HomeMy WebLinkAbout93-1915 - ADMIN Ordinance - City Council - 1993/05/03ORDINANCE NO. 191593 AN ORDINANCE AMENDING THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING THE CITY OF ST. LOUIS PARK DOES ORDAIN: Sec. 1. The City Council has considered the advice and recommendation of the Planning Commission, staff report and other pertinent material in Planning Case No. 93-5- ZA, as well as information received at the public hearing on April 19, 1993. Sec. 2. The City Council makes the following specific findings of fact: 1) There are certain inconsistencies in several provisions of the Zoning Ordinance relating to setbacks and bufferyards. 2) to allow for more efficient administration of the Ordinance and to enhance public understanding of the Ordinance provisions, it is necessary to eliminate these inconsistencies. 3) Elimination of the inconsistencies will not be contrary to the stated Findings and Purpose of the Zoning Ordinance but will further the Purpose of the Ordinance. Sec. 3. To create consistency in the application of Ordinance provisions, the following Sections of the Ordinance are hereby amended to read as follows: Page 79 -- Section 14:5-4.1(A)(7)(e) e. The total ground floor area of all accessory buildings shall not exceed 25 percent of the area between the principal structure and rear lot line and in the "R-1", "R-2", or "R-3" districts, it shall not exceed eight hundred (800) square feet. Page 81— Section 14:5-4.2(C)(3)(c) c. Outdoor recreational and play areas shall be located at least 25 feet from any lot in an "R" Use District and shall be buffered from such residential use with a Bufferyard "C". Page 89 -- Section 14:5-4.2(F)(6) -- Number 6 rewritten as follows: 6. The depth of the front yard of a lot shall be thirty-five (35) feet deep unless the average depth of at least two (2) existing front yards, for buildings within one hundred fifty (150) feet along the same block front of the lot in question , are less or greater than thirty-five (35) feet, then, the required front yards shall be the average depth of such existing front yards. However, the depth of 1 a front yard shall not be less than twenty (20) feet or be required to exceed fifty (50) feet. This change should also be added to the following sections: Page 99 -- Section 14.5-4.3 (F) (6) Page 109 -- Section 14:5-4.4 (F) (7) Page 121-- Section 14:5-4.5 (G) (7) Page 133 -- Section 14:5-4.6 (G) (7) Page 144 -- Section 14:5-5.2 (F) (4) Page 158 -- Section 14:5-5.3 (G) (4) Page 91-- Section 14:5-4.3(C)(3)(c) c. Outdoor recreational and play areas shall be located at least 25 feet from any lot in an "R" Use District and shall be buffered from such residential use with a Bufferyard "C". Page 101-- Section 14:5-4.4(C)(4)(c) c. Outdoor recreational and play areas shall be located at least 25 feet from any lot in an "R" Use District and shall be buffered from such residential use with a Bufferyard "C". Page 105 -- Section 14:5-4.4(D)(2)(b) b. All structures shall be located a minimum of 15 feet from any lot in an "R" Use District. Page 105 -- Section 14:5-4.4(D)(2)(d) d. A Bufferyard "C" shall be installed and maintained along all property lines abutting an "R" Use District. Page 112 -- Section 14:5-4.5(C)(2)(a) a. At least 40 square feet of outside play space per pupil must be provided and such space shall be enclosed by Fence F3 and Bufferyard "C". Page 113 -- Section 14:5-4.5(C)(7)(a) a. Buildings shall be located a minimum of 25 feet from a lot in an "R" Use District. Page 113 -- Section 14:5-4.5(C)(8) 8. PARKS AND RECREATION Page 114 -- Section 14:5-4.5(C)(9)(a) a. Buildings shall be located a minimum of 25 feet from a lot in an "R" Use District. 2 Page 116 -- Section 14:5-4.5(D)(1) Delete condition "c" and reletter conditions "d" through "h" as conditions "c" through "g" Page 117 -- Section 14:5-4.5(D)(3)(b) b. All structures shall be located a minimum of 15 feet from any lot in an "R" Use District. Page 124 -- Section 14:5-4.6(C)(2)(a) a. A minimum of 40 square feet of outside play space per pupil must be provided and such space shall be enclosed by Fence F3 and Bufferyard "C". Page 124 -- Section 14:5-4.6(C)(3)(d) d. The use shall be located a minimum of 1500 feet from two other group homes. Page 125 -- Section 14:5-4.6(C)(8) 8. PARKS AND RECREATION Page 126 -- Section 14:5-4.6(C)(9)(a) a. Buildings shall be located a minimum of 25 feet from a lot in an "R" Use District. Page 128 -- Section 14:5-4.6(D)(1) Delete condition "c" and reletter conditions "d" through "h" as conditions "c" through "g" Page 129 -- Section 14:5-4.6(D)(5)(a) a. All exterior faces of