it appears to the Council that it is necessary that the city acquire easements
for the purpose of construction and maintenance of said relief ditch, there-
fore
BE IT RESOLVED by the City Council of the City of St. Louis Park that
the city shall take by right of eminent domain relief ditch easements over the
above described land, and the City Attorney be hereby authorized and directed
to commence proceedings in the District Court of Hennepin County for appoint-
ment of Commissioners to determine the damages, if any, sustained by the
respective owners of the parcels affected, as authorized by law, and
BE IT FURTHER RESOLVED that the easements above referred to are more
particularly described as the free right of the city to enter upon said premises,
together with its employees and contractors, and to excavate the soil and con-
struct and maintain an open drainage ditch for drainage of surface waters; the
right to enter upon said premises at all times to inspect, repair and recon-
struct said ditch and to maintain the same free from obstruction for the flow
of surface waters; and the right to deposit soil excavated from the ditch
upon adjacent land.

SETTING HEARING ON PROPOSED SPECIAL ASSESSMENTS
WHEREAS, the City Council has heretofore ordered the improvements
hereinafter described and the same have been completed and_accepted by -the
City, and the City Clerk with the assistance of the City Engineer has cal-
culated the proper amount to be specially assessed for the respective im-
provements against every assessable lot, piece or parcel of land, in accord-
ance with the provision of Section 429.051, Minnesota Statutes, and the
proposed assessment roll has been filed with the Clerk, therefore
BE IT RESOLVED that the City Clerk publish notice that the City Council
will meet to consider the proposed assessments on September 16, 1957 and
BE IT FURTHER RESOLVED that the improvements above referred to and
of each is as hereinafter set forth in the following list:

The proposed area to be assessed for each of the fore-
going improvements is the lots and tracts adjoining
the streets above described where the improvements
were made.
Sanitary Sewer
In West 38th Street in the City of
Minneapolis between Drew Avenue
South and Xerxes Avenue South to
serve as an outlet for District
Sanitary Sewer No. 2 of said City
'of St. Louis Park.
The area proposed to be assessed will be Joint Sanitary
Sewer District No. 2 as described in Ordinance No. 239
of said City and in addition thereto those areas of the
city described as follows:
Commencing at the intersection of Division Street
and Texas Avenue; thence north on Texas Avenue to the
north line of Lot 14, Block 2, Texa-Tonka; thence west
along the north lot line of Lots 14, 20, 21, 22, 23,
24 and 27, Block 2, Texa-Tonka to Virginia Avenue;
thence south in Virginia Avenue to Minnetonka Boulevard;
thence west in Minnetonka Boulevard to the right-of-way
of Great Northern R. R. Hopkins spur track; thence
SWly along said right-of-way to Minnehaha Creek; thence
SEly along Minnehaha Creek to its intersection with
the St. Louis Park -Hopkins boundary; thence east along
an extension of Division Street to the point of begin-
ning in Texas Avenue.
Also, commencing at the intersection of the
right-of-way of Chicago, Milwaukee, St. Paul & Pacific
R. R. with the Hopkins -St. Louis Park Boundary;
thence south and east along said boundary to Excelsior
Boulevard; thence easterly along Excelsior Boulevard

thence north in Edgewood Avenue to the north line of
Section 20, Township 117, Range 21; thence west along
said north line to the main tract of the Chicago,
Milwaukee, St. Paul & Pacific R. R.; thence SWly along

RESOLUTION GRANTING PERMIT UNDER SECTION
10.3 OF THE ZONING ORDINANCE OF THE
CITY OF ST. LOUIS PARK

WHEREAS, application was made to the City Council by Liebenberg &
Kaplan, architects, for permit under Section 10.3 of the Zoning Ordinance of
the City of St. Louis Park, for the following purposes: To construct a
Presbyterian church on Lots 14 through 19, Block 1, Westwood Hills First
Addition, and
WHEREAS, by Resolution No. 175, adopted November 7, 1955, the City
Council did grant permission to the applicant for the purposes above set forth,
and
WHEREAS, application is made at this time by The Peace Presbyterian
Church for the purpose of constructing a Presbyterian church upon Lots 12
through 19, Block 1, Westwood Hills First Addition, and Lots 16, 17 and 18,
Block 3, Westwood Hills First Addition,
WHEREAS, the Council has considered the advices and recommendations
of the Planning Commission and the effect of the proposed use on the health,
safety and welfare of the occupants of surrounding lands, existing traffic
conditions including parking facilities on adjacent streets, and the effect
on values of properties in the surrounding area, therefore
BE IT RESOLVED by the City Council of the City of St. Louis Park that
it is hereby determined that the said proposed use will not be detrimental to
the health, safety or public welfare of the occupants of surrounding lands,
nor will it cause serious traffic congestion, nor hazards, nor will it seri-
ously depreciate surrounding property values; and
BE IT FURTHER RESOLVED, that Resolution No. 175, adopted November
7, 1955, be amended and superseded by this resolution; and
BE IT FURTHER RESOLVED that permit be hereby granted to the appli-
cant for the purposes above set forth.
