ORDINANCE NO.1869 -91
AN EMERGENCY ORDINANCE ESTABLISHING A MORATORIUM
ON CERTAIN LAND USE APPROVALS AND BUILDING
PERMIT ISSUANCE IN SPECIFIED INDUSTRIAL AREAS
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Findings
Sec. 1. Purpose: The purpose of this Ordinance is to establish a moratorium on land
use approvals and building permit issuance in certain industrial areas within the City
pending fi al study and adoption of the proposed Zoning Ordinance dated May 31, 1991.
Sec. 2. Findings: The City council hereby fords and determines as follows:
a. A public hearing was held in City Hall on August 6, 1991, for the purpose of
hearing testimony regarding the proposed Zoning Ordinance for the City of
St. Louis Park.
b. Testimony received at the public hearing indicated the existence of public
concern regarding general incompatibility between residential land uses and
industrial land uses which abutted one another.
c. Recent inquiries concerning potential development in certain industrial areas
suggests the potential for further incompatibility if development is approved
or building permits issued under the provisions of the current Zoning
Ordinance where certain development in the industrial areas would not be
permitted under the proposed Zoning Ordinance.
d. The proposed Zoning Ordinance would not permit the proposed incompatible
land use referred to in "c" above.
e. The City Council held study sessions on the proposed Zoning Ordinance on
August 26, 1991, September 11, 1991 and October 14, 1991, to further
consider and study the proposed Zoning Ordinance, and to consider testimony
received at the public hearing held August 6, 1991.
f. The City Council enacted an emergency ordinance to establish a moratorium
on land use approvals and building permit issuance in certain areas within the
City on August 26, 1991. This emergency ordinance expires on October 28,
1991 and an interim ordinance adopted by the City Council on October 21,
1991 will not become effective before November 14, 1991.
g.
The City Council hereby finds that the emergency conditions which
necessitated passage of the emergency ordinance on August 26, 1991 are still
in existence and, pursuant to Section 3.06 of the City Charter, the
reenactment of the emergency ordinance is justified and necessary.
h. Adoption of this emergency ordinance is necessary to protect the public
health, safety and general welfare and to preserve the integrity of the
planning and zoning process in the City of St. Louis Park.
Section 3. Development Restrictions: Pursuant to the above findings and Minnesota
Statutes 462.355 Subd. 4, the City of St. Louis Park hereby enacts the following
development restrictions to be imposed upon those areas proposed to be zoned I -G, General
Industrial, or I -P, Industrial Park Districts, pursuant to the Draft Zoning Ordinance dated
May 31, 1991 and the Zoning Map appertenent thereto.
a. No land use shall be established within the areas proposed to be designated as
I -P, Industrial Park District, or I -G, General Industrial District, in the
Proposed Zoning Ordinance dated May 31, 1991 unless such land use is listed
as either permitted or permitted with conditions in the Proposed Zoning
Ordinance dated May 31, 1991.
b. This ordinance applies only to the establishment of land uses and does not
require uses which may be legally established to adhere to performance
standards or dimensional requirements contained in the Proposed Zoning
Ordinance dated May 31, 1991.
c. Nothing in this ordinance shall be construed to prohibit any improvement
necessary to correct violations of City Ordinance or State Law or which are
necessary to correction situations where a hazard to public health and safety
presently exist.
Sec. 4. Term: This Ordinance shall be effective 24 hours after its filing with the City
Clerk and its posting in 3 conspicuous places in the City. This ordinance shall terminate
upon the effective date of the Interim Ordinance adopted October 21, 1991 or 61 days after
the effective date of this ordinance, whichever conies first.
