WHEREAS, the Minneapolis, Northfield & Southern Railroad has offered
to reconstruct its existing overpass bridge at the intersection of Cambridge
Avenue and the Minneapolis, Northfield & Southern Railroad, on the basis
that the City shall contribute one-third of the cost thereof, therefore
BE IT RESOLVED by the City Council of the City of St. Louis Park that
the City shall undertake said Improvement No. 56-98, construction of overpass
bridge at the intersection of Cambridge Avenue and the Minneapolis, Northfield
& Southern Railroad, as a necessary improvement of said Cambridge Avenue,
and the Mayor and City Manager be hereby authorized to enter into a contract
on behalf of the City with the Minneapolis, Northfield & Southern Railroad
for the construction of such bridge as now proposed by the said railroad on
the basis of payment of two-thirds of the cost thereof by the said railroad
and one-third thereof by the City, the maximum payable by the City to be
$11,000.00, provided, however, that the Railroad and Warehouse Commission of
the State of Minnesota shall make its order directing construction of said
bridge and division of the cost thereof between the City and the railroad on
said basis, and the City Manager is hereby authorized and directed to execute
in behalf of the City a petition jointly with the said railroad to the Commiss-
ion for such an order.

APPROVING REQUEST OF CITY OF HOPKINS FOR STORM
SEWER PERMIT
WHEREAS, the City of Hopkins has requested permission to construct
its storm sewer which will drain Excelsior Boulevard west of the St. Louis
Park -Hopkins boundary in Powell Road northerly from Minnehaha Creek as an
outlet, and
WHEREAS, the City Council deems it proper to allow said sewer to be
constructed by the City of Hopkins on the conditions hereinafter set forth,
BE IT RESOLVED by the City -Council of the City of St. Louis Park that
the City Manager be authorized to enter into negotiations with the City of
Hopkins for granting of a permit to said City for construction of storm
sewer in said Powell Road upon the condition that the City of Hopkins will
enter into such agreement as shall be recommended by the City Attorney
providing for indemnity to the City of St. Louis Park for any claims that
may arise on account of construction, maintenance or use of said sewer,
and obligating the City of Hopkins to pay for all labor and material in
connection with construction, reconstruction or repair of said sewer and
for replacement of the surface of the roadway where the sewer is constructed.
