AN ORDINANCE AMENDING THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING BY
AMENDING SECTIONS 14:5-1.1, 14:5-2.1 (Table 5-2.1A),
14:5-3.2, 14:6-2 (Table 6-2A) AND 14:5-8
THE CITY OF ST LOUIS PARK DOES ORDAIN
Findings
Sec 1 The City Council has considered the advice and recommendation of the Planning
Commission (Case No 99-3-ZA)
Sec 2 The St Louis Park Ordinance Code, Sections 14 5-1 1, 14 5-2 1 (Table 5-2 1A),
14 5-3 2, 14 5-8 and 14 6-2 (Table 6-2A) are hereby amended to read as follows

SECTION 14:5-3.2 DESCRIPTIONS
A RESIDENTIAL USES. (add No 7 Live -Work Unit, page 66)

7 LIVE -WORK UNIT - A dwellmg umt that includes space for the gainful employment of a resident
of the dwelling unit and up to two workers who may not be residents of the dwellmg unit The floor
area devoted to the business use may not exceed the floor area devoted to the residential use within
the unit Any space that will be used by walk -m customers of the business must be accessible from
an extenor entrance that is not used to access other residential units With the exception of the
extenor entrance, the business cannot substantially alter the extenor of the property or substantially
affect the character of the neighborhood or the health, safety and welfare of the residents The
busmess space must be designed to pemut conversion to residential space with minimum work and
no structural changes Uses which are not allowed mclude but are not limited to the followmg uses
classified as Industnal, appliance, small engine and bicycle repair, motor vehicle sales, motor vehicle
service and repair, pawnshops, animal handling, bars, food service, restaurants, pnvate
entertainment, and sexually-onented businesses

SECTION 14:5-8 "M -X" MIXED USE DISTRICT
A PURPOSE
The purposes of the "M -X" Mixed Use Distnct are to provide areas for mixed use development that are
carefully planned to promote efficient use of the land and roadway system, to ensure sensitivity to the
surrounding neighborhood, to provide appropnate transitions between uses, to encourage reductions in
impervious surface by minumzmg surface parking, to retain open space by encouraging taller buildings for
high density uses, to ensure high quality architectural design and matenals, to provide good pedestnan,
bicycle and transit access, and to promote innovative site design
B PERMITTED USES
1 GROUP HOME/NON-STATUTORY IN EXISTENCE ON JUNE 1, 1999
C USES PERMITTED WITH CONDITIONS
1 MIXED USE DEVELOPMENT
Conditions
a The development is m conformance with the Comprehensive Plan land use designation(s) for
the area
b The development is m conformance with a Redevelopment Plan for the area that has been
adopted as part of the Comprehensive Plan
c The development conforms with all performance standards of this distnct or an adopted
overlay distnct for the area unless certain standards are specifically waived or amended by
the adopted Redevelopment Plan
D USES PERMITTED BY PUD
1 MIXED USE DEVELOPMENT provided that
a The Comprehensive Plan land use designation is either CMX - Commercial Mixed Use or
CIVMX- Civic Mixed Use
b All buildings are multi -story and meet the following requirements. the majonty of ground
floor building area is devoted to uses from i) and/or ii) below as consistent with the
Comprehensive Plan land use designation and the majonty of upper -story floor area is
devoted to uses from iii) and/or iv) below
1) COMMERCIAL USES limited to the following banks without dnve-up facilities,
food service, convention and exhibition center, hotel/motel, pnntmg process/supply,
pnvate entertamment (indoor), restaurants, retail shops, service, showrooms,
studios
ii CWIC/INSTITUTIONAL and TRANSPORTATION USES limited to the
following community center, education/academic, library, museums/art gallenes,
indoor public parks/open space, police service substations, post office customer
service facilities, public studios and performance theaters, time transfer and transit
stations

