HomeMy WebLinkAbout96-2077 - ADMIN Ordinance - City Council - 1996/10/22ORDINANCE NO. 96-2077 AN ORDINANCE VACATING A PORTION OF THE UTILITY EASEMENT ON LOT 9, BLOCK 1, MINIKAHDA VISTA (3832 JOPPA AVENUE SOUTH) THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. Due to the presence of a garage on Lot 9, Block 1, Minikanda Vista (3832 Joppa Avenue South - "Property") within a public utility easement, there exists a property title defect. As a result, the City has been petitioned to vacate that portion of the utility easement the City does not consider necessary to protect the public's interest. Section 2. Said vacation petition has been duly filed with the City Clerk, and the City Council has conducted a public hearing upon said vacation petition and determined that the portion of the public utility easement described below is not needed for public purposes, and that it is in the best interest of the public that said public utility easement be vacated. Section 3. The public utility easement as now dedicated and laid out on the Property is reduced to the following: The West 5 feet of Lot 9, Block 1, Minikanda Vista Addition except the South 15 feet and the East 3.5 feet of the West 5 feet of said Lot 9. Section 4. The City Clerk is instructed to record certified copies of this ordinance in the Office of the Hennepin County Register of Deeds or Registrar of Titles as the case may be. I& Section 5. This ordinance shall take effect fifteen days after its publication.