all buildings shall meet the provisions of Section 14:6-6. Page 129 -- Section 14:5-4.6(D)(5)(b) b. All structures shall be located a minimum of 15 feet from any lot in an "R" Use District. Page 130 -- Section 14:5-4.6(D)(5)(d) d. A Bufferyard "C" shall be installed and maintained along property lines in an "R" Use District. Page 136 -- Section 14:5-5.1(C)(2)(a) a. A minimum of at least 40 square feet of outside play space per pupil shall be provided and such space shall be enclosed by a Bufferyard D. The bufferyard shall include at a minimum a Fence F3 as described in Section 14:6-4 3 Page 138 -- Section 14:5-5.2(C)(6)(a) a. All exterior faces of all buildings shall meet the provisions of Section 14:6-6. Page 138 -- Section 14:5-5.2(C)(6)(b) b. All structures shall be located a minimum of 15 feet from any abutting property located in an "R" Use District. Page 138 -- The following Section 14:5-5.2(C)(6)(d) should be added: d. A Bufferyard "C" shall be installed and maintained along all property lines in an "R" Use District. Page 138 -- Section 14:5-5.2(C)(7)(b) -- Add b. Where animals are boarded, the facility shall be located a minimum of 100 feet from abutting properties in an "R" Use District. Page 138 -- Section 14:5-5.2(C)(8)(a) Section 8.a. -- Change 500 feet to 300 feet. Page 138 -- Section 14:5-5.2(C)(11) The existing conditions should be deleted and replaced with the following. 11. CLUBS AND LODGES WITHOUT LIQUOR LICENSE Conditions: a. Access shall be from a roadway identified in the Comprehensive Plan as a collector or arterial or otherwise located so that access can be provided without conducting significant traffic on local residential streets. b. The building housing the use shall be located a minimum of 25 feet from any property located in an "R" Use District. c. A Bufferyard "E" shall be installed and maintained along all property lines which abut property in an "R" Use District. This bufferyard shall include at a minimum a berm "B2" or fence "F5". Page 140 -- Section 14:5-5.2(C)(17)(c) c. A Bufferyard "E" shall be installed and maintained along all property lines which abut property in an "R" Use District. This bufferyard shall include at a minimum a berm "B2" or fence "F5". Page 141-- Section 14:5-5.2(C)(21) Add Item i i. Page 195 -- Section 5-7.3(C)(11)(a) Section 11.a. -- Change Bufferyard "E" to Bufferyard "D". 7 Page 233 -- Section 14:6-1.2(C)(12) 12. Yards. Parking areas shall be subject to the requirements of front yards and side yards abutting a street in all "R" Use Districts, except that in the R-1, R-2 and R-3 Use Districts, parking for a detached single family or two family house shall be permitted in the front yard under the following conditions: The paragraph following (12)(c) on page 233, should be amended to read as follows: Parking areas in the "C-1", "C-2", "0", "I -P" and "I -G" Use Districts shall be permitted in the front yard and side yards abutting a street provided that all of the following requirements are met, but in no case shall the yard be reduced to less than six (6) feet. Page 295 -- Section 14:6-6.2(L) L. All developments shall consider the effect of sun angles and shade patterns on adjacent buildings. All new multiple family and non-residential buildings and additions thereto shall not be located so that the structure casts a shadow which covers more than 50% of an adjacent wall of a principal structure for a period greater than 2 hours between 9:00 a.m. and 3:00 p.m. for more than 60 days of the year. This Section 14:6-6.2L will not apply in an industrial use district, provided that shade is cast upon a wall which does not have any openings. Page 318 -- Section 14:7-4(G)(1)(2)(3) -- Sections (1) (2) and (3) shall be deleted and replaced with the following. 1. If the required bufferyard is a "B" and the available bufferyard width is at least 4 but less than 10 feet a bufferyard shall be installed on the available width using the 100% of the required plant units. 2. If the required bufferyard is either "A" or "B" and the available bufferyard width is less than 4 feet, an F1 fence and 50% of the plant units required for each 100 linear feet of bufferyard shall be installed. 3. If the required bufferyard is either "C" or "D" and the available bufferyard width is at least 4 but less than 10 feet, the bufferyard shall be installed on the available width using an F2 fence plus 50 plant units for each 100 linear feet of bufferyard. Sec. 4. The contents of Planning Case File 93-5-ZA are hereby entered into and made part of the public hearing record and the record of decision for this case. Sec. 5.
