HomeMy WebLinkAbout94-1996 - ADMIN Ordinance - City Council - 1994/05/02r ORDINANCE NO. 94-1996 AN ORDINANCE AMENDING THE CABLE COMMUNICATIONS FRANCHISE ORDINANCE FOR THE OPERATION OF A CABLE TELEVISION SYSTEM IN ST. LOUIS PARK: ST. LOUIS PARK MUNICIPAL CODE, PART 7 - CABLE TELEVISION THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. Section 9-717(1) of the St. Louis Park Municipal Code is hereby amended as follows: (1) Basis; Approval. Fees, rates or charges for any service provided shall be fair, reasonable and non-discriminatory and designed to meet all necessary costs of service including a fair and reasonable return on investment under economical and efficient management. All fees, rates and charges shall be filed with the City provided that City is duly authorized by the Federal Communications Commission to regulate rates charged for basic service, installation and equipment. City may regulate such rates in accordance with regulations promulgated by the Federal Communications Commission. For purposes of this section, the terms "basic service," "installation" and "equipment" shall have the same meaning as in 47 C.F.R. S76.901, et. seq. Section 2. Section 9-717(4) of the St. Louis Park Municipal Code is hereby repealed and replaced with Section 9-717(4) as follows: (4) Procedure. Grantee shall provide any and all documents and information requested by City in connection with City's review of rates charged or proposed to be charged by grantee. City shall not approve or disapprove any rate changes proposed by grantee until after holding a duly -noticed public hearing thereon. Section 3. Effective date. This ordinance shall take effect sixty (60) days from notice of public hearing date or immediately upon its adoption, whichever occurs first.
