RESOLUTION REGARDING ENCROACHMENT OF ANY KIND
WHATSOMM IN CONNECTION WITH
S.P. 27]1-39 (Bridge) & S.P. 2714-38 (T.H. 12=10)
WHEREAS, the City of St. Louis Park has approved the plans and specifi-
cations for the improvement of that part of Trunk Highway Number 10 renumbered
as Trunk Highway Number 12 within the corporate limits of the City of St. Louis
Park from 0.22 mile west to 0.30 mile east of Jct. with S.A.R. 18; and _
WHEREAS, in order to obtain Federal aid in the construction of said
Trunk Highway Number 10 renumbered as Trunk Highway Number 12 the Bureau of
Public Roads requires the assurance that the City of St. Louis Park will not
suffer any encroachment of any nature or kind whatsoever on the right of way
of said Trunk Highway Number 10 renumbered as Trunk Highway Number 12 ilithin
the corporate limits of the said City of St. Louis Park; and
WHEREAS, the Commissioner of Highways desires in the interest of
public safety that all parking of vehicles on said trunk highway be parallel
with the curb and at least 20 feet from any crosswalk.
NOW, THEN, BE IT RESOLVED that said City of St. Louis Park does hereby
agree and covenant that it will never permit. or suffer, within its corporate
limits, any encroachment of any kind whatsoever, including curb gas pumps and
gas stations, billboards or other structures of any kind whatsoever, upon the
right of way of Trunk Highway Number 10 renumbered as Trunk Highway Number 12
and to the above end said City of St. Louis Park hereby agrees that it will
never issue any license, permit, or grant, or give any leave or liberty or any
other consent of whatever form for the construction or maintenance of any en-
croachment whatsoever, including curb gas pumps and gas stations, billboards
or other structures of any kind whatsoever, upon said right of way; and that
said City of St. Louis Park will cooperate insofar as possible to eliminate
existing encroachments constituting traffic hazards and will further take
any necessary action to eliminate any encroachment that may hereafter exist
on said trunk highway right of way; and
BE IT FUR'1HER RESOLVED that said City of St. Louis Park does hereby
agree to require _the parking of all vehicles on said trunk highway to be
parallel with the curb and at least twenty (20) feet from any crosswalks on
all public streets intersecting said trunk highway within the corporate
limits of said City of St. Louis Park.

RESOLUTION SUPPORTING STATE CONSTITUTIONAL AMENDMENT NO. 2
WHEREAS,- proposed Amendment No. 2 to the Constitution of the State
of Minnesota, to be submitted to the voters of the state at the general
election November 6, 1956, will authorize a division of revenues collected
by the state from gasoline and motor vehicle taxes between the state and
political subdivisions thereof, including the City of St. Louis Park, and
WHEREAS, a substantial portion of these taxes are contributed by
the citizens of this City, and under the existing law cannot be made avail-
able for maintenance or improvement of Highways within the City other than

state highways, and whereas the amendment will authorize expenditure of
funds to improve certain city streets, it is deemed by the City Council
that the division authorized by this amendment is equitable and necessary
to the welfare of the City and its citizens, therefore
BE IT RESOLVED by the 'City Council of.the City of St. Louis Park
that said proposed Constitutional Amendment No. 2 be hereby supported and
approved for adoption by the citizens of this City.

AUTHORIZING PETITION TO THE RAILROAD AND
WAREHOUSE COMMISSION OF THE STATE OF
MINNESOTA IN REGARD TO CERTAIN DANGEROUS
CROSSINGS
WHEREAS, at the grade crossing of Wooddale Avenue with the right-
of-way of the Minneapolis and St. Louis Railroad and the Chicago, Milwaukee,
St. Paul & Pacific Railroad, and also at the grade crossing of Brunswick
Avenue with said railroad rights-of-way, there have been installed automatic
warning signals pursuant to order of the Railroad and Warehouse Commission
of the State of Minnesota, and
WHEREAS, it has become the practice for one or both of said rail-
roads to operate locomotives and trains in the vicinity of said inter-
sections and to cause and permit such locomotives and trains to stand in
the vicinity of such intersections for substantial periods of. time, and be-
cause of the presence of such locomotives and trains standing at such lo-
cations the said automatic signals are caused to flash the warning indicat-
ing an on -coming train and to continue with such flashing so long as such
locomotives and trains are standing in such position; that the result of
said continuous flashing of said signals for substantial periods of time,
with no train actually approaching the intersection, is to cause confusion
to motorists using said grade crossings, some of whom feel obliged to re-
main standing so long as the signals flash - thereby obstructing traffic, and
others proceeding on the assumption that no train is approaching; that due to
the fact that said grade crossings involve the parallel main lines of both of
said railroads, the City Council deems that said condition is dangerous to
the public and that it is imperative that this dangerous condition be remedied
and to accomplish such remedy that the said railroad companies be required to
provide flagmen at such crossings when causing the signal devices to be
operated for substantial periods of time by reason of a standing locomotive
or train, or that they -be required by the Railroad and Warehouse Commission
to adopt such safety device as the Commission may deem necessary for the
proper protection of the crossings, therefore
BE IT RESOLVED by the City Council of the City of St. Louis Park
that the City Manager be hereby authorized and directed to file with the
Railroad and Warehouse Commission of the State of Minnesota, pursuant to
authority of this resolution a complaint on behalf of the City that the said
railroad grade crossings with Wooddale Avenue and Brunswick Avenue in the
City of St. Louis Park are dangerous to life and property for the reasons set
forth in this resolution and praying that the Commission require said rail-
roads to provide flagmen at such crossings at all times when the automatic
signal devices are operated by reason of standing locomotives and trains in the
vicinity of these crossings, or to adopt such safety devices as the Commission
may deem necessary for the proper protection of the crossings, as authorized
by section 219.40, Minnesota Statutes.
