HomeMy WebLinkAbout4424 - ADMIN Resolution - City Council - 1972/01/031, Original January 3, 1972 RESOLUTION NO. 4424 RESOLUTION IN RELATION TO MINNESOTA POLLUTION CONTROL AGENCY IMPLEMENTATION PLAN WHEREAS, the City Council of the City of St. Louis Park is the official governing body of the City of St. Louis Park, and WHEREAS, the City Council understands that the Minnesota Pollution Control Agency is contemplating the approval of certain regulations and standards entitled "Implementation Plan", and WHEREAS, as part of a plan there is provision made for the delegation of authority to local units, which local unit for Hennepin County would be the Minneapolis agency, and WHEREAS, the City Council on May 20, 1968, passed a comprehensive air pollution ordinance and has since implemented an effective and progressive air pollution control program within St. Louis Park through the use of consultants and extensively trained professional staff, the purchase of equipment and the use of necessary enforcement procedures, and WHEREAS, the City Council recognizes the need for regional coordination of air pollution control but at the same time believes that local air pollution problems can best be controlled by the City of St. Louis Park because: 1. The City already has a competent staff experienced in local pollution problems. 2. 'The St. Louis Park pollution control program has been successful and is an integral part of an overall enforcement program which overlaps with other programs of the City thereby adding to the comprehensiveness and effectiveness of all the programs, and WHEREAS, the Minnesota Pollution Control Agency has always encouraged and supported the St. Louis Park pollution control program, and WHEREAS, the City' Council believes it important to establish and maintain the participation of local government bodies in state programs, particularly in the area of pollution control, and WHEREAS, the proposed Implementation Plan casts doubt upon the continued existence and effectiveness of the St. Louis Park pollution control program, therefore, BE IT RESOLVED, by the City Council of the City of St. Louis Park in regular meeting assembled that the City Council opposes the approval by the Minnesota Pollution Control Agency of its Implementation Plan to the extent that the plan appears to delegate the authority and responsibility solely to the Minneapolis agency to police and enforce the pollution control programs within the corporate limits of the City of St. Louis Park and requests that the plan be clarified to indicate that the City of St. Louis Park will have full authority under the plan to police and enforce pollution control programs within its corporate boundaries subject to meeting reasonable guidelines set by the Minnesota Pollution Control Agency, BE IT FURTHER RESOLVED, that the City Clerk cause a copy of this Resolution to be aelivered to the Pollution Control Agency before it considers whether or not to approve its Implementation Plan and that the Pollution Control Agency be urgently requested to consider the position of the City of St. Louis Park with regard to this plan.
