HomeMy WebLinkAbout92-1902 - ADMIN Ordinance - City Council - 1992/12/07r r i ORDINANCE NO. 92-1902 SUMMARY OF AN ORDINANCE AMENDING CHAPTER 14 OF THE ORDINANCE CODE RELATED TO ZONING BY REPEALING SECTIONS 14-101 THROUGH 14-230 INCLUSIVE AND ADOPTING SECTIONS 14:1-0 THROUGH 14:8-7 INCLUSIVE IN THE DOCUMENT ENTITLED DRAFT ZONING ORDINANCE DATED OCTOBER 28, 1992, AS AMENDED THE CITY OF BT. LOUIE PARR DOES ORDAIN: Sec. 1. The City Council has considered the advice and recommendation of the Planning Commission, Zoning Ordinance Task Force, Zoning Ordinance Citizens Advisory Committee, staff reports and other pertinent material in Planning Case No. 89-4-ZA as well as the testimony of interested persons at public hearings conducted on August 6, 1991, October 23, 1991 and November 23, 1992. Sec. 2. Sections 14-101 through 14-230 of the Ordinance Code are hereby repealed. Sec. 3. The City Council makes 88 specific findings organized into the following categories: I. History of the City and adoption of the City's Comprehensive Plan II. Goals and Policies of the City's Comprehensive Plan III. History of this Zoning Ordinance IV. To Support adoption of Zoning Ordinance V. Termination of existing and future uses, including: A. Concrete plants B. Bars without full-service on -premise restaurants C. Auto reduction facilities, salvage yards, junk yards VI. Other findings A. Consolidation of zoning districts B. Parking modifications C. Signage reduction D. Lighting E. Landscaping and bufferyards F. Architectural design G. Planned unit development process H. Non -conformities I. Industrial zoning J. Erosion control K. Tree removal L. Regulate location of sexually oriented businesses Sec. 4. The document entitled Draft Zoning Ordinance dated October 28, 1992, a summary of which is hereby adopted and hereby replaces Sections 14-101 through 14-230 inclusive and substitutes new sections numbered 14:1-0 through 14:8-7 inclusive: Summary: This ordinance is a new Zoning Ordinance for the City of St. Louis Park and is intended to regulate and guide current and future development in the City. The Ordinance consists of eight major parts which are as follows: Part 1 - Purpose and Intent Part 2 - Rules of Construction Part 3 - Definitions and Abbreviations Part 4 - General Provisions Part 5 - Zoning Districts Part 6 - Special Provisions Part 7 - Non -Conformities Part 8 - Administration The following is a summary of each major part of the ordinance: Part 1 - Purpose and Intent - In this Section, the City Council finds it necessary to establish minimum requirements to protect the public health, safety, morals, comfort, convenience and general welfare of the people. The Ordinance divides the City into land use districts and establishes regulations which control the location, erection, construction, reconstruction, alteration and use of structures and land. Part 2 - Rules of Construction - Contains the rules which govern the application and interpretation of the various provisions of the Ordinance. Part 3 - Definitions and Abbreviations - Defines and illustrates, where appropriate, the terms and abbreviations used in the Ordinance. Part 4 - General Provisions - Contains general regulations which apply throughout the community relating to lot provisions, yard encroachments allowed, fences, traffic visibility, pedestrian access, modifications to height limits, grading and filling, requirements and standards for erosion control plans and procedures, restrictions on tree removal and provisions for temporary land uses. Part 5 - Zoning Districts - Contains the requirements for ten zoning districts and four overlay districts in the City. The ten districts are the R-1 Single Family Residential District, R-2 1 4 Single Family Residential District, R-3 Two -Family Residential District, R-4 Multi -Family Residential District, R -C Multi Family Residential District, C-1 Neighborhood Business District, C-2 General Commercial District, 0 Office District, I -P Industrial Park District, I -G General Industrial District. The four overlay districts established are the FW Floodway District, FF Flood Fringe District, FP General Floodplain District, TDM Travel Demand District. This Section also adopts the zoning map illustrating the location of the zoning districts in the community. In each district, specific land uses are permitted, permitted with conditions, permitted by conditional use, permitted through the Planned Unit Development Process or are permitted as accessory uses. The district regulations also specify specific performance standards which must be met as well as dimensional standards including lot size, building and parking setbacks, floor area ratios and height limits. The purpose of the R1 Single Family Residence District is to provide appropriately located