LOUIS PARK ORDINANCE CODE BY AMENDING AND ADDING REQUIREMENTS FOR THE LICENSING OF PLUMBERS, GAS, HEATING, COOLING AND VENTILATING TRADES BY AMENDING SECTIONS 13-210, 13-211, 13-212, 13-220, 13-230, 13-231 AND ADDING SECTIONS 13-210.101, 13-210.102, 13-212.101, 13-212.102, 13,213, 13-222, 13-222.101, AND 13-222.102. THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. Section 13-210 is amended as follows: Section 13-210. License Required. No person shall repair, alter, or install any gas piping or gas burning devices or engage in the business of repairing, altering or installing such devices, within the corporate limits of the City of St. Louis Park, without first having secured a license from the City Manager. Such licenses shall be known as Gas Fitter's Licenses, and shall be of two classes, including Class A and Class B. Section 2. A new Section 13-210.101 is added as follows: Section 13-210.101. Scope of Class A Licenses. A Class A Gas Fitter's License shall entitle the holder to engage in all types and areas of installation, altering, repairing and servicing gas pipe, gas equipment, gas venting and gas burners as herein defined, and for the purpose of this section the following terms shall mean: (1) Gas shall include all natural and liquid fed petroleum (LP) whether it is liquid or gaseous state. (2) Gas burner shall be a device for the final conveyance of gas, or a mixture of gas and--air,-to-the--combustion zone of a boiler or furnace used in connection with a heating system. (3) A power burner shall be a device in which gas or air or both are supplied at a pressure exceeding the house line pressure for gas and atmospheric pressure for air. (4) Gas equipment shall include all valves, regulators, tanks, and appurtenances used in connection with gas as defined above. Section 3. Section 13-210.102 is added as follows: Section 13-210.102. Scope of Class B License. A Class B Gas Fitter's License shall entitle the holder to engage in all gas fitting as covered by a Class A License, as above set forth, except: (1) The installing, altering, repairing and servicing of gas burners and power burners for environmental heat as defined above. (2) Gas equipment as relates to gas burners and power burners for environmental heat as defined above. - 2 - Section 4. Section 13-211 is amended as follows: Section 13-211. Application. The application for such a license shall state the name and address of the person desiring such a license or their place of business and such additional information as the City shall require. Section 5. Section 13-312 is amended as follows: Section 13-212. Qualifications of Applicants. Each person, firm or corporation desiring to engage in, or carry on, the business as mentioned above shall be well qualified to do so. Qualified shall mean that a principal person of each firm, partnership or corporation shall have a Master's Certificate of Competence issued by the Director of Department of Inspections or by a person so designated by the Director. The Certificate of Competence must be of the type corresponding to the type of license being applied for. The holder of the Master's Certificate of Competence shall be active in the day to day management of the firm, partnership or corporation. Section 6. A new Section 13-212.101 is added as follows: Section 13-212.101. Types of Certificates of Competence. Master Class A Gas Fitter Class B Gas Fitter Journeyman Gas Fitter Each individual applicant for a Certificate of Competence shall be qualified by education and/or experience and shall pass a written examination. The written examination shall be administered by the Director of Inspections or the Director's authorized representatives. The Director may waive the examination if the applicant has a current cerificate of type being applied for from a city with equal requirements. The Certificate shall expire on the 31st day of December of each year. The holder of the certificate may renew the certificate for the next year without re- examination. The Director of Inspectional Services may require re- examination at 5 year intervals; notwithstanding the fact that the individual holds a valid Certificate of Competence, from another jurisdiction. Section 7. Section 13-212.102 is added as follows: Section 13-212.102. Fee for Examination and Certificate of Competence. The fee for the examination for a Certificate of Competence shall be $25.00 per examination. The fee for issuance of each Certificate of Competence shall be $5.00. 1 1 - 3 - Section 8. A new Section 13-213 is added as follows: Section 13-213 Journeyman Gas Fitters. No person shall work at or engage in the occupation of any or all branches of gas fitting as set forth in Section 123-210.101 of this ordinance without first making proper application for and having issued to them a Journeyman Gas Fitter's Certificate of Competence. Said Journeyman Gas Fitter shall be in the employment of a duly licensed business as set forth in Section 13-210 of this ordinance when engaging in or working at the occupation of gas fitting. No provision of this section shall be interpreted to prevent a holder of a Master Gas Fitter's Certificate of Competence from working as a Journeyman. Section 9. Section 13-220 is amended as follows: Section 13-220 License Required. No person shall install, alter or repair any heating, ventilating, refrigeration or air conditioning system in the corporate limits of the City of St. Louis Park, or engage in the business of so doing in said City without first having obtained a license from the City Manager authorizing him to do so. Said License shall be divided into the following types: Type I. Dry Heat, Ventilation, Air Conditioning and Refrigeration. Refrigeration shall not exceed 5 tons rated capacity per system and said system shall be for human comfort only. Type II. Wet Heat and Chilled Water Systems. Wet heat shall include all hot water, steam of 15 psi gauge or less and chilled water systems. These requirements shall apply to all types of usage including but not limited to systems for human comfort. Type III. Refrigeration. 4. Refrigeration shall include systems of any type or usage except that which is included id Type I. Section 10. Section 13-222 is added as follows: Section 13-222. Qualifications -.of Applicants. Section 13-230 is amended as follows: Section 13-230. License Required. No person shall engage in the business of plumbing, or construct, extend, alter or repair any plumbing work, house drain, sanitary sewer and storm sewer systems or the water supply system of the City of St. Louis Park, without first obtaining _a _l icens-e -from -the City Manager to do so. No license shall be granted to any person not having a valid Master's Plumber License from the State of Minnesota nor to any plumbing company, firm or corportion not having within its employment a plumber possessing a Master's Plumber License from the State of Minnesota. The holder of the Master's Plumbers License shall be active in the day to day management of the firm, partnership or corporation. Proof of a Master's Plumber License shall be provided with the initial application and each renewal application. 1 1 1 -5 - Section 14. Section 13-231 is amended as follows: Section 13-231. Application The application for such license shall state the name of the applicant, the place where the business to be licensed is to be carried on, and such other information as the City Manager shall require. Section 15. Penalty. Any person violating the provisions this ordinance shall be guilty of a misdemeanor and upon conviction shall be punished in accordance with Section 2-203 of the St. Louis Park Municipal Code. Section 16. Effective Date. This ordinance shall take effect 15 days after its publication.
