HomeMy WebLinkAbout210 - ADMIN Resolution - City Council - 1956/02/06Resolution No. 209 Adopted ,January 30, 1956 117 On the motion of Councilman Bolmgren, seconded by Councilman Wolfe, the foll- owing resolution, having been read by/the Secretary, was adopted by unanimous vote of the Councilman present: RESOLUTION REFUNDING 53-82 CURB AND GUTTER #505 ASSESSMENT WHEREAS it appears that on October 20, 1953, Lorenz H. Kyllo of 2905 Wyoming Avenue paid in full to the Village of St. Louis Park the above assessment in the amount of $105.25 (Receipt #20395), and WHEREAS the County Auditor's office cancelled said assessment on the owner's tax statement for 1953 (Payable 1954); and WHEREAS the County auditor's office inadvertantly put the above 'assessment back on said owner's tax 'statement for 1954 (payable 1955) in the amount of $25.26, which the owner paid again on the tax statement; therefore BE IT RESOLVED by the City Council of the City of St. Louis Park that the 1955 installment of such assessment heretofore paid in the amount set forth below be re- funded to the respective property owner, and, upon receipt of a signed verified claim and the paid tax statement, ,that the City Manager, the City Clerk, and the City Treasurer be hereby authorized to issue_a check in payment_of such refund to the same property owner. Kyllo 2905 Wyoming LOT 4 AMOUNT TO BE REFUNDED BLK ADDITION 1955 Amt. 1 Texa Tonka 3rd $25.26 Resolution -No. 210 Adopted February 6, 1956 On motion of Councilman Wolfe, seconded by Councilman Schadow, the following resolution having been read was.adopted by the unanimous_vote of all members of the Council present: RESOLUTION AMENDING RESOLUTION LEVYING WATER MAIN ASSESSMENT WHEREAS, on June 20,.1955, the City Council duly adopted a resolution provid- ing for levy of assessment for water mai,n_project No. 54-1 and 54-2, said assessment resolution_ including lots on Monterey Avenue -from 252 Street to 26th Street, being Lots numbered 36 to 44, -Block 8 and Lots numbered 1 to 7, Block 9, Thorpe Bros. Cedar Lake Heights; and it further appearing that said assessment was made payable inzoneiinstallment because of an understanding between the Council and the owners of property in Cedarwood Second Addition at whose request the water main project was ordered, and WHEREAS, it,appears that said extension, in Morierey Avenue was added at the in- stance of the City Engineering Department, without any understanding with the owners of said lots that the -assessment would be payable.on a one -instilment basis, the customary basis being over a period of ten years, -and it appearing that extending the levy to said lots on a one-year basis was thru inadvertence, therefore BE IT RESOLVED by the City Council that said resolution of June 20, 1955, be hereby amended so as to provide that the assessments therein levied'against the above described lots in Thorpe Bros. Cedar Lake Heights Addition shall be payable over a period of ten years, the first installment of which shall be payable con- currently with taxes levied in 1955_ and payable in 1956; and the Clerk is directed to certify an amended assessment roll to the County Auditor.
