LOUIS PARK ORDINANCE CODE RELATED TO LICENSE AND PERMIT FEE INCREASES AND REPEALING SECTIONS RELATED TO OPENS FTRES, LOW-GRADE FUEL BURNING, AUCTION/ESTATE SALES•AND,WELL ABANDONMENT THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. The following Municipal Code sections related to license and permit fee increases are amended as attached: Sec. 11-521(2) 13-513 13-1103 13-214 13-543 13-1132 13-223 13-603 13-933 13-232 13-614 13-1334 13-404 13-633 13-1342 13-414 13-708 13-1404 13-423 13-709 13-1482 13-433 13-803 13-1502 13-443 13-1004 15-211.102(2) & .103 13-452 13-1023 15-243 13-473 15-352 Section 2. The following Municipal Code sections related to Open Fires, Low -Grade Fuel Burning, Auction and Estate Sales and Well Abandonment are repealed as attached: Sec. 11-213 13-1329 11-215 13-1329.102 11-216 13-1329.103 13-1325(1)(2) 13-1329.104 13-1326 13-1329.105 13-1327 15-244 13-1328 1 "Process and Refuse Burning" Section 11-211. Process Equipment License Fee. The annual license fee for a process equipment license shall be $60.00 at each location. Section 11-212. Refuse Burning Equipment License Fee. The annual license fee for a refuse burning equipment license shall be $30.00 at each location. "Temporary Noise Permits" Section 11-521(2). Temporary Noise Permit. (2) A person who makes an application for a temporary noise permit shall pay to the City a fee of $2.50 per day for each day of the permit requested in the application with the minimum fee being $40.00. "Gas Fitter" Section 13-214. License fee. The annual fee for each such license shall be $70.00. "Heating" Section 13-223. License Fee. The annual fee for such license shall be $70.00. "Parking" Section 13-225. Enclosed Parking Facility. No person shall own, operate or engage in the business of operating an enclosed parking facility exceeding 1,000 square feet with mechanical ventilation without first obtaining a license from the City Manager. All such facilities are subject to inspection and monitoring including carbon monoxide monitoring by the City. All ventilating facilities shall be kept in good repair and meet the requirements of the City Ordinance Code. Carbon monoxide and other toxic gas levels shall be safe levels established by the State of Minnesota. The license fee for such facility at each location shall be $90.00. "Plumbers" Section 13-232. License Fee. The annual fee for such license shall be $70.00. "Mechanical Amusement Devices" Section 13-404. License Fee. The annual license and/or renewal fee for each amusement device shall be $35.00. 1 1 i r IP Li "Children's Amusement Devices" Section 13-414. License Fees. The annual license fee for such a license shall be $35.00 for each amusement device. "Carnivals, Circuses" Section 13-423. License Fees. The fees for licenses to be issued under this ordinance shall be $230.00 for each day for which the license is issued for those carnivals and circuses which do not have food service operations. For carnivals and circuses which conduct food service operations, a fee of $50.00 for each separate food service operation shall be required. "Public Dance Halls" Section 13-433. License Fee. A license issued under this ordinance may be for one day only. The license fee for such period shall be $170.00. "Theaters" Section 13-443. License Fee. The annual license fee for such a license shall be: Seating Capacity License Fee 0-400 $330 401-700 $385 701-1000 $460 1001-1300 $550 More than 1300 $660 "Golf Driving Fairways" Section 13-452. License Fee. The annual license fee for such license shall be $120.00. "Billiard Halls and Bowling" Section 13-473. License Fee. The license fee for each billiard hall shall be $200.00 plus $20.00 per year for each table; for each bowling alley, the fee shall be $20.00 for each alley in the establishment. "Dog Kennels" Section 13-513. License Fee. The annual license fee for such license shall be $275.00 for commercial dog kennels and $135.00 for animal hospitals. 3 "Animal Training Schools" Section 13-543. License Fee. The annual license fee for such license shall be $140.00. "Weapons, Explosives, Excavations" Section 13-603. License Fee. The annual license fee for such target and trap shooting license shall be $60.00. "Explosives" Section 13-614. License Fee. The annual fee for such license shall be $180.00. A $100.00 deposit shall be required for cleaning litter and debris from the site of a public display of fireworks. Organizations conducting a public display of fireworks which have a tax-exempt status may, after having submitted a written request, have the license fee waived by the City Council or City Manager. "Excavation" Section 13-633. Permit Fee. The fee for a permit shall be $90.00 which shall accompany the application thereof. Section 13-708. Permit Fees. "Signs" (2) Wall, Freestanding, Ground, Portable, Directional, and Projecting Signs. The permit fee for a sign not exceeding 50 square feet in area shall be $40.00 and for each 50 square feet in area or fraction thereof in excess of 50 square feet in area, shall be an additional $12.50. This fee shall be calculated on the basis of only one side of a double-faced, back- to-back sign or billboard. (3) Temporary, Construction, Real Estate Signs. For any permit for a temporary sign, the fee shall be $30.00. The permit fee for a construction or real estate sign exceeding 40 square feet in area shall be $30.00. "Signs" Section 13-709. Annual Inspection Program and Fees. The Director of Inspectional Services shall inspect annually, or at such times he deems necessary, each billboard structure regulated by the Ordinance Code for the purpose of ascertaining whether the same is secure or insecure and whether it is in need of repair or removal and whether the surrounding site is properly maintained 1 4 ie and that it is in compliance with all City code requirements. To