LOUIS PARK ORDINANCE CODE RELATING TO ZONING BY - ADDING SECTION 14:5-8 "M -X" MIXED USE DISTRICT RENUMBERING SECTIONS 14:5-8 AND 14:5-9 TO 14:5-9 AND 14:5-10 AMENDING SECTIONS 14:6-2, 14:6-6 and 14:6-7 THE CITY OF ST. LOUIS PARK DOES ORDAIN: Findings Sec. 1. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 95-27-ZA) Sec. 2. The St. Louis Park Ordinance Code, is hereby amended to read as follows: Add Section 14:5-8 "M -X" MIXED USE DISTRICT (page No. 201.1) A. PURPOSE The purposes of the "M -X" Mixed Use District are to provide areas for mixed or multiple use development that are carefully planned to promote efficient use of the land and roadway system; to ensure sensitivity to the surrounding neighborhood; to provide appropriate transitions between uses; to encourage reductions in impervious surface by minimizing surface parking; to retain open space by encouraging taller buildings for high density uses; to ensure high quality architectural design and materials; to provide good pedestrian, bicycle and transit access; and to promote innovative site design. B. USES PERMITTED BY PUD 1. MIXED OR MULTIPLE USE DEVELOPMENT provided that: a. The principal use is in conformance with the Comprehensive Plan land use designation. In "M -X" Districts with more than one underlying Comprehensive Plan designation, conformance with each designation shall be analyzed individually. For purposes of this section, the principal use is defined as the use having the greatest floor area on the preliminary and final PUD site plan. In phased projects, at least 30% of the approved principal use floor area must be constructed in the first phase. b. The Planned Unit Development (PUD) contains uses from at least two of the following four categories: i) COMMERCIAL USES limited to the following: banks, food service, in -vehicle sales or service in PUDs where the principal use is commercial and as regulated below, printing process/supply, private entertainment (indoor), restaurants, retail shops (no outdoor sales/display), service, showrooms, studios. ii) HOTEL/MOTEL, OFFICE, and HUMAN CARE USES limited to the following: adult day care, group day care/nursery school, medical/dental office, nursing home. iii) INSTITUTIONAL USES limited to the following: community center, library, museums/art galleries, parks/usable open space/recreation and public plazas in excess of minimum usable open space requirements,indoor public park/recreation. iv) RESIDENTIAL USES limited to the following: cluster housing, residential uses permitted or permitted with conditions in the "R -C" district, multiple family dwellings, elderly housing, single- family dwellings in existence prior to the effective date of this ordinance. c. The floor area of any one category of uses shall not exceed 55% of the total floor area of any phase of the PUD. C. ACCESSORY USES 1. Bar if accessory to a restaurant, hotel, or private entertainment (indoor). 2. Incidental repair or processing which is necessary to conduct a permitted use and not to exceed 10% of the gross floor area of the associated permitted use. 3. Parking lots designed in accordance with Section 14:6-1 except that the number of required spaces may be reduced as provided in Subsection D.6. of this Mixed Use District. 4. Parking ramps designed in accordance with the conditions contained in Section 14:5-5.3(c)(21) and utilizing the same exterior facing materials as the principal building(s). 5. Pedestrian skyways utilizing the same exterior facing materials as the principal building(s). 6. Public transit stops/shelters. 7. Visitor lodging associated with elderly housing and nursing homes. 8. Warehouse/storage which is necessary for a permitted use and not to exceed 20% of the gross floor area of the associated permitted use. D. DIMENSIONAL/PERFORMANCE STANDARDS & GENERAL REQUIREMENTS Notwithstanding the provisions of Section 14:6-7 (the PUD Ordinance), the following standards and requirements cannot be modified or waived except as specifically stated: 1. The minimum size of the District and PUD site area is 10 acres. The PUD may include more than one contiguous properties that are planned, designed and maintained as a unit. 2 1 r f 1 2. The PUD shall comply with the Plan By Neighborhood policies of the Comprehensive Plan for the neighborhood in which it is located; conditions of approval may be added to ensure compliance with this requirement. 3. The maximum nonresidential density is 1.5 FAR and the maximum residential density is 50 units per acre. In determining density, the total nonresidential floor area or number of residential units shall be divided by the land associated with each use, including building coverage and parking/bufferyard areas associated with the use and a proportion of the on- site usable open space. Maximum densities may be increased by up to 50% at the sole discretion of the City Council if one or more of the following are provided: a. At least 50% of the required parking is provided underground or above- ground, including all levels of parking ramps; b. Housing is provided above ground floor commercial and the total floor area of the housing is at least twice the floor area of the commercial use; c. Office is provided above ground floor retail/service and the total floor area of the office is at least twice the floor area of the retail/service use; d. At least 50% of the building ground coverage is concentrated in structures of six or more stories in height, thereby conserving open space within the PUD site. 4. The PUD site