HomeMy WebLinkAbout1831-90 - ADMIN Ordinance - City Council - 1990/06/18ORDINANCE No. 1831-90 CHAPTER 2: IEGISIATIVE BODY PART 1 - Council meetings Section 2-101. Regular Meetings. (1) Time. Regular meetings of the City Council shall be held on the first and third Mondays of each calendar month at 7:30 p.m. Any regular meeting falling on a legal holiday shall be held on the next business day at the same time and place. By vote of its members, the Council may cancel any regular meeting provided that at least one regular meeting is held in each month. All business set for consideration at a meeting which is canceled shall be deemed adjourned to the next succeeding regular meeting. (2) Place. All regular meetings of the Council shall be held in the City Hall of the City unless the Council decides otherwise at a prior meeting or a meeting in City Hall is impossible. Section 2-102. Special Meetings. The Mayor or any three (3) members of the Council may call special meetings of the Council upon at least 12 hours' notice to each member of the Council. Such notice shall be delivered personally to each member or left at the member's usual place of residence with a responsible person, or left in a conspicuous place at the residence if no such person is found there. The presence of any member of the Council at a special meeting shall constitute a waiver of any formal notice unless the member appears for the special purpose of objecting to the holding -of -such ting. Notice #o -tie -pubis shall be given in accordance with State Statute 471.705 subd. lc (b) or therein after as -amended. Section 2-103. Public Meetings. All Council meetings, including special and adjourned meetings and meetings of Council committees, shall be conducted in accordance with the Minnesota Open Meeting Law. Section 2-104. Agenda. PeLitiun�, bests • -anc_1 addressed to the Council shall be presented to the Council unless, in the opinion of the City Manager, or by law and not objected to by the petitioner, they require an_ administrative or advisory commission report prior to presentation to the Council. The petition and related report shall be placed on a Council agenda within a reasonable period of time. A list of such petitions so withheld from each agenda showing date received and information relative to source and nature of required report, shall be transmitted to the Council along with each agenda. The City Manager shall appropriately advise each petitioner that his petition is being held for later submission to the Council along with the required report, and the date of the Council meeting at which the petition and report will be considered by the Council. At the first Council meeting in each month, the City Manager shall submit to the Council a cumulative listing of petitions awaiting report. All reports, communications, ordinances, resolutions, contract documents or other matters to be submitted to the Council shall, before Monday noon of the week prior to each Council meeting, be delivered to the City Manager who shall immediately arrange a list of such matters according to the order of business and furnish each member of the Council and the City Attorney a copy of the same prior to the Council meeting as far in advance of the meeting as time for preparation will permit. No matters shall be presented to the Council by administrative officials except with approval of the City Manager. Any business brought before the Council, including hearings and matters adjourned or referred to a specified meeting and not disposed of by motion or resolution or postponed by formal action entered in the minutes to a definite date, shall be deemed indefinitely tabled and may be acted upon at any subsequent meeting held within the same calendar year. Section 2-105. The Presiding Officer. The Mayor shall be the presiding officer of the Council. In the absence or disability of the Mayor, the Mayor pro tem shall be elected by the City Council at the first regular meeting in January of each year to hold office at the pleasure of the Oxncil. The presiding officer shall vote as a member of the Council. The presiding officer shall vote an all questions, the name of the presiding officer being called last. The presiding officer shall sign all ordinances and resolutions adopted by the Council. In the case of absence or disability of the Mayor and the Mayor pro tem, the secretary shall call the meeting to order and shall preside until the City Council members present choose a member to act temporarily as presiding officer. The secretary shall call the Council to order, whereupon a -temporary presiding officer- shall be elected by the members of the Council present. Upon the arrival of the Mayor or Mayor pro tem, the temporary presiding officer shall immediately relinquish the chair upon the conclusion of the business immediately before the Council. Section 2-106. Roll call. Before proceeding with the business of the Council, the secretary of the Council shall call the roll of the members, and the names of those present shall be entered in the m notes . Section 2-107. Quorum. A majority of all the members elected to the Council shall constitute a-quonun to do business, but a lesser number may adjourn from time to time. In the absence of a quorum, the presiding officer may compel the attendance of absent members. Section 2-108. Order of Business. Each meeting of the Council shall convene at the time and place appointed therefor. The Council members, the secretary of the Council, the City Manager and City Attorney shall take their regular stations in the 2 Council Chambers and the business of the Council shall be conducted in the following order: 1. Call to order 2. Presentations 3. Roll call 4. Approval of minutes 5. Approval of agenda 6. Public Hearings 7. Petitions, Requests, Communications 8. Resolutions and Ordinances 9. Reports from Officers, Boards, Committees 10. Unfinished Business 11. New Business 12. Miscellaneous 11. Claims, Appropriations, Contract Payments 14. Adjournment Unless objection is made by motion of the Council, the presiding officer may modify the foregoing order of business in order to accommodate citizens present or to expedite the business of the Council. Section 2-109. Reading of Minutes. The minutes of the Council meeting need not be read aloud unless it is so rested by a Council member. Such minutes may be approved without reading if the secretary has previously furnished each member with a copy thereof. The presiding officer shall call for any additions or corrections. If there is no objection to a proposed addition or correction, it may be made without a vote of the Council. If there is an objection, -the-Council shall-vote-on-the-addition—or correction. Section 2-110. General Rules of Order. The proceedings of the City Council shall be conducted in accordance with Roberts Rules