Fernstrom Mayor _ Attest: Joseph Justad City Clerk Resolution No. 1.78 Adopted October 114, 1957 AMENDING ARTICLE 20 OF THE CITY STANDARD GENERAL CONTRACT CONDITIONS BE IT RESOLVED by the City Council of the City of St. Louis Park that Article 20 of the standard General Contract Conditions heretofore adopted by the City Council for use and incorporation into all construction contracts en- tered into by the City shall be amended to read as follows: 20. Contractorts Insurance: The Contractor shall not commence work under this contract until he has obtained all insurance required under this paragraph, and has submitted certificates evidencing such insurance to the City Clerk, nor shall the Contractor allow any sub -contractor to commence work until all similar insurance required by the sub -contractor has been obtained and approved. 304 Resolution No. )78 - continued Public Liability and Property Damage Insurance: The Contractor shall take out, and maintain during the life of this contract, such public liability and property damage insurance as shall protect him and any sub- contractor performing work covered by -this contract from claims for damages for personal injury, including accidental death, as well as from claims for property damage, which may arise from operations under this contract, whether such operations be by himself or by any sub -contractor, or by any- one directly or indirectly employed by either of them, and including claims arising by reason of an injury or damage sustained after the Contractor has completed the work or left the site thereof. The amount of such insur- ance shall be as follows: (a) Public liability insurance in an amount not less than $75,000.00 for injuries, including accidental death, to any one person and in an amount not less than $100,000.00 on account of one accident, and property damage insurance in an amount not less than $25,000.00. (b) Compensation Insurance: The Contractor shall take out and maintain during the life of this contract such workmen's compensation in- surance as shall be required by the laws of the State of Minnesota. (c) Fire and Windstorm Insurance: If the nature of the install- ation is such that it is insurable against fire or windstorm, such insur- ance will be effected and maintained by the City and the loss made payable to the City as trustee to whom it may concern. (d) An Owner's Protective Liability Policy in which the City shall be named as insured and which shall insure the City against claims for dam- ages for personal injury, including accidental death, and for damage to property, which may arise from operations under this contract, whether such operations be by the Contractor or:'any sub -contractor, or by anyone directly or indirectly employed by either of them, or any officer or agent of the Cir, including claims arising by reason of any injury or damage sustained after the Contractor has completed the work or left the site thereof. The amount of such insurance shall be not less than $75,000.00 for injuries, including accidental death, to any one person, and in an amount of not less than $100,000.00 on account of one accident, and property damage insurance in an amount not less than $25,000.00. The Contractor may, in lieu of furnishing said owner's protective liability policy, secure an endorsement to the public liability and property damage insurance required under (a) above which shall provide that the City shall be included as an additional assured protected by said policy. The Contractor shall furnish certificates executed by the authorized representative of the insurer issuing each of the policies required herein and certifying to the insurance coverage herein required and stipulating that the policy will not be canceled on less than ten days' notice to the City. Upon request by the City the Contractor shall promptly furnish to the City for examination at any time and from time to time all contracts of insurance required under this article.
