ORDINANCE NO. 1863-91 AN EMERGENCY ORDINANCE ESTABLISHING A MORATORIUM ON CERTAIN LAND USE APPROVALS AND BUILDING PERMIT ISSUANCE IN SPECIFIED INDUSTRIAL AREAS THE CITY OF ST. LOUIS PARK DOES ORDAIN: Findings Sec. 1. Purpose: The purpose of this Ordinance is to establish a moratorium on land use approvals and building permit issuance in certain industrial areas within the City pending final study and adoption of the proposed Zoning Ordinance dated May 31, 1991. Sec. 2. Findings: The City council hereby finds and determines as follows: a. A public hearing was held in City Hall on August 6, 1991, for the purpose of hearing testimony regarding the proposed Zoning Ordinance for the City of St. Louis Park. b. Testimony received at the public hearing indicated the existence of public concern regarding general incompatibility between residential land uses and industrial land uses which abutted one another. c. Recent inquiries concerning potential development in certain industrial areas suggests the potential for further incompatibility if development is approved or building permits issued under the provisions of the current Zoning Ordinance where certain development in the industrial areas would not be permitted under the proposed Zoning Ordinance. d. The proposed Zoning Ordinance would not permit the proposed incompatible land use referred to in "c" above. e. The City Council has established dates for study sessions on the proposed Zoning Ordinance on August 26, 1991, and September 11, 1991, to further consider and study the proposed Zoning Ordinance, and to consider testimony received at the public hearing held August 6, 1991. f. Adoption of this emergency Ordinance is necessary to maintain the integrity of the planning and zoning process in the City. Adoption of this emergency ordinance is necessary to. protect the public health, safety and general welfare and to preserve the integrity of the planning and zoning process in the City of St. Louis Park. g. Sec. 3. Development Restrictions: Pursuant to the above findings, Minnesota Statutes 462.355, Subdivision 4 and Section 3.06 of the City Charter, the City of St. Louis Park hereby enacts the following development restrictions: a. No building permit, special permit, zoning change, Comprehensive Plan Amendment or other land use approvals shall be granted for developments or land uses in the areas proposed to be zoned I -G, General Industrial or I -P, Industrial Park pursuant to the draft Zoning Ordinance dated May 31, 1991, and the zoning map appurtenant thereto. b. The following activities are exempt from the provisions of this Ordinance: 1. Land use approvals or building permits for developments which are consistent with and permitted by the provisions of the draft Zoning Ordinance dated May 31, 1991. 2. Interior improvements for existing structures which do not require additional parking under applicable ordinances or do not establish a land use prohibited under "a" above. 3. Exterior additions to existing structures which do not increase the size of the structure by more than 10% of its existing gross floor area and further provided the existing structures occupied a land use permitted in the draft Ordinance dated May 31, 1991. 4. Any improvements necessary to correct violations of City Ordinance or State Law or which are necessary to correct situations where a hazard to public health and safety presently exist. Sec. 4. Term: This Ordinance shall be effective 24 hours after its filing with the City Clerk and its posting in 3 conspicuous places in the City.