of Order, Newly Revised. Failure to comply with said rules shall not invalidate Council action unless at the time the action is taken or promptly thereafter a member of the Council or any person interested in the subject in question shall object to the method of procedure and point out to the Council the particular rule which it is claimed was not observed. Section 2-111. Consent Agenda. The Council shall determine which items shall be placed on the consent agenda based on the policy resolution adopted by the City Council. The consent agenda shall contain routine, administrative items in matters where Council has previous formulated policy. The consent agenda shall not be used in exercising legislative power. The Mayor shall notify the public at the Council meeting that approval of the consent agenda is under consideration and explain how the consent items are identified on the agenda. Any Council member or citizen may request that a consent agenda item be removed and be placed on the regular agenda for diGcnscion. Items on the consent agenda are not subject to discussion unless so removed. Any request for removal of an item from the consent agenda will be honored. The entire consent agenda shall be unanimously approved by one motion. The Council Secretary shall include in the minutes the numerical vote for each consent agenda item. Section 2-112. Motions and Resolutions. Motions shall be set down in writing by the secretary in the minutes. Resolutions shall be in writing when presented to the City Council for vote and shall be preserved by the City Clerk, indexed as to meeting dates unless copied in full in the minutes. Section 2-113. Rules of Debate. (1) Presiding Officer May Debate and Vote, etc. The presiding officer may debate fluid the chair, subject to such limitations of debate as are by these rules imposed on all members and shall not be deprived of any of the rights and privileges of a Council member by reason of acting as presiding officer. (2) Getting the Floor - Improper References to be Avoided. Every member desiring to speak shall address the presiding officer and upon recognition by the presiding officer, shall confine remarks to the question under debate avoiding all personalities and indecorous language. (3) Interruptions. A member once recognized shall not be interrupted when speaking unless to call the member to order or as herein otherwise --provided. If -a --ember, while spear_is called to order, the member shall cease speaking until the question of order is determined by the presiding officer and, if in order, shall be permitted to proceed. (4) Motion to Reconsider. A motion to reconsider any action taken by the Coanncil may be made at the meeting at which such action was taken. It may be made either immediately during the sae session or at a recessed or adjourned session thereof. Such motion must be made by one of the prevailing side, but may be seconded by any member and may be made at any time and have precedence over all other motions or while a member has the 4 7 P floor; it shall be debatable. A motion for reconsideration requires only a majority vote regardless of the vote necessary to adopt the motion reconsidered. Nothing herein shall be construed to prevent any member of the Council from making or remaking the same or any other motion at a subsequent meeting of the Council. (5) Remarks of Councilmember - When Entered in Minutes. A Councilmember may request, through the presiding officer, the privilege of having an abstract on any subject under consideration by the Council, or the reason for dissent from any action of the Council, entered in the minutes. Unless the Council by motion objects thereto, such statement shall be entered in the minutes. (6) Synopsis of Debate - When Entered in Minutes. The secretary may be directed by the presiding officer, with consent of the Council, to enter in the minutes a synopsis of the discussion on any question coming before the Council. Section 2-114. Addressing the Council. Any person desiring to address the Council shall first seek to be recognized in a decorous manner and secure the permission of the presiding officer to do so. Section 2-115. Manner of Addressing Council - Time Limit. Each person addressing the Council shall, if requested by the presiding officer, step up in front of the rail, shall state their name and address for the records, and unless further time is granted by the presiding officer, shall limit the address to five minutes except at public hearings when the limit shall be ten minutes. All remarks should be addressed to the Council as a body and not to any nember thereof. No person, other than the Council and the person having the floor, shall be permitted to enter into any discussion either directly or through a member of the Council without -the -permission of the presiding -officer. No question shall be asked a Counci i med er except through the presiding officer. Section 2-116. Silence Constitutes Affirmative Vote. Unless a member of the Council states they are not voting, silence shall be recorded as an affirmative vote. Section 2-117. Decorum. (1) By Council Member. While the Council is in session, the members shall preserve order and decorum, and a member shall neither by conversation or otherwise, delay or interrupt the proceedings or the peace of the Council nor disturb any member while speaking or refuse to obey the orders of the Council or its presiding officer except as otherwise herein provided. 2) By Other Person. Any person making personal, impertinent or slanderous remarks or who shall become boisterous while addressing the council shall be forthwith, by the presiding officer, barred from further audience before the Council unless permission to continue is granted by a majority vote of the Council. Section 2-118. Enforcement of Decorum. The Chief of Police or designate shall be Sergeant -at -Arms of the Council meetings. They shall carry out all lawful orders and instructions given by the presiding officer for the purpose of maintaining order and decorum at the Council meeting. Upon instructions of the presiding officer, it shall be the duty of the Sergeant -at -Arms to place under arrest any persons who violate the order and decorum of the meeting and cause them to be prosecuted under the provisions of this Code, the complaint to be signed by the presiding officer. Section 2-119. Person Authorized to be Within Rail. No person, except City officials, their representatives and newspaper reporters, shall be permitted within the rail in front of the Council Chamber without the express consent of the Council. Section 2-120 Special Committees. All special committees shall be appointed by the presiding officer when directed by the City Council. Section 2-121. Adjournment. A motion to adjourn shall always be in order but shall be subject to debate.