in) OFFICE, HUMAN CARE and LABORATORY USES Imuted to the following
adult daycare, group daycare/nursery school, group home/non-statutory,
medical/dental office, medical/optical/dental laboratory, nursing home, office
iv) RESIDENTIAL USES limited to the following multiple family dwellmgs, elderly
housmg not to exceed 50% of the total residential floor area
LIVE -WORK UNITS, as defined by Section 14 5-3 2, satisfy the above use mix
requirements m areas designated as CMX - Commercial Mixed Use
c In -vehicle sales or service is prohibited
E ACCESSORY USES
1 Bar if accessory to a restaurant, hotel, or private entertainment (mdoor)
2 Incidental repair or processing which is necessary to conduct a permitted use and not to exceed 10%
of the gross floor area of the associated pernutted use
3 Parking lots designed m accordance with Section 14 6-1 except that the number of required spaces
may be reduced as provided m Subsection D 6 of this Mixed Use Distnct
4 Parking ramps designed in accordance with the conditions contained m Section 14 5-5 3(c)(21) and
utilizing the same extenor facmg materials as the principal buildmg(s)
5 Pedestnan skyways utilizing the same extenor facing materials as the prmcipal building(s)
6 Public transit stops/shelters
7 Visitor lodging associated with elderly housmg and nursmg homes
8 Warehouse/storage which is necessary for a permitted use and not to exceed 20% of the gross floor
area of the associated permitted use
9 Home Occupations complying with all of the conditions m the "R -C" High Density Multiple Family
Distnct
F DIMENSIONAL/PERFORMANCE STANDARDS & GENERAL REQUIREMENTS
Notwithstanding the provisions of Section 14 6-7 (the PUD Ordinance), the followmg standards and
requirements cannot be modified or waived except as specifically stated
1 The development may include more than one contiguous properties that are planned, designed and
maintained as a unit
2 The development shall comply with the Plan By Neighborhood policies of the Comprehensive Plan
for the neighborhood in which it is located, conditions of approval may be added to ensure
compliance with this requirement

3 The maximum nonresidential density is 1 5 FAR and the maximum residential density is 50 units per
acre In determining density, the total nonresidential floor area or number of residential units shall be
divided by the land associated with each use, including building coverage and parkmg/bufferyard
areas associated with the use and a proportion of the on-site usable open space Stormwater ponds
and public/pnvate streets and alleys shall be excluded from land calculations _Maximum densities
may be increased by up to 50% at the sole discretion of the City Council if two or more of the
following are provided
a At least 80% of the required parkmg is provided m underground or above -ground structures,
mcludmg all levels of parking ramps,
b Housing is provided above ground floor commercial or civic and the total floor area of the
housing is at least twice the floor area of the commercial and/or civic uses,
c Buildings are placed at or near the street nght-of way and off-street parking is screened
from public nght-of way by buildings
d At least 50% of the building ground coverage is concentrated m structures of six or more
stones m height, thereby conserving open space within the development site
4 The development site shall include a minimum of 12% usable open space based on pnvate
developable land area, The mmunum open space requirement may be reduced to a minimum of 8%
of the pnvate developable land area if the one or more of the following are provided
a Accessible usable open space on land within 600 feet of all buildings within the
development, such open space must be protected by covenants which ensure its
perpetuation, open space credits for protected open space are granted at the sole discretion
of the City Council based upon the following findings
The land area of the usable open space is at least twice the size of the open space
credit requested for the development site, and
ii The development mcludes logical pedestnan/bicycle connections from the usable
open space, through the development site, and to other properties adjacent to the
development, and
iii The design of the development is sensitive to the usable open space Sensitive
design features include design of pedestnan/bicycle connections to enhance existing
circulation patterns within the open space, location of building service areas away
from the open space or m heavily screened areas, design and location of buildings
to complement the scale and character of the open space, use of substantial
landscaping to provide adequate transitions between the development_and open
space
b Public art, open space credits for public art are granted at the sole discretion of the City
Council and may reduce open space requirements by a maximum of 2 percentage points
c Other public amenities, open space credits for public amenities are granted at the sole
discretion of the City Council and may reduce open space requirements by a maxunum of 2
percentage points

