ORDINANCE NO, 1868-91 AN INTERIM ORDINANCE ESTABLISHING A MORATORIUM ON CERTAIN LAND USE APPROVALS IN SPECIFIED INDUSTRIAL AREAS THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. Purpose: The purpose of this ordinance is to establish a moratorium on land use approvals in certain industrial areas within the City pending final study and adoption of the Proposed Zoning Ordinance dated May 31, 1991. Section 2. Findings: The City Council hereby fords and determines as follows: a. The City adopted major amendments to the City's Comprehensive Plan on April 1, 1991 which affect land use, transportation and housing. b. The City's Zoning Ordinance is one of the primary tools used to implement the Comprehensive Plan. c. The City has appointed a Zoning Ordinance Task Force and Citizen Advisory Committee to provide guidance, direction and input in the preparation of the proposed new ordinance. d. The proposals and recommendations of these groups have been duly considered as they relate to zoning changes which are necessary to implement the Comprehensive Plan. e. A draft of the Proposed Zoning Ordinance dated May 31, 1991 has been developed based on the recommendations of the Zoning Ordinance Task Force. f. The Planning Commission has, pursuant to applicable State Statutes, considered the draft ordinance and has made specific recommendations thereon. g. The City Council held a public hearing in City Hall on August 6, 1991 for the purpose of hearing testimony regarding the Proposed Zoning Ordinance dated May 31, 1991 for the City of St. Louis Park. h. Testimony received at the public hearing indicated the existence of public concern regarding the general incompatibility between residential land ,uses and industrial land uses which abut one another. i. The Proposed Zoning Ordinance dated May 31, 1991 would not permit some of the proposed incompatible land uses in industrial areas. The City adopted an Interim Emergency Ordinance on August 19, 1991 which became effective on August 28, 1991 to restrict the establishment of certain industrial uses in the proposed industrial districts because of the concerns raised at the public hearing regarding the potential incompatibility of these industrial land uses and because of goals and policies stated in the City's j. Comprehensive Plan. k. The City Council is in the process of considering the adoption of the Proposed Zoning Ordinance dated May 31, 1991 and has scheduled a public hearing for October 23, 1991 on the Proposed Zoning Ordinance. 1. Adoption of this interim ordinance is necessary to protect the public health, safety and general welfare and to preserve the integrity of the planning and zoning process in the City of St. Louis Park. Section 3. Development Restrictions: Pursuant to the above findings and Minnesota Statutes 462.355 Subd. 4, the City of St. Louis Park hereby enacts the following development restrictions to be imposed upon those areas proposed to be zoned I -G, General Industrial, or I -P, Industrial Park Districts, pursuant to the Draft Zoning Ordinance dated May 31, 1991 and the Zoning Map appertenent thereto. a. No land use shall be established within the areas proposed to be designated as I -P, Industrial Park District, or I -G, General Industrial District, in the Proposed Zoning Ordinance dated May 31, 1991 unless such land use is listed as either permitted or permitted with conditions in the Proposed Zoning Ordinance dated May 31, 1991. b. This ordinance applies only to the establishment of land uses and does not require uses which may be legally established to adhere to performance standards or dimensional requirements contained in the Proposed Zoning Ordinance dated May 31, 1991. c. Nothing in this ordinance shall be construed to prohibit any improvement necessary to correct violations of City Ordinance or State Law or which are necessary to correct situations where a hazard to public health and safety presently exist. Section 4. Term and Effective Date: This ordinance shall take effect fifteen days after its publication and shall remain in effect for a period of one year from its effective date or until the effective date of the Proposed Zoning Ordinance dated May 31, 1991, as amended or upon its rejection by the City Council, whichever comes first.