areas for single family living on larger lots. The purpose of the R2 Single Family Residence District is to provide appropriately located areas for single family living at reasonable population density consistent with sound standards of public health. The purpose of the R3 Two Family Residence District is to provide appropriately located areas for one and two family dwelling units on parcels of reasonable size. The purpose of the R4 Multiple Family Residence District is to provide appropriately located areas for family living in a variety of dwelling types at densities of up to thirty units per acre with sound standards for public health and safety. The purpose of the RC High Density Multiple Family Residence District is to provide appropriately located areas for family living in a variety of dwelling types at densities of up to fifty units per acre with sound standards for public health and safety. The purpose of the Cl Neighborhood Commercial District is to provide for low intensity, service oriented commercial uses for surrounding residential neighborhoods. The purpose of the C2 Commercial District is to allow the concentration of general commercial development for convenience of the public and mutually beneficial relationships to each other in those areas located away from residential areas designated by the Comprehensive Plan. The purpose of the "0" Office District is to provide opportunities for high density office development in areas outside of commercial districts. The purpose of the IP Industrial Park District is to provide locations for large and small scale industrial enterprises engaged in activities not typically associated with high levels of potential nuisances. The purpose of the IG General Industrial District is to provide locations for large and small scale industrial enterprises. The purpose of the FF, FP and FW Floodplain Districts are to regulate development in areas subject to flooding in order to minimize the potential loss of life, property and health and to minimize safety hazards, disruption of commerce and governmental services and impairment of the tax base. The purpose of the TDM Travel Demand Management District is to provide a means whereby the capacity of interchanges on Interstate 394 serving the City of St. Louis Park may be maintained at efficient levels of service which will serve to reduce traffic, congestion, air and noise pollution and other associated environmental problems. Part 6 - Special Provisions - Contains rules and regulations which may apply to certain properties or in certain areas of the community. These regulations fall into seven categories as follows: A. Standards and requirements for the provision of off- street parking for each land use in the community are established. B. The size and location of signs are regulated based on the type of land use and the zoning district in which it is located. C. Requirements for lighting plans and illumination levels are established to minimize the impact of light pollution on adjacent properties. D. Extensive standards for landscaping and bufferyards are established. The intent is to minimize the impact of higher intensity, typically nonresidential land uses on lower intensity, typically residential land uses. E. General conditions are established which must be met for any conditional use which is approved in the community. F. Standards for Architectural Design are established to promote a high standard of development in the City. 1 4 G. A Planned Unit Development Process is established which will permit greater flexibility in the development of property by tailoring the development to the site and the neighborhood. Benefits of this process include greater utilization of new building design and technology, higher standards of site and building design, more effective and efficient of streets, utilities and public facilities, and a more creative and efficient use of land. Part 7 - Non -conformities - Deals with properties, structures and land uses which do not comply with the terms of the Zoning Ordinance; establishes different categories of non -conformities and prescribes procedures dealing with the treatment of each type of non -conformity; and further provides for the termination after a reasonable amortization period of land uses not permitted anywhere in the City by this Ordinance. Part 8 - Administration - Establishes procedures for the administration and enforcement of this Ordinance including penalties for noncompliance and authorizing procedures to compel compliance. Sec. 5. The contents of Planning Case Files 89-4-ZA and 92 -20 -CP are hereby entered into and made part of the public hearing record and the record of decision for the case. Sec. 6. This Ordinance shall take effect fifteen days after its publication.