shall include a minimum of 12% usable open space based on total PUD land area; The minimum open space requirement may be reduced to a minimum of 8% of the total PUD land area if the one or more of the following are provided: a. Accessible usable open space on land immediately adjacent to the PUD; such adjacent open space must be protected by covenants which ensure its perpetuation; open space credits for adjacent protected open space are granted at the sole discretion of the City Council based upon the following findings: i. The land area of the adjacent usable open space is at least twice the size of the open space credit requested for the PUD site; and ii. The PUD site plan includes logical pedestrian/bicycle connections from the adjacent usable open space, through the PUD site, and to other properties adjacent to the PUD site; and iii. The design of the PUD is sensitive to the adjacent usable open space. Sensitive design features include design of pedestrian/bicycle connections to enhance existing circulation patterns within the open space; location of building service areas away from the open space or in heavily screened areas; design and location of PUD buildings to complement the scale and character of the adjacent open space; use of substantial landscaping to provide adequate transitions between the PUD and adjacent open space. b. Public art on the PUD site; open space credits for public art are granted at the sole discretion of the City Council and may reduce open space requirements by a maximum of 2 percentage points. c. Fountains, clock towers and other public amenities; open space credits for public amenities are granted at the sole discretion of the City Council and may reduce open space requirements by a maximum of 2 percentage points. 5. Building setbacks shall be regulated by the final PUD site plan and development agreement approved by the City Council based upon the following findings: a. The setbacks provide adequate distances from uses in adjacent districts and conform to the distances from residential districts established in Subsection D.12 of this ordinance; and b. The setbacks maintain and enhance the character of the neighborhood in which the PUD is located; and c. An adequate yard is provided along all street frontages; such yard shall not be less than fifteen (15) feet in width except as specifically modified by the final PUD site plan at the sole discretion of the City Council. 6. Cumulative parking requirements may be reduced by up to 30% of required spaces at the sole discretion of the City Council if one or more of the following are provided: a. Joint parking/shared parking arrangements between uses; b. Proof of parking; such proof of parking may include reserved open space areas in excess of minimum open space requirements and/or agreement to construct parking ramps or other means of satisfying parking requirements when and if warranted as determined by the City Zoning Administrator based upon evidence of overflow parking on public streets, in fire lanes, or in other areas that are not striped for parking. c. Off-site employee parking, employee car/van pooling, and/or provision of employee transit passes. d. Superior pedestrian, bicycle, and/or transit access. 7. In -vehicle sales or service shall only be permitted in PUDs where the principal use is commercial and when it can be demonstrated that the operation will not have a significant adverse effect on the level of service of nearby streets and intersections; in -vehicle sales or service must also comply with the following conditions: 4 P ip 1 a. Drive through facilities and stacking areas shall not be located adjacent to any "R" Use District or any Residential or Human Care Use within the PUD. b. A Bufferyard "D" shall be provided between drive through facilities and stacking areas and adjacent streets and properties. c. Stacking shall be provided for a minimum of 6 cars per customer service point. d. Stacking shall be prohibited on public streets, in fire lanes, and in areas that interfere with on-site vehicular and pedestrian circulation. 8. All trash handling and loading areas must be interior or utilize architectural screening consisting of the same exterior facing materials as the principal building. 9. Truck circulation and loading areas must be separated from streets and properties adjoining the PUD by a bufferyard F. 10. Buildings constructed after adoption of this ordinance must utilize at least 80% Class I materials on each building face and no Class III materials on any building face that is visible from public areas within the PUD or from off-site. All buildings within the PUD must be visually integrated by utilizing some of the same exterior materials and architectural elements such as roof pitch, window treatments, and massing. 11. Buildings constructed after adoption of this ordinance must utilize parapet walls to completely screen rooftop equipment from ground and street level view and must paint rooftop equipment to match the color of the roof in order to minimize the visual impact as viewed from other buildings. 