ORDINANCE NO. 96-2064
AN ORDINANCE AMENDING CHAPTER 10 OF THE ST LOUIS PARK MUNICIPAL
ORDINANCE CODE BY ADDING PART 9, INCLUDING SECTIONS 10-901, 10-902,
10-903, 10-904, 10-905, 10-906 AND 10-907, RELATED TO THE OPERATION AND
REGULATION OF MOTORIZED GOLF CARTS UPON THE ROADWAY OF
DESIGNATED STREETS WITHIN THE CITY OF ST. LOUIS PARK
THE CITY OF ST. LOUIS PARK DOES ORDAIN.
Section 1: Chapter 10 of the St. Louis Park Municipal Code is hereby amended to read as
follows
Section 10-901. Operation Authorized The operation of motorized golf carts by permit is
hereby authorized on the roadways of all streets, except State trunk highways, County
highways, or County State -aid roads, in all districts zoned R-1, R-2, or R-3.
Notwithstanding the restriction against operating a motorized golf cart on State trunk
highways, County highways, and County State -aid roads, the operation of a motorized
golf cart under permit may cross any street, highway or road that intersects a street on
which the operator is specifically authorized in the permit to operate a motorized golf cart.
Any person operating a motorized golf cart under permit has all the rights and duties
applicable to the driver of any other vehicle, except when those provisions cannot
reasonably be applied to motorized golf carts.
Section 10-902. Permits. Authorization to operate a motorized golf cart on City streets is
by permit only. Permits shall be issued by the Police Chief only to physically disabled
persons, as defined in Minnesota Statutes Section 169.345, who have supplied the
information required under Section 10-903. All permits shall expire on December 31,
unless renewed. The fee for a permit shall be fixed by resolution of the Council.
Section 10-903 Permit Applications Each application for a permit to operate a motorized
golf cart on the roadway of streets shall include:
(1) the name and address of the applicant.
(2) a description of the specific area, including the names of all affected streets
within which the applicant seeks authorization to operate a motorized golf
cart; and
(3) such other information as the Council may from time to time require
In addition, each permit application, whether for an initial permit or a renewal, shall be
accompanied by (a) a certificate signed by a physician stating that the applicant is
capable of safely operating a motorized golf cart on the roadway of streets designated in
the permit application, and (b) evidence of insurance complying with the requirements
under State statute for motorcycle owners (presently Minnesota Statutes Section 658.48,
subdivision 5).
Section 10-904. Required Equipment. The following equipment is required on any
motorized golf cart during operation upon the roadway of any street:
(1) the slow moving vehicle emblem provided for by State statute, properly
mounted on the rear of the golf cart pursuant to State regulations; and
(2) A rear view mirror, properly mounted on the golf cart so as to reflect to the
Operator a view of the street for a distance of at least 200 feet to the rear of
the golf cart.
Section 10-905. Unlawful Acts. It is unlawful for any person to operate a motorized golf
cart on the roadway of any street within the City unless:
(1) The operator has in possession a valid, current and unrevoked permit issued
to the operator by the Police Chief;
(2) The motorized golf cart is being operated on a roadway that is not
specifically designated in the operator's permit, except when crossing at an
intersection as provided in Section 10-901;.
The motorized golf cart is being operated during daylight hours between
sunrise and sunset;
(3)
(4) The motorized golf cart is being operated at times other than during
inclement weather or when visibility is impaired by weather, smoke, fog, or
other condition, or at any time when there is insufficient light to clearly see
persons or vehicles on the roadway at a distance of 500 feet.
The motorized golf cart is equipped with the required equipment described
under Section 10-904;
(5)
(6) The operator has current insurance coverage as provided in Section 10-903,
pursuant to State statute; and
(7)
The operator observes all traffic laws and regulations, except when those
provisions cannot reasonably be applied to motorized golf carts.
Section 10-906. Revocation or Modification of Permits. A permit issued under Section
10-902 may be revoked or modified at any time by the Police Chief if there is evidence
that the permit holder cannot safely operate a motorized golf cart on the roadway of
streets within the City. For purposes of this section, the commission of any of the
violations described in Section 10-905 constitutes evidence that the violator cannot safely
operate a motorized golf cart on the roadway of streets within the City.
Section 10-907. Appeal. Any person whose permit to operate a motorized golf cart has
been revoked may appeal the revocation to the City Council. Appeals shall be submitted
in writing to the City Clerk within 30 days of the date of revocation.

Section 2: Effective Date. This ordinance shall take effect 15 days after its publication.

Summary This ordinance amends the St Louis Park
Municipal Code by establishing a process whereby physi-
cally disabled persons, as defined in M S 169 345, may
apply for a permit to operate motonzed golf carts on the
roadways of certain streets within the City of St Louis
Park, subject to certain requirements and regulations
Effective Date This ordinance shall take effect on
June 13, 1996