5 Building setbacks shall be regulated by the Redevelopment Plan or final PUD site plan and
development agreement approved by the City Council based upon the following findings
a The setbacks provide adequate distances from uses m adjacent distncts and conform to the
distances from R-1, R-2, and R-3 residential distncts established m Subsection D 11 of this
ordinance, and
b The setbacks mamtam and enhance the character of the neighborhood in which the
development is located, and
c Adequate visibility is provided from all street mtersections
6 Cumulative parking requirements may be reduced by up to 30% of required spaces at the sole
discretion of the City Council if one or more of the following are provided
a Joint parkmg/shared parkmg arrangements between uses,
b Proof of parking, such proof of parkmg may mclude reserved open space areas in excess of
minimum open space requirements and/or agreement to construct parking ramps or other
means of satisfying parking requirements when and if warranted as determined by the City
Zoning Administrator based upon evidence of overflow parkmg on public streets, m fire
lanes, or in other areas that are not stuped for parking
c Off-site employee parking, employee car/van pooling, and/or provision of employee transit
passes
d Supenor pedestnan, bicycle, and/or transit access
7 All trash handlmg and loading areas must be mtenor or screened from the public nght-of-way,_other
public areas and adjacent properties utilizing architectural screening consisting of the same extenor
facing matenals as the principal building
8 Trash handlmg, truck circulation and loading areas must be separated from streets and properties
adjommg the development by a bufferyard F
9 Buildings constructed after adoption of this ordinance must utilize at least 80% Class I matenals on
each building face and no Class III matenals on any buildmg face that is visible from public areas
wnthm the development or from off-site The Class I matenals requirement may be reduced to 60%
at the sole discretion of the City Council if a balance of architectural interest and visual
compatibility is provided through approval of the followmg_
a a variety of compatible materials and colors,
b height and building wall deviations,
c architectural features,
d canopies over sidewalks, and
e pedestrian -scale details
All buildings within the PUD must be visually integrated by utilizing some of the same extenor
matenals and architectural elements such as roof pitch, window treatments, and massmg

10 Buildings constructed after adoption of this ordinance must utilize parapet walls to completely
screen rooftop equipment from ground and street level view and must pamt rooftop equipment to
match the color of the roof m order to minimize the visual impact as viewed from other buildmgs
11 Buildings constructed after adoption of this ordinance are subject to the followmg height restnctions
based upon distances from adjacent R-1, R-2, and R-3 residential distncts
a Within a distance equal to the minimum lot width of an adjacent residential distnct, the
maximum height shall not exceed the height allowed m the adjacent residential distnct, said
height restnction may be waived if the adjacent residentially zoned property is public park
or open space that is protected by covenants
b Within a distance equal to two times the minimum lot width of an adjacent residential
distnct, the maximum height shall not exceed two times the height allowed m the adjacent
residential district, said height restnction may be waived if the adjacent residentially zoned
property is public park or open space that is protected by covenants
c In other areas of development sites, building height shall be restricted by maximum density
provisions and to prevent the castmg of shadows for a penod greater than two hours on
residential uses within the development between the hours of 9 a m and 3 p m
12 Developments constructed after adoption of this ordinance must include sidewalks and/or bikeways
along all pnvate and public street nght of ways as determined appropnate and on-site
pedestnan/bicycle facilities that provide logical connections to off-site uses and are separated from
off-street surface parking areas by curbed, landscaped islands a muumum of 20 feet in width
inclusive of sidewalk
13 Developments constructed after adoption of this ordinance that can be served by public transit must
provide at least one transit stop that convemently serves the development
14 Signage shall be allowed in conformance with the approved Redevelopment Plan or final PUD site
plan and development agreement m accordance with the following conditions
a Pylon signs are not permitted, and
b Freestanding monument signs shall utilize the same extenor matenals as the prmcipal
building(s) and shall not interfere with pedestnan/bicycle or automobile circulation and
visibility, and
c Pedestnan-scale signs visible from public sidewalks shall be encouraged, such signs shall be
no more than three feet in vertical dimension unless flush with the building wall, and
a Maximum allowable numbers, sizes, and heights shall be regulated by Section 14 6-2 except
as specifically modified by the Redevelopment Plan or final PUD site plan and development
agreement at the sole discretion of the City Council
15 A development agreement is required as part of the development approval and shall address at a
muumum approved site and building design cntena, approved sign locations and design cntena,
construction phasmg, bonding or other financial surety for construction of on and off-site
improvements generated by the development, and maintenance

16 The development shall comply with all other applicable Code provisions unless specifically modified
by Subsections D 1 - D 15 of this ordinance or by approval of a Redevelopment Plan or final PUD
plan and development agreement