meet the expense of such inspection, the permittee therefor shall pay to the City Treasurer the sum of $115.00. ""Food" Section 13-803. License Fees. Fees for licenses issued hereunder shall be set forth herein. (1) Food Establishment License Fees. The annual license fee for each food establishment, except catering food vehicles, bakery food vehicles, packaged food establish- ments, potentially hazardous food vehicle, packaged snack food outlet and retail candy shops, shall be $240.00 provided, however, that if more than one facility such as, but not limited to, kitchen, bar, bakery, meat market, grocery store, delicatessen, which would require food establishment licenses if operated separately, shall be located on the same premises, the license fee shall be an additional $55.00 for each such facility in addition to the $240.00 for the first such facility. (2) Packaged Food Establishments. The annual license fee for each packaged food establishment shall be $110.00. (3) Itinerant Food Establishments. The license fee for each itinerant food establishment shall be $110.00. (4) Retail Candy Shop License. The annual license fee for each retail candy shop shall be $110.00 provided further that if the candy shop is operated in conjunction with another facility, as provided in Section 13-803(1), the retail candy shop shall be an extra facility and a charge of $35.00 added to the basic cost of the food establishment license. (5) Packaged Snack Food Outlet License Fee. The annual license fee shall be as follows: (a) For a single location, the annual license fee shall be $15.00 provided further if the single location is operated in conjunction with another facility requiring a license and fee under this ordinance, the single location shall not be required to obtain a license. (b) For a business operating more than one packaged food outlet, the annual license fee shall be $115.00 for the entire business. (6) Potentially Hazardous Food Vehicles. The annual license fee for each potentially hazardous food vehicle shall be $55.00 per vehicle for such vehicles not licensed under Section 13-803(7), fleet vehicles. (7) Potentially Hazardous Food Vehicles - Fleet License. The annual license fee for a fleet of one or more potentially hazardous food vehicles shall be $195.00. (8) Bakery Food Vehicle License Fee. The annual license fee for each bakery food vehicle shall be $55.00 per bakery food vehicle. (9) Catering Food Vehicle License Fee. The annual license fee for catering food vehicles shall be $195.00 for each vehicle owned or operated by the licensee in the City of St. Louis Park. "Garbage Collection" 7 Section 13-1004. License Fee and Term. The annual fee for such collector's license shall be $135.00 for the first truck and $35.00 for each additional truck and all such licenses shall expire on December 31 of each year. "Scavengers" Section 13-1023. License Fee. The annual fee for such license shall be $60.00. "Pools, Steam Baths" Section 13-1103. License Fees. (1) The license fee for a public swimming pool(s) operating on a year-round basis shall be $210.00 for all such facilities at each locationl. (2) The license fee for a public swimming pool(s) operating on a seasonal basis shall be $140.00 for all such facilities at each location. Section 13-1132. License Fees. (1) Steam Bath, Heat Bathing Room and Suntannina Room. The annual license fee for a public steam bath(s), a public heat bathing room(s) and/or public suntanning room(s) shall be $60.00 for all such public facilities at each location. (2) Public Portable Rest Rooms. The annual license fee for each person required to be licensed under Section 13- 1131(2) shall be $15.00 per location, or upon payment of a fee of $85.00 annually, an appli- cant can receive a license to operate an unlimited number of portable rest rooms. "Gasoline Station" Section 13-933. License Fee. The annual license fee shall be: (1) $205.00 for each gasoline service station, plus $15.00 for the second and each additional fuel dispensing hose. (2) $70.00 for each private fuel outlet, plus $15.00 for the second and each additional fuel dis- pensing hose. "Anetseay Estate, Residential Sales" Section 13-1325. Definitions. As used in this ordinance, the following words have the meanings indicated: (1) Residential sale or "garage sale" shall mean any sale conducted as a residential premises where the property sold consists only of items owned by the owner or renter of the premises at which the sale takes place or by friends of such owner or renter, and where the sale is conducted by the owner of the premises or friends, not by an agent or any other person to whom a commission or fee is paid. Section 13-1329.101. Residential or Garage Sales Restrictions. No residential premises shall be used for a residential sale or a garage sale for more than two (2) periods of seventy-two (72) consecutive hours in any calendar year. None of the items offered for sale shall have been bought for resale or received on consignment for purposes of resale. "peddler, Solicitor or Transient Merchant" Section 13-1334. Annual Registration Fee. At the time of submitting information as required by Section 13-1333 and annually on or before each January 1 thereafter, as long as he engagtes in activities_ which require him to submit information under Section 13-1333, the peddler, solicitor or transient merchant shall also pay, unless constitutionally exempted, a registration fee of $40.00 provided that any charitable, benevolent, philanthropic, patriotic, religious, social service, welfare, educational or eleemosynary organization not be required to pay the registration fee. °"Christmas Trees1, Section 13-1342. License Fee. The annual fee for such license shall be $70.00. "Taxidermy" Section 13-1404. License Fee. The annual license fee for the business of