ORDINANCE NO. 1305-89
An ordinance amending the St. Louis Park Municipal Code relating to the
operation of a Cable Communications System in St. Louis Park adding Section
9-715(4), "Institutional Network".
The City of St. Louis Park does ordain:
Section 1.
The St. Louis Park Municipal Code, Section 9-715 is hereby amended by
the addition of 9-715(4) to read:
(4) Institutional Network Plan. Company shall construct, operate, and
maintain a separate Institutional Network. In constructing the InstitUtional
Network, it is the company's intent to utilize portions of the existing trunk
plant together with the construction of additional trunk plant, if needed.
(a) ,'Channel Capacity/Frequency Bandwidth. The separate
Institutional,Network will utilize a "high - split" (18 upstream and•37
downstream 6 MHz CATV channels) as was determined by the St. Louis Park
Institutional Network Committee.
(b) Coverage. The separate Institutional Network will pass the
institutions listed on Exhibit C-1.
(c) Completion/Time for Construction. Construction and
activation of the separate Institutional Network shall be completed no later
than six (6) months after completion of construction and activation of the
Subscriber Network.
(d) Equipment Provided. For the duration of the franchise,
Company shall make available, as required, modulators, demodulators,
associated head -end equipment, and encoders costing Company no more than
$50,000 for users of the Institutional Network.
(e). Service Provided. Company shall make available one free
drop of the Subscriber Network to institutions listed on Exhibit C. Also,
Company shall make available one.free drop of the Institutional Network to
institutions listed on Exhibit C-1. Company shall provide, at no charge,
basic (service to institutions listed on Exhibit C. Company shall provide, at
no charge and upon City's request, up to 40 standard non -addressable
converters to City or City's designees. To the extent any of the signals
transmitted to or from any of the institutions listed on Exhibit C are
scrambled, Company shall provide up to 20 addressable converters upon the
City's request.
(f) Proposed Use. At the time of activation of the
Institutional Network, the following institutions from the list on Exhibit C-1
shall,, as part of the $50,000 listed under 4(d), be equipped by Company to
function as points of origination: Park Senior High School, City Hall, St.
Louis Park Recreation Center, and Westwood Hills Environmental Education
Center. Company shall install equipment necessary to send signals from the
St. Louis Park High School athletic field located near the intersection of
Lake Street and Dakota Avenue and from Lenox Community Center to the Park
Senior High School and from the Park Senior High School to make connection to
the Subscriber Network.
At the time of activation of the Institutional Network, or by
September 1, 1991, whichever is later, one classroom to be determined by the
City, upon recommendation of School District 283, at the St. Louis Park Senior
High School and one classroom to be determined by the City, upon
recommendation of School District 283, at the St. Louis Park Junior High
School may be fully interactive, and may utilize a two way communication
system. Company shall construct the I -Net so as to provide for this
interactive function between the St. Louis Park Senior High School and the St.
Louis Park Junior High School.
At the end of two (2) years from the date of activation of the
Institutional Network, an evaluation shall be made of the Institutional
Network. Proposed future uses of the Institutional Network may include: On
September 1, 1993, Company may, as part of the $50,000 listed under.4(d),
equip one classroom at Aquila Primary Center, one classroom at Peter Hobart
Primary Center, one classroom at Susan Lindgren Intermediate Center, one
classroom at Cedar Manor Intermediate Center, and one classroom at any new,,
renamed, or reactivated primary centers, intermediate centers, junior high
schools, or senior high'schools in St. Louis Park School District 283 for a
two-way interactive communication system. In addition, future uses may
include any use as determined by the City.
.During the renegotiation of the Cable Communications Franchise
Ordinance in year five (5), an evaluation shall be made of the Institutional
Network. Proposed future uses of the Institutional Network may include a
reassignment of equipment or the equipping of sites listed on Exhibit C-1, or
any City or School District building for interactive, two-way communications
system or other uses as determined by the City.
Section 2. Effective Date. This Ordinance shall take effect 15 days
after its publication.
