ORDINANCE NO. 96- 2070
AN ORDINANCE AMENDING
THE ST. LOUIS PARK HOME RULE CHARTER,
SECTION 5.05, PURCHASES AND CONTRACTS, AND SECTION 5.06,
CONTRACTS - HOW LET.
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Findings
Section 1. The City Council has considered the recommendation of the Charter
Commission, as set forth in Charter Commission Resolution No. 1, adopted by the Charter
Commission on May 9, 1996.
Section 2 Minnesota Statutes Section 410.12, subdivision 7, authorizes the City
Council, upon the recommendation of the Charter Commission, to amend the City's Home
Rule Charter by ordinance.
Section 3.

Section 5.05 of the St. Louis Park Home Rule Charter is hereby amended
Section 5.05. Purchases and Contracts. The City Manager shall
be the chief purchasing agent of the City. All purchases on behalf of the
City shall be made, and all contracts shall be let, by the City Manager,
provided that the approval of the Council must be given whenever the
amount of such purchase or contract exceeds $25,000. All contracts,
bonds, and instruments of every kind to which the City is a party shall be
executed in the name of the City and shall be_signed by the Mayor and the
City Manager.
Section 2. Section 5 06 of the St. Louis Park Home Rule Charter is hereby amended
to read:
Section 5.06. Contracts - How Let.
(a) In all cases of contracts for the purchase of supplies,
merchandise, or materials, for the purchase or rental of equipment, or for
any kind of construction, alteration, repair, or maintenance work
undertaken by the City, which are estimated to require an expenditure of
more than $25,000 unless the Council shall by emergency ordinance
otherwise provide, the City Manager shall advertise for bids by at least one
(1) week's published notice in the official newspaper Contracts and
purchases in excess of $25,000 shall be let to the lowest responsible bidder
as determined by the Council. The Council may, however, reject any and
all bids.
(b) In all cases of purchases or contracts that are estimated to
require an expenditure of more than $10,000 but not more than $25,000,
the City Manager may make the purchase or contract either through
competitive sealed bidding or through direct negotiation. The City
Manager may reject any and all bids. In the case of any contract to be
made upon direct negotiation, the City Manager shall obtain two or more
quotations for the purchase or contract whenever possible, but advertising
for bids and otherwise complying with competitive bidding procedures shall
not be required.
(c) In all cases of purchases or contracts that are estimated to
require an expenditure of $10,000 or less, the City Manager may make the
purchase or contract either upon direct negotiation, as provided in
subsection (b), or in the open market, in the discretion of the City
Manager.
(d) Nothing contained in this section shall prevent the Council from
contracting for work with patented processes or from the purchasing of
patented appliances.
(e) All public improvements which require that the City issue bonds
to secure funds to pay the costs of construction of the improvements shall
be ordered and approved in the manner provided in Chapter 7 of this
Charter.

Section 3. Effective Date. This ordinance shall be in force and take effect in the St.
Louis Park Home Rule Charter 90 days after its date of publication.
