HomeMy WebLinkAbout162 - ADMIN Resolution - City Council - 1955/10/1088 Resolution No. 161 Adopted October 10, 1955 On motion of Councilman Bolmgren, seconded by Councilman Jorvig, the follow- ing resolution having been read was adopted by the unanimous vote of all members of the Council present: RESOLUTION ORDERING ACQUISITION OF PROPERTY TO SERVE AS OUTLET FOR STORM SEWER NO. 17 WHEREAS, the City Council has met at the time and place specified in the notice published in the St. Louis Park Dispatch September 29 and October 6, 1955, relating to acquisition of land in Government Lot 3, Sec. 9, Twp. 117, R. 21, and in the SEI of the NEI, Sec. 8, Twp. 117, R. 21, to serve as an outlet for Storm Sewer District No. 17, and the Council has heard all interested persons appear- ing at said meeting and has secured from the City Engineer a report advising it in a preliminary way that the acquisition of said land as an outlet for said storm sewer is feasible and as to whether it should best be made as proposed or in connection with some other improvements, therefore BE IT RESOLVED by the City Council of the City of St. Louis Park that the following described portion of said Government Lot 3 in Section 9 and said SEI of the NEI in Section 8, Twp. 117, R. 21, be hereby ordered acquired by the City to serve as ari outlet for said Storm Sewer District No. 17: That part of Government Lot 3 lying West of Minneapolis Northfield fe Southern Ry Right-of-way and South of the Great Northern Ry. Right-of-way; that part of the N2 of Sec. 8, T. 117, Range 21 described as follows: Commencing at a point in the east line of said Section 8, measured 320 feet North along said line from the SE corner ,of the NEI of said Sec. 8; thence west parallel with the South line of said NE4,a dis- tance of 200 feet; thence south parallel with the West line of said NEI 320 feet to the south line of said NEI; thence west on said south line (200 feet; thence North 155 feet; thence west 50 feet; thence south 155 feet; thence west 277.4 feet; thence north parallel with the east line of said NEI to the south line of the Great Northern Railway Right-of-way; thence easterly along said southerly line to the east line of said NEI; thence south along said east line to,point of beginning. BE IT FURTHER RESOLVED that the offer made by the owners of ;said band to sell and convey the same to the City for the sum of $22,500,,said consideration to include release and settlement in full of all damages claimed on account of flooding of the said lands from said ,Storm Sewer' No. 17, and a dismissal of the action brought by said owners against the Village (now City) of St. Louis Park, now pending in the District Court of Hennepin County, be hereby accepted as in the best interestes of the City and upon approval by the City Attorney of the title to said premises, and deed conveying same for the City, and receipt of release and stipulation of dismissal of said action approved by the City Attorney, payment of said sum is hereby authorized. BE IT FURTHER RESOLVED that the said owners shall also convey tb the City the following tract for street purposes: the East 33 feet and the south 33 feet of a tract described as follows: Commencing at the SE corner of the NEI of Sec. 8, T. 117, R 21, thence West 200 feet; thence North 320 feet; thence east 200 feet; thence south to point of beginning.` Resolution No. 162 Adopted October 10, 1955 On'motion of Councilman Bolmgren, seconded by Councilman Middleton, the following resolution having been read was adopted by the unanimous vote of all Members of the Council present: RESOLUTION ORDERING STREET GRADING; GRAVELING AND BITUMINOUS STABILIZING WHEREAS the City Council has met at the time and:place specified in the notice published in the St. Louis Park Dispatch September 29 and October 6, 1955, relat- ing to the public improvementss hereinafter described and has heard all interested persons appearing at said meeting and has secured from the City Engineer a report advising it in a preliminary way as to whether each proposed improvement is feasible and as to whether it should best be made as proposed or in connection with some other improvements, and the estimated cost of the improvements; 89 THEREFORE, BE IT RESOLVED by the City Council of the City of St. Louis Park that the following public improvements be hereby ordered in accordance with plans and specifications which have been prepared by the City Engineer and filed with the City Clerk, and the City Clerk is hereby directed to advertise for. bids which will be opened by the City Manager October 24, 1955. STREET GRADING, GRAVELING AND BITUMINOUS STABILIZING IMPROVMENT NO. LOCATION 55-101 Maryland Avenue from W. 14th Street to W. 16th Street 55-103 North South Alley in Block 194, Rearrangement of St. Louis•Park Resolution,No. 163 Adopted October 10. 1955 On motion of Councilman Perkins, seconded by Councilman Davis, Resolution No. 163 was adopted by unanimous vote of all Members of the Council present. RESOLUTION APPROVING ASSIGNMENT OF SECURITIES IN LIEU OF BOND WHEREAS the City Council of the City of St. Louis Park has designated the Park -Plaza State Bank of St. Louis Park as a depository for City Funds in an amount not to exceed $150,000.00, and WHEREAS the Park -Plaza State Bank of St. Louis Park has proposed to assign the following securities in lieu of bond of public depository, in addition to other securities already assigned and has asked that they be deposited with Mar- quette National Bank, Minneapolis 2, Minnesota: $50,000.00 U.S. Treasury Bonds 2 due 11-15-61 " - now theref ore, 'BE IT RESOLVED that said bonds and safekeeping request be hereby approved. Resolution No. 164 Adopted October 10, 1955 On motion of Councilman Middleton, seconded by Councilman Davis, the follow- ing 'resolution was adopted (reading of the resolution having been waived by un- animous consent).by unanimous vote of all Members of the Council present. RESOLUTION SRANTING PERMIT UNDER SECTION 10.3 OF THE ZONING ORDINANCE OF THE CITY OF ST. LOUIS PARK WHEREAS, application has been made to the City Council LeRoy Sign Company for permit under Section 10.3 of the Zoning Ordinance of the City of St. Louis Park for the following purpose: ERECT A ROOF SIGN FOR THE MEAL -IN -A -BUN DRIVE-IN AT 5515 Excelsior Blvd. WHEREAS, the Council has considered the advices and recommendations of the Planning Commission and the effect of the proposed' use on the health, safety and Welfare cif the occupants of surrounding lands, existing traffic conditions; in- cluding parking facilities'on adjacent streets, and effect on values'arid proper- ties in the surrounding area, therefore • and BE IT RESOLVED by the City Council of the City of St. Louis Park kthat it is hereby determined that the said proposed use will'not'be detrimental t� the health, safety or public welfare, to the occupants of surrounding lands, nor will it cause serious traffic congestion, nor hazards, nor will it seriously depreciate surrounding property values, and BE IT FURTHER RESOLVED that permit be hereby granted to the applicant for the purpose above set forth.
