HomeMy WebLinkAbout544 - ADMIN Resolution - City Council - 1958/02/24372 Resolution No. 544 Adopted February 24, 1958 RESOLUTION GRANTING PERMIT UNDER SECTION 10.3 OF THE ZONING ORDINANCE OF THE CITY OF ST. LOUIS PARK WHEREAS, application has been made to the City Council by The Church of the Holy Family of St. Louis Park for permit under Section 10.3 of the Zoning Ordinance of the City of St. Louis Park for the following purpose: Erect a church building on and use for church purposes Lots 3, 4 and 5, Block 6, Del Monte Heights and WHEREAS, the Council has considered the advices and recommendations of the Planning Commission and the effect of the proposed use on the health, safety and welfare of the occupants of the surrounding lands, existing traffic conditions, including parking facilities on adjacent streets, and the effect on values and properties in the surrounding area, therefore BE IT RESOLVED by the City Council of the City of St. Louis Park that it is hereby determined that the said proposed use will not be detrimental to the health, safety or public welfare of the occupants of surrounding lands, nor will it cause serious traffic congestion, nor hazards, nor will it seri- ously depreciate surrounding property values, and BE IT FURTHER RESOLVED that permit be hereby granted to the appli- cant for the purpose above set forth upon condition that the said Church of the Holy Family of St. Louis Park shall execute and deliver to the City a recordable agreement in writing in form approved by the City Attorney sup- ported by appropriate bond or undertaking all approved in form by the City Attorney which shall provide as follows: 1. That the church structure be located according to Plot Plan A. 2. That size of church be limited to size described by the Church Parish to Council. 3. That area ways on Plan A and Plan B'be constructed to permit traffic access and exit with exception that traffic on Lake Street in front of church be revised( to eliminate parking lot desig- nated as holding 13 cars, and to extend the North-South traffic lane on West side of church property to enter Lake Street at the location designated by Planning Consultant. L. That all areas designated for parking on Plan A and Plan B except that area previously described and the area on Plan B located east of present School Building be appropriately dedicated in a re- cordable instrument to be delivered to the City. 5., That areas designated for parking be surfaced with a bit- uminous material to control dust. 6. That parking areas be maintained subject to change only by later action of the then Council, during the entire time the proper- ties in question are used for school and church purposes. 7. That a chain link fence of design acceptable to Council .shall be erected at location shown in Plan B and a fence be erected along westerly property line shown in Plan A, which shall be of suit- able design and approved by the Council, except that said fence shall not be required to extend beyond the front line of the church edifice. 8. All green areas shown on both plans be established and maintained during the time properties are used for church and school purposes. Resolution No. 544 - continued 9. That church driveways on Plan A be designated as one way with entrance on Zarthan Avenue and exit on Lake Street. 10. That in construction of church the design shall be such that no shadow line shall extend further to the West than that shown in Plan C. 11. That Parish provide City with a written statement of intentions that a parking attendant or attendants as may be required will be furnished to direct and supervise parking in off street park- ing area for each meeting, service or other function which shall be held in church edifice, except attendance by school children at school and a statement of Policy from the Parish that the Parish will pur- chase additional property for parking when such property is available at a fair market value. 12. That the plans for church structure shall be prepared so that no drainage from church property will enter upon property to west or north of church structure. H. P. PARK WHEREAS, application has been made to the City Council by LeRoy Sign'Inc. for permit under Section 10.3-20 and 10.5 of the Zoning Ordinance of the City of St. Louis Park for the following purpose: erect_a. 50' x 4' sign (200 sq. -ft.) replacing present sign at 6320 Minnetonka Boulevard (Boulevard Pharmacy) and WHEREAS, the Council has considered the effect of the proposed use on the health, safety and welfare of the occupants of the surrounding lands, existing traffic conditions, including parking facilities,on adjacent streets, and the effect on values and properties in the surrounding area, therefore BE IT RESOLVED by the City Council of the City of St. Louis Park that it is hereby determined that the said proposed use will not be .detrimental to the health, safety or public welfare of the occupants of surrounding lands, nor will it cause serious traffic congestion, nor hazards, nor will it serious- ly depreciate surrounding property values, and BE IT FURTHER RESOLVED that permit be hereby granted to the appli- cant for the purpose above set forth.