taxidermy shall be $140.00 for each business location. "Hotels, Motels, Lodging and Boarding Houses" Section 13-1482. Required License Fees. The annual license fee for hotels, lodging houses and boarding houses shall be as follows: (1) Hotels (and motels) 1-50 rooms $175.00 Plus 51 rooms and over (per room) $ 1.75 (2) Lodging House per location $ 70.00 (3) Boarding House per location $ 70.00 If a boarding house is required to have a food establishment license, the boarding house license fee shall be 1/2 of the required fee under this Section. "Conduct of Temporary Outdoor Retail Sales" Section 13-1502. License Fee. The license fee shall be $70.00 for each day for which the license is issued. "Building Demolition" Section 15-211.102(2) (2) Building Demolition Permit Fees. A permit fee to demolish any building shall be calculated according to the current fee schedule used for plumbing, electrical and mechanical permit fees. "Certificate of Occupancy" Section 15-212.102. Certificate of Occupancy, Occupancy Change Inspection Fee. The occupancy inspection fee for changes in occupancy or ownership as required in Section 15-212.101 (except for licensed apartment buildings) shall be $65.00 for floor areas of 3,000 or less square feet; the fee shall be $130.00 for floor areas of more than 3,000 square feet. The fee for change in occupancy of land without a structure shall be $50.00. Section 15-212.103. Temporary Structures. No person shall 7 i erect, install or place a temporary structure within the City of St. Louis Park without first having obtained a permit from the City. A temporary structrure includes, but is not limited to, a tent other than an accessory to a single-family dwelling or a sales office. The permit fee for a temporary structrure shall be $75.00 for each location. Such permit shall contain an expiration date at which time the structure shall be removed. The duration period for any temporary permit as described shall not exceed six (6) consecutive months. The City may renew such cpermits upon reapplication to the Department of Inspectional Services and upon payment of the required temporary structure permit fee. eoPoolsoo Section 15-215. Construction Fee - Certain Swimming Pools. Any above -grade prefabricated, private residential swimming pool holding less than 5,000 gallons shall require a construction permit amounting to a total fee of $45.00 which includes the plan -checking fee of $15.00. "Cesspools" Section 15-243. Cesspools, Septic Tanks and Drain Fields. The fee for individual systems, including cesspools, septic tanks and drain fields, regardless of the size or number in the system, shall be: Residential system Commercial/industrial system "Apartments" $35.00 $60.00 Section 15-348. Schedule of Fees. At the time of application for the license or for license renewal required by this Section, the City shall collect the appropriate license fee and inspection fee in accordance with the following schedule. The calculation of the fees for any number of buildings using the below -listed schedule shall be based on one or more abutting buildings on a single, contiguous tract of land or on one or more abutting tracts of land: Multi -Family Apartment Dwelling Units: LICENSE FEE 1 or 2 buildings 3 to 9 buildings 10+ buildings Plus $35.00 $70.00 $140.00 INSPECTION FEE 3 to 5 units 6 to 10 units 11 to 20 units 21 to 40 units 41 to 100 units 101 to 200 units 200+ units $7.00 per unit $6.50 per unit $6.00 per unit $5.50 per unit $5.00 per unit $4.00 per unit $3.50 per unit "Trailers" Section 15-352. Application and Issuance of Permit. Any person or persons desiring to occupy a trailer within the corporate limits of the City of St. Louis Park for habitation or living purposes for a period of more than ten (10) days shall make application to the City Clerk for a permit as herein required, which application shall state the number of persons residing in such trailer, the address of his or their usual or permanent place of abode, the length of time the applicant intends to continue to live in such trailer and such other information as the City Manager or City Clerk may require. Such application shall also be accompanied by an inspection fee of fifteen dollars ($15.00) to be paid the City Treasurer, and by a statement in writing from the owner of the premises on which such trailer is located, authorizing the location of same on such premises for living purposes. Such application shall be referred to the City Health Authority, who shall determine and report to the City Manager whether the occupants of said trailer have made suitable and safe arrangements for water supply and sanitary conveniences. Such permit may be denied or granted by the City Manager after due consideration of the right of the applicants to occupy the premises whereon the trailer is located and considerations of public health and safety. Permits shall be granted for not more than one year or for such period of less than one year as the City Manager may designate. Renewal permits may be granted on application and if the City Manager shall deem it necessary to require inspection by the Health Office, renewal permit fee of $5.00 may be required before granting such a permit. "Building Moven Section 15-502(3) (3) Fee. The applicant shall be accompanied by the following permit fees: (a) A building which is a detached accessory structure including garages and storage sheds not exceeding 750 square feet shall pay a permit fee of $50.00. 10 (b) For all other buildings including family dwellings, the permit fee shall be $100.00 for moves into the City or moves within the City from one location to another location; $60.00 for moves out of the City; and $25.00 for transportation of a building through the City. Section 3. Effective date. This ordinance shall take effect 15 days after its publication.
