RESOLUTION GRANTING PERMIT UNDER SECTION
6:122.11 OF THE ST. LOUIS PARK ZONING ORDINANCE
FOR ADDITIONAL DRIVE IN TELLER FACILITY
WHEREAS, application has been made to the City Council by Citizens
State Bark of St. Louis Park for permit under Section 6:122.11 of the St.
Louis Park Zoning Ordinance for the following purpose:
To construct additional drive in teller facility
at the following location:
5001 Excelsior Boulevard, to wit:
All that part of Section 7, Township 28, Range 24 described as
follows: Commencing at a point in the center line of Excelsior
Avenue distant 901 feet northeasterly along said center line from
its intersection with the center line of Wooddale Avenue; thence
southeasterly at right angles to said center line of Excelsior
Avenue 350 feet; thence South westerly parallel with Excelsior
Avenue 70 feet; thence Northwesterly 350 feet to a point in the
center line of Excelsior Avenue distant 70 feet southwesterly
from the point of beginning; thence Northeasterly 70 feet to
the point of beginning, subject to the State Highway, Excelsior
Avenue; together also with an easement for the sole purpose of
driveway egress from the said land (but not ingress) and not for
parking or other use, over the following described ground
contiguous to the above-described land, namely - the front or
northwesterly one hundred seventy-two (172) feet of the north-
easterly ten (10) feet of the land lying southwesterly from and
contiguous to the seventy-foot wide parcel above described; it
being understood that the right of grantees in said easement is
limited and restricted to the right of occupants of said seventy-
foot wide parcel to use said ten -foot driveway for egress only
from said seventy-foot wide parcel, entering the same in the
rear sixteen feet thereof, without in any way restricting the
rights of owners of the land lying southwesterly and southeasterly
from said ten -foot wide parcel of land to use the same for
purposes that will not interfere with such easement right;
and subject to the condition and convenant that said grantee,
his heirs, personal representatives and assigns shall equally
with grantor, their heirs, personal representatives and assigns,
maintain said driveway and pay any special assessments for
improving the same.
WHEREAS, the Council has considered (Case No. 71-57-S.P.) the
effect of the proposed use on the health, safety and welfare of the
occupants of the surrounding lands, existing and anticipated traffic
conditions, including parking facilities on adjacent streets, and the
effect on values of properties in the surrounding area, and the effect
of the proposed use on the Comprehensive Plan, therefore
BE IT RESOLVED by the City Council of the City of St. Louis Park
that it is hereby determined that the said proposed use will not be
detrimental to the health, safety or general welfare of the community
nor will it cause serious traffic congestion, nor hazards, nor will it
seriously depreciate surrounding property values, and the same is in
harmony with the general purpose and intent of this ordinance and the
Comprehensive Plan, and
BE IT FURTHER RESOLVED that permit be hereby granted to the
applicant until June 15, 1973 for the purpose above set forth, subject
however to the following conditions:
1. The site be constructed, used and maintained in accordance
with Exhibit A, Site Plan as modified by the Planning
Department on September 29, 1971.
2. All improvements including the teller station striping,
fencing and landscaping be completed by June 15, 1972.
