ORDINANCE NO. 1847-91
AN ORDINANCE VACATING A PORTION OF THE UTILITY EASEMENT
ON LOT 26, BLOCK 3, SUBURBAN HOMES CO.'S ADDITION
(4043 YOSEMITE AVENUE SOUTH)
THE CITY OF ST. LOUIS PARK DOES ORDAIN:

Section 1. Due to the presence of a garage serving the residence of Lot
26, Block 3, Suburban Homes Co.'s Addition (4043 Yosemite - "Property") within
a public utility easement, there exists a property title defect which has
rendered the Property unmarketable. As a result, the owner of the Property
has petitioned the City to vacate that portion of the utility easement upon
which the garage is located, and the City has determined that the narrowing of
the easement in the vicinity of garage will not adversely affect the
maintenance of the municipal storm sewer located within the remainder of the
easement. In consideration for the narrowing of the easement, the Property
owner has dedicated a utility easement to the City over the northerly four
feet of the southerly twenty feet of the easterly 25 feet of the westerly 61.5
feet of said Property.
Section 2. Said vacation petition has been duly filed with the City
Clerk, and the City Council has conducted a public hearing upon said vacation
petition and determined that the portion of the public utility easement
described below is not needed for public purposes, and that it is for the best
interest of the public that said public utility easement be vacated.
Section 3. The following described portion of a public utility
easement, as now dedicated and laid out within the corporate limits of the
City of St. Louis Park is vacated:
The northerly 10 feet of the southerly 16 feet of the westerly
26.5 feet of the easterly 64.5 feet of Lot 26, Block 3, Suburban
Homes Co.'s Addition
Section 4. The City Clerk is instructed to record certified copies of
this ordinance in the Office of the Hennepin County Register of Deeds or
Registrar of Titles as the case may be.
Section 5. This ordinance shall take effect fifteen days after its
publication.
