Resolution No. 83 Adopted _Tune 13. 1955
On motion of Councilman Davis, seconded by Councilman Perkins, the follow-
ing resolution, having been read by the Secretary, was adopted by unanimous vote
of all Members of the Council present:
RESOLUTI O N
BE IT RESOLVED, that the City of St. Louis Park as a condition of the receipt
by the County of Hennepin of Federal Funds for the construction, reconstruction or
improvement of any State Aid Road within the City enter into an agreement with
the County, a copy of which is attached hereto and made a part hereof:
BE IT FURTHER RESOLVED, that the Mayor and Clerk be and they hereby are
authorized to execute said Agreement for and on behalf of the City.
Agreement
On motion of Councilman Davis, seconded by Councilman Perkins, the following
agreement was approved for execution by the Mayor and Clerk for and on behalf of
the City.
AGREEMENT BETWEEN MUNICIPALITY AND
COUNTY FOR FEDERAL AID HIGHWAY
IMPROVEMENT
THIS AGREEMENT made by the City of St. Louis Park, Minnesota, hereinafter
called the "Municipality" with the County of Hennepin, hereinafter called the
"County", WITNESSETH:
WHEREAS the United States Government, through the Bureau of Public Roads of
the Department of Commerce does apportion Federal funds for the construction,
reconstruction arid improvelgent of highway projects on approve systems of public
roads, and
WHEREAS said State -Aid Roads within the limits of a Municipality are now or
may be eligible for the participation of these Federal Funds in their improvement
or construction, and
WHEREAS the Bureau of Public Roads as a condition to the use of Federal
funds' on approved State -Aid projects requires the agreement of the municipality
to control road signs, traffic control devices, advertising signs, miscellaneous
installtions, speed and parking, NOW, THEREFORE,
The Municipality in consideration of the expenditure and use of Federal
Funds for the construction, reconstruction, or improvement of any State -Aid Road
within the limits of the Municipality agrees with the County as follows:
1. No signs, traffic control devices or other protective structures shall
be erected on any Federal Aid secondary project within the Municipality limits
except as shall conform with the Manual on Uniform Traffic Control, Devices dated
August 1948, prepared by the American Association of State Highway Officials,
approved by the State of Minnesota, and concurred in by -the Commissioner of Public
Roads, or any subsequent revisions.
2. All right of way within the limits of the Municipality on any Federal
Aid Secondary Project shall be held and maintained inviolate as a public highway
and no signs, other than traffic control or protective devices, poster, billboards,
Roadside stands, curb pumps, curb service devises or other private installations
shall be permitted within the right of way limits of the project. The Municipality
will with respect to such items as are within its jurisdiction which may be or
cause an obstruction or interfere with the free flow of traffic or which may be or
cause a hazard to traffic or which may vitiate or impair the usefullness of the
project and which maybe required to be removed by the County at its own election
or at the request of the Commissioner of Public Roads remove or cause removal of
the same.
3. The speed limits on any Federal Aid Secondary Project shall not be less
than 30 miles per hour.
4. Parking regulations generally recommended by the Commissioner of Highways
and the Commissioner of Public Roads for use under similar conditions shall be
adopted on any Federal Aid Secondary Project.
