HomeMy WebLinkAbout2337-07 - ADMIN Ordinance - City Council - 2007/10/01ORDINANCE NO.2337-07 AN ORDINANCE VACATING PUBLIC RIGHTS OF WAY AND EASEMENTS 3515 BELTLINE BOULEVARD THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. A petition in writing signed by a majority of all of the owners of all property abutting upon both sides of the public rights of way and easements proposed to be vacated has been duly filed. The notice of said petition has been published in the St. Louis Park Sailor on September 6, 2007, and the City Council has conducted a public hearing upon said petition and has determined that the rights of way and easements are not needed for public purposes, and that it is for the best interest of the public that said rights of way and easements be vacated. Section 2. The following described public rights of way and easements, as now dedicated and laid out within the corporate limits of the City of St. Louis Park, are vacated: That part of the Northeast Quarter of the Southwest Quarter of Section 6, Township 28, Range 24, Hennepin County, Minnesota described as follows: A tract of land 40 feet in width lying immediately north of and adjacent to the northerly lines of Blocks 1, 2 and 3, "Westmoreland Park", according to the plat thereof on file and of record with the Register of Deeds of Hennepin County, Minnesota, said tract to extend in a continuous strip from West 36th Street to the east line, projected, of said Block 1, "Westmoreland Park". Lying easterly of the southeasterly line of Belt Line Boulevard; AND The alley contained within Block 1, "Westmoreland Park", according to the recorded plat thereof, Hennepin County, Minnesota, lying southerly of the north line of said plat and lying northerly of a line described as beginning at the southwest corner of Lot 18, said Block 1; thence Northwesterly to the southeast corner of Lot 19, said Block 1, and said line there terminating; AND That part of the north -south alley contained within Block 2, "Westmoreland Park", according to the recorded plat thereof, Hennepin County, Minnesota, lying southerly of the southeasterly line of Belt Line Boulevard, as monumented, and lying northerly of a line described as beginning at the southwest corner of Lot 6, said Block 2; thence Westerly to the southeast corner of Lot 14, said Block 2, and said line there terminating; AND That part of the east -west alley contained within Block 2, "Westmoreland Park", according to the recorded plat thereof, Hennepin County, Minnesota, lying easterly of the southeasterly line of Belt Line Boulevard, as monumented, and lying westerly of a line described as beginning at the northeast corner of Lot 7, said Block 2; thence Northerly to the southeast corner of Lot 6, said Block 2, and said line there terminating; AND Ordinance No. 2337-07 -2- That part of the alley contained with Block 7, "Westmoreland Park", according the recorded plat thereof, Hennepin County, Minnesota, lying northerly of the northeasterly line of Monterey Drive, as monumented, and lying southerly of a line described as beginning at the northeast corner of Lot 22, said Block 7; thence Southeasterly to the northwest corner of Lot 1, said Block 7, and said line there terminating; AND That part of Ottawa Avenue originally dedicated in the plat of "Westmoreland Park", according to the recorded plat thereof, Hennepin County, Minnesota, lying southerly of the northerly line of said plat and lying northerly of a line described as beginning at the southwest corner of Lot 19, Block 1, said plat; thence Northwesterly to the southeast corner of Lot 7, Block 2, said plat, and said line there terminating; AND That part of Natchez Avenue originally dedicated in the plat of "Westmoreland Park", according to the recorded plat thereof, Hennepin County, Minnesota, lying southerly of the northerly line of said plat and lying northerly of the northeasterly line of Monterey Drive, as monumented; AND That part of Highland Avenue originally dedicated in the plat of "Westmoreland Park", according to the recorded plat thereof, Hennepin County, Minnesota, now known as 36 1/2 Street West, lying easterly of the northeasterly line of Monterey Drive, as monumented; reserving, however, to the City of St. Louis Park any and all easements that may exist in, over, and across the described property for storm sewer, sanitary sewer, water main, and public utility purposes. Section 3. The City Clerk is instructed to record certified copies of this ordinance in the Office of the Hennepin County Register of Deeds or Registrar of Titles as the case may be. Sec.4. This Ordinance shall take effect fifteen days after its publication.
