Resolution No. 241A ,Adopted May 14. 1956 RESOLUTI O N RESOLVED that Resolution No. 241 setting hearings for Curb and Gutter and Sidewalk for May 21, 1956 be amended so as to provide for said hearings being held at'the Council meeting -June 4, 1956. ,fifziAjP Resolution No. 242 �9- 1)14- I RESOLUTION NO. 242 PRESCRIBING RULES AND REGULATIONS FOR PURCHASE OF INSURANCE BY THE CITY Adopted May 14. 1956 WHEREAS, it has been the policy of the City and Village Councils respec- tively for many years past to purchase insurance requirements of the City and Village respectively from insurance agents doing business within St. Louis Park, the agents selected for this purpose being designated as "Associated Agencies", and the Council now deems it proper that rules be adopted for deter- mination of insurance agents eligible to participate in writing of City insur- ance and prescribing the procedures for obtaining and underwriting such insur- ance, BE IT RESOLVED by the City Council of the City of St. Louis Park as follows: 1.- It is hereby declared to be the policy of the City Council fo secure the underwriting of all insurance requirements of the City through a group of insurance agents, to be selected and said insurance,to be written in accordance with the rules hereinafter established, said group of agents -to be hereinafter called the "underwriting agencies". 2. The City Council shall determine the insurance agents who shall be members of the underwriting agencies upon the basis of the qualifications of each agent to perform the services required by the City in underwriting its insurance and financial responsibility. In addition, the City Council shall determine that each agent shill have complied with the following minimum re- quirements: ' (a) The agent shall be a resident of the City at the time he makes application and shall remain a resident of the City during all the time that he acts as a member of the underwriting agencies. 155 Resolution No. 242 - continued (b) The applicant shall maintainihis principal, insurance office with- in the City dP St. Louis Park,`staffed with competent clerical personnel during regular business hours, and he shall have maintained said office in the City for at least three years prior to his application. (c) If required by the City Council, the applicant shall furnish the City Council with a statement showing adequate financial responsibi- lity. (d) The applicant shall present evidence satisfactory to the Council that he derives his income primarily from commissions from the sale of insurance, and devotes approximately 85% of his time to the direct sale of insurance. (e) The applicant shall furnish the Council with evidence that he is authorized to underwrite types of insurance required by the City in one or more insurance companies having a General Policy Holders of A or A plus Rating, in the latest issue of BBst's Insurance Guide, and shall furnish the Financial Rating as shown in the latest issue of Best's Insurance Guide of all Companies which they represent. (f) The agent will file an application in writing with the City Clerk setting forth the location of his place of business, residence address, the length of time he has been in the insurance business in St. Louis Park and elsewhere, the insurance companies he is authorized to represent and with which he regularly places insurance as a broker, and the types of insurance, if any, in which he specializes, together with such additional information as shall satisfy the requirements above set forth and as shall be required by the City Council or the City Manager. (g) Only individual insurance agents licensed as such by the State of Minnesota will be designated as members of the underwriting agencies. Such individuals may be male of female. 3. An applicant to become a member of the underwriting agencies shall be referred by the City Clerk to the City Manager and City Council forthwith and shall be investigated by the City Manager, who shall report the results of his investigation to the City Council promptly, and the Council shall act to approve or disapprove the application within thirty days after filing thereof. A detennina4 tion as to whether the applicant shall be eligible to become a member of the underwriting agencies shall be within the discretion of -the City Council and the designation of any agent as a member of the underwriting agencies shall be sub- ject to termination by the City Council at any time that the Council shall deter- mine that the applicant is no longer qualified to continue as a member thereof, and the privilege of being a member shall be personal and not subject to assign- ment or transfer in any manner whatsoever to any other person, firm, or corpor- ation. 4. The insurance requirements of the City shall be underwritten by the underwriting agencies in accordance with the following rules: (a) The individual agents comprising the underwriting agencies shall adopt rules in writing covering the writing of City insurance, the collection and remittance of premiums for the same, and the division of commissions, which rules shall be subject to approval by the City Council and having been so approved shall be binding upon each individual member of the underwriting agencies who continue to participate in the under- writing of City insurance and the division of commissions thereon. (b) The City manager, with approval of the Council, shall designate a liaison member of the underwriting agencies who shall be responsible for securing all applications for insurance from the.City, billing of premiums, payment and remittance of premiums, procurement and delivery of policies, modification, endorsement of policies, and all service required by the City in connection with purchase and placement of its policies and filing of claims. 136 Resolution No. 242 - continued The liaison member'shall ,rovide at all thhes:'.an- analysis of each policy issued to the City, which shall be kept on file in the City Clerk's office. This analysis shall be made on a Remington Rand Kardex form, or a similar record system providing all pertinent data to each and every policy issued to the City. (c) Each agent participating as a member in the underwriting agencies who issues any insurance policy for the City in behalf of any insuring company shall be covered by an "errors and omissions" policy to cover the City in a sum determined by the City Council in the event of any errors or omissions, and a certificate of said policy issued by the insurer shall be filed with the City Clerk. 0 (d) All policies issued to insure the City shall be issued by insur- ance companies licensed to do business in the State of Minnesota. (e) Applications for insurance shall be placed by the City Manager with the Liaison member, and it shall be the duty of all members of the underwriting agencies to confer and recommend through the liaison member in writing to the City Manager the most favorable and adequate coverage for the purposes requested. The City Manager shall, on the basis of recommendations given him, order the insurance coverage in the particular companies as approved by the City Council. 5. A board of Review shall be appointed each year by the City Council to analyze and study all insurance coverage carried, required and desirable for protection of the City and its property. This Board shall examine policies of insurance in force and make its recommerdations to the City Council. This Board shall be composed of three underwriting specialists employed in the Twin City Area by casualty, fire and surety companies, consideration being given to appointment of C P C. U Is where possible. The members of this Board shall be compensated by the City, as the City deems advisable. Resolution No. 243 Adopted May 14. 1956 RESOLUTION NO. 243, REFUNDING GARBAGE ASSESSMENT WHEREAS it appears that the following property owner has been inadvertantly assessed for garbage collection during years 1951 (payable 1952) thru 1954 (Payable 1955) and said assessments have been paid, and WHEREAS A letter from the owner and a statement from Suburban Drayage Company confirm the fact that no such service was rendered to the property assessed, therefore BE IT RESOLVED by the City Council of the City of St. Louis Park that the 1951 thru 1954 installments of such assessment heretofore paid in the respective amounts hereinafter set forth be refunded to the property owner, and upon receipt of a signed verified claim and the paid tax statements, that the City Manager, the City Clerk, and the City Treasurer by hereby authorized to issue a check in payment of such refund to the property owner.
