HomeMy WebLinkAbout96-2079 - ADMIN Ordinance - City Council - 1996/10/22Revised 1 ORDINANCE NO. 96-2079 AN ORDINANCE VACATING A PORTION OF THE UTILITY EASEMENT ON LOT 29, BLOCK 1, CEDAR KNOLL MANOR FOURTH ADDITION (1629 FORD ROAD) THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. Due to the presence of a garage on a utility and drainage easement on Lot 29, Block 1, Cedar Knoll Manor Fourth Addition (1629 Ford Road - "Property"), there exists a property title defect. As a result, the City has been petitioned to vacate that portion of the utility easement the City does not consider necessary to protect the public's interest. Section 2. Said vacation petition has been duly filed with the City Clerk, and the City Council has conducted a public hearing upon said vacation petition and determined that the portion of the public utility easement described below is not needed for public purposes, and that it is in the best interest of the public that said public utility easement be vacated. Section 3. The public utility easement as now dedicated and laid out on the Property is reduced to the following: ell All that part of Lot 29, Block 1, Cedar Knoll Manor 4th Addition described as follows to wit: Beginning at the Southwest comer of said Lot 29; thence North along West line of Lot 29 for five (5) feet; thence Easterly and parallel to the South line of Lot 29 for 70.50 feet; thence Southerly at 90 degrees for 4.5 feet; thence Easterly at 90 degrees and parallel to said South line for 22 feet; thence Northerly at 90 degrees to the intersection of the Southeasterly easement line on Lot 29; thence five (5) feet Northeast and parallel the East line of Lot 29 to the intersection of the North line of Lot 29; thence Easterly along said North line to the Northeast corner of Lot 29; thence Southwesterly along said East line for 74.15 feet to the Southeast corner of Lot 29; thence Westerly along the South line of Lot 29 for 93 feet to the point of beginning. Section 4. The City Clerk is instructed to record certified copies of this ordinance in the Office of the Hennepin County Register of Deeds or Registrar of Titles as the case may be. Section 5 This ordinance shall take effect fifteen days after its publication.
