LOUIS PARK MUNICIPAL CODE SECTIONS 13-1350 THROUGH 13-1354, REGULATING THE SALE OF CIGARETTES. The City of St. Louis Park, does ordain: Section I FINDINGS The City Council of the City of St. Louis Park Finds the following: Whereas, Smoking is detrimental to the present and long-term health of persons who smoke; and Whereas, Numerous studies show that cigarettes are a major contributor to both short and long-term health damage; and Whereas, Recent studies show that cigarette smokers start smoking at an average age of fourteen (14) and under; and Whereas, Recent studies show that minors have easy access to cigarettes through cigarette vending machines; and Whereas, Recent studies show that cigarette vending machines are the medium of choice for minor smokers under the age of seventeen (17). Now, Therefore, the City council, of the City of St. Louis Park does Ordain the following: Section 13-1350. Cigarettes over the counter: License Required. No person, shall sell any cigarette, package of cigarettes, retail carton of cigarettes or otherwise dispense any cigarette or cigarette wrapper at any place within the City of St. Louis Park without obtaining a license issued by the City for said practice. Section 13-1351. Cigarettes over the counter: Application and Issuance. Application for such license shall be made to the City Clerk on a form provided by the city. The applicant must state its full and true name and address, the location of the building the kind of business conducted at such location and any other information as shall be required by the application and/or the City Clerk. Section 13-1352 License Fee. The annual fee for every such license shall be $15. The fee for a license issued which shall be valid after June 30 and until December 31 of a single year shall be $7.50. Section 13-1353. Over the Counter Sales: Restrictions: a. No person shall sell, allow the sale of, or give away any cigarette or cigarette wrapper to any person under the age of eighteen (18). b. The use of vending machines and/or any other such automatic type devices is prohibited in the sale and/or distribution of cigarettes or cigarette wrappers at any location within the corporate limits of the City of St. Louis Park. c. No person shall keep for sale, sell, allow the sale of, give away, or dispose of any cigarette containing opium, morphine, jimson weed, belladonna stychnia, cocaine, marijuana, or any other deleterious or poisonous drug except nicotine. d. No license shall be issued to an applicant for sale of cigarettes at any place other than the applicants established place of business. No license shall be issued for the sale of cigarettes at a movable place of business; nor shall any license be issued for the sale of cigarettes at more than one place of business. Section 13-1354. Cigarettes: Penalties. a. Anyone found to be selling or allowing the sale of cigarettes or cigarette wrappers within the City without a license shall be guilty of a misdemeanor. b. Any establishment licensed under Section 13-1350 of this code which is in violation of Section 13-1353 shall be guilty of a Gross Misdemeanor and said license shall be revoked. Section VI. Effective Date. This ordinance shall take effect March 1, 1990. Adopted by the City Counc,1 February 5, 1990.
