AN ORDINANCE AMENDING THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING O'
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Findings
Sec. 1. The City Council has considered the advice and recommendation of the
Planning Commission, staff report and other pertinent material in Planning Case No. 94-19-
ZA, as well as information received at the public hearing on May 23, 1994
Sec. 2. The City Council makes the following specific findings of fact:
A. The rear yard setback requirement in the R-3 District was intended to be
consistent with the rear yard setback requirement in the other residential
districts.
B. The building setback from internal streets or parking lots in the R-4 District is
stated twice, therefore unnecessary and confusing in the administration of
this Ordinance.
C. Reduction in the number of vehicles which may be refueled at any given time
at a service station in the C-1 District is consistent with the purposes of the C-
1 Zoning District and Comprehensive Plan policies which relate to the
relationship between commercial and residential land uses.
D. Language related to land uses in the "I" Use Districts which are located
adjacent to railroad track or street rights-of-way greater than 66 feet in width
did not clearly state the intent of that section of the Ordinance.
E. Operation of nonconforming uses are treated differently by the Zoning
Ordinance depending on whether they own or lease the premises they occupy.
F. Requiring that another legal notice shall be given for any public hearing
required by the Ordinance which are continued more than once will ensure
that due process is afforded to all interested parties and that an adequate
record of decision can be developed.
Sec. 3. The following Sections of the Ordinance are hereby amended as follows:
Page 64 - Section 14:5-2 - Table 5-2B amend the rear yard setback in the R-3 District
to read to 25 feet.
Page 109 - Section 14:5-4.4(F)(6) amend the rear yard depth to read 25 feet
Page 116 - Section 14:5-4.5(D)(1) delete letter "g".
Page 128 - Section 14:5-4.6(D)(1) delete letter "g".

Page 142 - Section 14:5-5.2(D)(1)(b) amend to read as follows:
b. The gasoline pump stands, dispenser type and location shall be designed so
that no more than eight (8) vehicles can be refueled at any given time.
Page 178 - Section 14:5-7.1(A)(10) amend to read as follows:
Properties in the "I" Use Districts situated so that railroad tracks or street and
highway rights-of-way which are greater than 66 feet in width are located
between the property in the "I" Use District and the "R" Use District are
exempt from this requirement, except for that part of the site within 100 feet
of a property line abutting any residentially used property.
Page 312 - Section 14:7-3 (A)(2) - delete the last paragraph.
Page 323 - Add Section 14:8-2.9 Public Hearings as follows:
SECTION 14:8-2.9 PUBLIC HEARINGS
Any public hearing required by this Ordinance may be continued once. If a
hearing is continued more than once, another notice shall be given in
accordance with Section 14:83.2(B).
Sec. 4. The contents of Planning Case File 94-19-ZA are hereby entered into and
made part of the public hearing record and the record of decision for this case.
Sec.4. This Ordinance shall take effect fifteen days after its publication.

This ordinance authorizes a number of
amendments to the Zauung Ordmance including
changes m public Hearing notice reqwrements
to require renotice of meetings which had been
continued more that once, clarification of a sec-
tion m the Ordrnanctrestncting weekend hours
of work in certalkipcations, removal of a provi-
sion which regwres a landlord to lease proper-
ty formerly occupied by a nonconforming use
only to a use permitted under the current Or-
dinance, a change in the number of fueling loca-
tions for gas stations in the C-1 District from 10
to 8 and four teclwcal amendments relating to
setbacks in the R-3 District and elimination of
a redundant condition in the R-4 District
