HomeMy WebLinkAbout92-1901 - ADMIN Ordinance - City Council - 1992/11/16r 1 ORDINANCE NO. 92-1901 AN ORDINANCE VACATING A PORTION OF THE UTILITY EASEMENT ON LOT 11, BLOCK 2, SUBURBAN HOMES CO.'S ADDITION (4044 WEBSTER AVENUE) THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. Due to the presence of a house and garage on Lot 11, Block 2, Suburban Homes Co.'s Addition (4044 Webster Avenue - "Property") within a public utility easement, there exists a property title defect. As a result, the City has been petitioned to vacate that portion of the utility easement the City does not consider necessary to protect the public's interest, and the City has determined that the vacation of a portion of the easement will not adversely affect the maintenance of a municipal sewer located along the Property's south line or an overhead electrical system located along the Property's west line. Section 2. Said vacation petition has been duly filed with the City Clerk, and the City Council has conducted a public hearing upon said vacation petition and determined that the portion of the public utility easement described below is not needed for public purposes, and that it is for the best interest of the public that said public utility easement be vacated. Section 3. The public utility easement as now dedicated and laid out on the Property is vacated except for the following: 1. The westerly five feet of Lot 11, Block 2, Suburban Homes Co.'s Addition 2. The southerly five feet of the westerly 19.7 feet; together with the southerly 1.86 feet of the easterly 24.2 feet of the westerly 43.9 feet; together with the southerly five feet east of the westerly 43.9 feet, Lot 11, Block 2, Suburban Homes Co.'s Addition K Section 4. The City Clerk is instructed to record certified copies of ib this ordinance in the Office of the Hennepin County Register of Deeds or Registrar of Titles as the case may be. ed Section 5.