12. Buildings constructed after adoption of this ordinance are subject to the following height restrictions based upon distances from adjacent residential districts: a. Within a distance equal to the minimum lot width of an adjacent residential district, the maximum height shall not exceed the height allowed in the adjacent residential district; said height restriction may be waived if the adjacent residentially zoned property is public park or open space that is protected by covenants. b. Within a distance equal to two times the minimum lot width of an adjacent residential district, the maximum height shall not exceed two times the height allowed in the adjacent residential district; said height restriction may be waived if the adjacent residentially zoned property is public park or open space that is protected by covenants. c. In other areas of PUD sites, building height shall be restricted by maximum density provisions and to prevent the casting of shadows for a period greater than two hours on residential uses within the PUD between the hours of 9 a.m. and 3 p.m. 13. Developments constructed after adoption of this ordinance must include sidewalks and/or bikeways along all public street right of ways as determined appropriate and on-site pedestrian/bicycle facilities that provide logical connections to off-site uses and are separated from parking areas by curbed, landscaped islands a minimum of 20 feet in width inclusive of sidewalk. 14. Developments constructed after adoption of this ordinance that can be served by public transit must provide at least one transit stop that conveniently serves the development. 15. Signage shall be allowed in conformance with the approved final PUD site plan and development agreement in accordance with the following conditions: a. Pylon signs are not permitted; and b. Freestanding monument signs shall utilize the same exterior materials as the principal building(s); and c. Maximum allowable numbers, sizes, and heights shall be regulated by Section 14:6-2 except as specifically modified by the final PUD site plan and development agreement at the sole discretion of the City Council. 16. A development agreement is required as part of the final PUD approval and shall address at a minimum: approved site and building design criteria, approved sign locations and design criteria, construction phasing, bonding or other financial surety for construction of on- and off-site improvements generated by the development, and maintenance. 17. The PUD shall comply with all other applicable Code provisions unless specifically modified by Subsections D.1- D.16 of this ordinance or by approval of a final PUD plan and development agreement. Freestanding Signs. Except for private directional, project information, real estate, political, decorative banners, and temporary signs, no more than one freestanding sign shall be permitted on an individual street frontage of a lot or PUD site. R. Sign Area and Height. Exterior surface materials of buildings shall be subject to the following regulations. 1. Classes of Materials. For the purpose of this subsection, materials shall be divided into Class I, Class II, and Class III categories as follows: Class I - Brick, marble, granite or other natural stone, textured cement stucco, copper, porcelain, and glass are Class I exterior building materials on buildings other than those used as dwellings which contain four (4) or fewer dwelling units. Wood or vinyl siding and prefinished metal are Class I materials on residential buildings containing four or fewer dwelling units in addition to the other Class I materials listed in this subsection. Class II - exposed aggregate concrete panels, burnished concrete block, integral colored split face (rock face) and exposed aggregate concrete block, cast -in-place concrete, artificial stucco (E.I.F.S., Drivit), artificial stone, prefinished metal. Class III - unpainted or surface painted concrete block (scored or unscored), unpainted or surface painted plain or ribbed concrete panels, and unfinished or surface painted metal. G. Building design shall be consistent with the following requirements: The height, bulk, general massing, roof treatment, materials, colors, textures, major divisions, and proportions of a new or remodeled building shall be compatible with that of other buildings on the site and on adjacent sites. No unbroken building wall may exceed a 4 to 1 ratio of wall length to wall height, and each building wall deviation at the 4:1 ratio shall be a minimum depth of 4 feet; where a maximum 3:1 wall length to wall height ratio is used, the minimum depth of each building wall deviation may be reduced to 3 feet; where a maximum 2:1 wall length to wall height ratio is used, the minimum depth of each building wall deviation may be reduced to 2 feet. to ST 94 No building may display more than 5% of any elevation surface in bright, pure accent colors. Design review shall be done by the Zoning Administrator or the Zoning Administrator's designee, except in cases where a conditional use permit or planned unit development process is required, in which case the design review shall be done by the Planning Coordinator. The staff decision is subject to review by the City Council. Amend Section 14:6-7 PLANNED UNIT DEVELOPMENT (PUD) PROCESS as follows: SECTION 14:6-7.4 MODIFICATIONS (Page 300) C. Any modification approved as part of a PUD shall not exceed the maximum modification allowed as shown on Table 6-7.A except as specifically approved for shopping centers over 200,000 square feet according to the conditions in Section 14:5-53 or as specifically approved for mixed use developments according to the conditions in the M -X Mixed Use District: Sec. 3. The contents of Planning Case File 95-27-ZA are hereby entered into and made part of the public hearing record and the record of decision for this case. Sec.4. This Ordinance shall take effect fifteen days after its publication.
