RESOLUTION GRANTING PERMIT UNDER SECTIONS 6:176.2 AND
6:176.4 OF THE ST. LOUIS PARK ZONING ORDINANCE FOR RESIDENTIAL
DEVELOPMENT UNIT AND COMMERCIAL DEVELOPMENT UNIT,
CHARLES M. FREIDHEIM CO.
WHEREAS, application has been made to the City Council by Charles
M. Freidheim, Co. for permit under Section 6:176.2 and 6.176.4 of the
St. Louis Park Zoning Ordinance for the following purpose:
to use land in R B, Residential Business District, for a Residential
Development unit and commercial development unit for multiple
family dwellings, offices, motor hotel and retail sales and services
as permitted.
at the following location, to -wit:
that part of the southwest one-quarter of the southwest one-quarter
of Section 6, Township 28, Range 24, lying southwest of the
centerline of W. 36th Street and easterly of the east right-of-way
line of State T.H. 100, Hennepin County, Minnesota.
WHEREAS, the Council has considered the advice and recommendation
of the Planning Commission (Case No. 71-69-S.P.) and the effect of the
proposed use on the health, safety and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, including
parking facilities on adjacent streets, and the effect on values of pro-
perties in the surrounding area, and the effect of the proposed use on the
Comprehensive Plan, therefore
BE IT RESOLVED by the City Council of the City of St. Louis Park
that it is hereby determined that the said proposed use will not be
detrimental to the health, safety or general welfare of the community nor
will it cause serious traffic congestion, nor hazards, nor will it
seriously depreciate surrounding property values, and the same is in
harmony with the general purpose and intent of this ordinance and the
Comprehensive Plan, and
BE IT FURTHER RESOLVED that permit be hereby granted to the applicant
for the purpose above set forth, subject, however, to the following
conditions:
1. The site shall be developed, used and maintained in
accordance with the following exhibits: Exhibit A,
Park Center (General Site Plan); Exhibit B, Final Plat
of Park Center, Exhibit C, Drainage and Utility Plan;
except as said exhibits may hereinafter be modified through
conditions or new exhibits.
2. That the existing concrete block plant, block storage and
associated facilities and uses be eliminated prior to
December 31, 1972.
3. Before a permit shall be issued for any construction on
any lot or lots included in the plant, an amendment to this
special permit which includes a detailed site and development
plan for land to be included in such building permit must be
approved by the City. Such detailed site plans must conform
to the general site plan, Exhibit A. Land use component
Exhibit "D", and the architectural form and treatment of
proposed buildings shall take into account the architectural
form and treatment of the structures in the area!
4. All electric, telghone or other wire or cable distributed
services, gas, sewer, and water services shall be placed
underground.
5. Lot 2 add Lot 3, Block 2 are limited to residential use.
6. All lots must be developed in accordance with the open space
links and pedestrian ways extending from Wolfe Park through the
site as shown on Exhibit "A". Each lot shall have access rights
over those portions of the pedestrian system located on other
lots and shall in turn provide access to the other lots. Proper
easement agreements shall be provided when detail plans for
development are presented.
This resolution shall become effective fifteen days after the property
as described in this resohtion is changed to RB (Residential Business) zoning.
