REJECTING BIDS FOR SANITARY SEWER IMPROVEMENT
NO. 56-52 SECTIONS B AND C
WHEREAS, pursuant to advertisement for bids duly published, the City
Council received and opened bids May 13, 1957, for construction of Sanitary
Trunk Sewer No. 3, Sewer Improvement No. 56-52, Sections A, B and C, and
WHEREAS, on May 20, 1957, the City Council by resolution determined
that the bid so received from Nodland-Barbarossa, a joint venture, for Section
A, in the sum of $986,059.00, was the lowest bid of a responsible bidder for
said Section A, and that the bid of L & L, a joint venture consisting of
Lametti & Sons, Inc. and Peter Lametti Construction Co., was the lowest bid
of a responsible bidder for Sections B and C, and the City Council did at
said time reject the bid of a joint venture consisting of Rue Contracting
Company, a partnership, and Sornsin Construction Co. Inc., a corporation, as
not being the lowest bid of a responsible bidder, and
WHEREAS, legal action has been commenced questioning the validity of
the contract to be entered into with said L & L, joint venture and Nodland-
Barbarossa, joint venture and
WHEREAS, it appears to the City Council that due to municipal bond
market conditions it would be unwise to attempt to issue bonds to finance
construction of said Sections A, B and C at this time, and that delay in con-
struction of Sections B and C and the necessary financing of the same would be
desirable in order to obtain a favorable interest rate, and
WHEREAS, the Council has been advised by its Engineer that substantial
saving in construction and supervision cost may be anticipated by re-adver-
tising for said Sections B and C upon the basis of completion by May 1, 1958,
in lieu of October 1, 1958, as provided for in the original contract conditions,
therefore
BE IT RESOLVED by the City Council of the City of St. Louis Park that
the said bids received May 13, 1957, for Sections A, B and C, Sewer Improvement
56-52, by L & L, joint venture, and said Sornsin & Rue, joint venture, the same
being submitted as "tied" bids, be hereby rejected together with bid of Nodland-
Barbarossa for Sections B and C, and
BE IT FURTHER RESOLVED that action of the City Council May 20, 1957,
determining the said bid of Nodland-Barbarossa, joint venture, to be the lowest
bid of a responsible bidder received for said Section A, and authorizing ex-
ecution of Contract by the Mayor and City Manager for said Section A is hereby
ratified and confirmed, and
