ORDINANCE NO. 2039-95
AN ORDINANCE AMENDING THE ST. LOUIS PARK MUNICIPAL CODE
RELATED TO AMORTIZATION OF NONCONFORMING USES: ADDING
SECTION 14:7-4.1 ESTABLISHING A REASONABLE AMORTIZATION
PERIOD.
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. The City Council has made Findings related to amortization of the Apple
Valley Red -E -Mix facility located at 3270 Gorham Avenue South. Si Louis Park, Minnesota,
as attached hereto as Exhibit A. which are incorporated herein by reference..
Section 2. Section 14:7-4 of the St. Louis Park Zoning Ordinance is hereby amended to
add the following section 14:7-4.1:
Section 14:7-4.1. Amortization of Apple Valley Red -E -Mix. The reasonable
amortization period applicable to the ready -mix facility owned and operated by
Apple Valley Red -E -Mix at 3270 Gorham Avenue South, St. Louis Park,
Minnesota, shall be two (2) years, commencing upon publication of this
ordinance. At the conclusion of the two-year amortization period, Apple
Valley Red -E -Mix's nonconforming ready -mix use shall terminate and cease to
operate. In accordance with Minnesota Statutes Section 462.362 and St. Louis
Park Ordinance Code Section 14:8-7.1, this section shall be enforceable by
mandamus, injunction, or any other appropriate remedy in any court of
competent jurisdiction.
Section 3. This ordinance shall take effect upon publication, in accordance with St. Louis
Park Ordinance Code Section 14:7-4(D)(4).
