AN ORDINANCE
AMENDING THE ST. LOUIS PARK CODE OF ORDINANCES,
SECTIONS 5-201 AND 5-202,
RELATING TO CITY PROCEDURES FOR
PURCHASES AND CONTRACTS AND OPENING BIDS
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. Section 5-201 of the St. Louis Park Code of Ordinances is hereby amended
to read:
Section 5-201. The Procedure for Purchases and Contracts shall be as follows:
(1) Requisitions and Estimates All departments and divisions of the
City, either by or with authorization of the head of the department
under which the using division or department operates, shall file
with the Director of Finance detailed requisitions or estimates of
requirements in supplies and contractual services, in such manner,
at such times, and for such future periods as the City Manager shall
prescribe.
(2) Examination by Director of Finance and Report to Manager The
Director of Finance shall examine each requisition or estimate and
shall report to the City Manager from time to time such summary of
requisitions and estimates as the City Manager shall request. The
City Manager shall have authority to revise requisitions.
(3)
Budget Control. Except in cases of emergency, the City Manager
as Purchasing Agent, shall not issue any order for delivery on a
contract or open market purchase until the Director of Finance shall
have determined and endorsed on the requisition that there is to the
credit of the using agency concerned a sufficient unencumbered
appropriations balance of the budget to defray the amount of such
order.
(4) Advertisement for Bids Unless the Council shall by an emergency
ordinance otherwise provide, no contract for the present or future
purchase of supplies, merchandise, materials, or the purchase or
rental of equipment, or for any kind of construction, alteration,
repair, or maintenance work undertaken by the City, which is
estimated to requires an expenditure of more than $25,000, shall be
entered into in behalf of the City unless the City Manager shall have

advertised for bids for furnishing the same by at least one week's
published notice in the official newspaper.
Contracts under $10.000. Any purchase or contract that is
estimated to require an expenditure of $10,000 or less shall be
made or let by the City Manager. In such cases it shall not be
necessary that there shall have been an advertisement for bids, but
prior to making any such purchase or contract the Purchasing
Agent shall wherever practicable solicit and secure written bids
from two or more prospective suppliers or contractors; competitive
prices are to be secured at such frequent intervals as the market and
commodity involved may tend to fluctuate, and purchases shall be
made at the lowest price available, taking into account the quality
and other cost factors involved.
(.0 Contracts Between $10.000 and $25.000 Any purchase or
contract that is estimated to require an expenditure in excess of
$10,000 but not more than $25,000 shall be made or let by the City
Manager either through advertising for bids, according to the
procedures for competitive bidding provided in Section 5-201(4)
and Section 5-202, or through direct negotiation, according to the
procedures for direct negotiation provided in Section 5-201(5).
Qfl Council Approval. Any purchase to be made or contract to be
entered into where the amount involved exceeds $25,000 shall be
approved in advance by the City Council, the advertisement for bids
shall be issued by the City Manager, the bids shall be opened by the
City Manager in the manner hereinafter prescribed, and the City
Manager shall tabulate and report the bids to the City Council at
such time as it shall direct.
Section 5-202 of the St. Louis Park Code of Ordinances is hereby amended
Section 5-202. Procedure for Opening Bids shall be as follows:
(1) Bids shall be submitted sealed to the City Clerk and shall be
identified on the envelope as to the nature of the bid and name of
bidder
(2) Bids shall be opened in public in the Council Chambers or the City
Manager's office as specified in the advertisement for bids and at
the time specified in the advertisement. They shall be publicly read
at such time and available for inspection by interested bidders.

(3)
A tabulation of all bids received shall be prepared for submission to
the City Council, and when completed shall be open to public
inspection. Contracts involving public improvements or
construction work of any kind shall be submitted to the Public
Works Division for tabulation, contracts for purchase of supplies
and any other contracts or purchases shall be tabulated as directed
by the City Manager.
(4) The City Manager shall have authority to reject any and all bids
involving $25,000 or less and the City Council shall have authority
to reject all bids involving more than $25,000.
Section 3. Effective Date. This ordinance amendment shall be in force and take
effect upon publication.
Adopted by the City Council by an affirmative vote of all its members on
