ORDINANCE NO. 1800-89
AN ORDINANCE RELATED TO LAWFUL GAMBLING, AMENDING THE ST. LOUIS
PARK MUNICIPAL CODE, SECTIONS 13-1600(1, 2, 3); ADDING NEW SECTIONS
13-1600(2a, 2b, 3c); DELETING FORMER SECTIONS 13-1600(2b & 2c); RE-
NUMBERING FORMER SECTION 13-1600(3c) to 13-1600(3d)
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Sec. 1. The St. Louis Park Municipal Code is hereby amended to read
as attached:
LAWFUL GAMBLING AND VIDEO GAMES OF CHANCE
Section 13-1600. "Lawful gambling" is the operation, conduct or sale of
bingo, raffles, paddlewheels, tipboards and pulltabs. "Organization" means
any fraternal, religious, veterans or other nonprofit organization.
(1) State License Required for Lawful Gambling. Minnesota Statutes,
Section 349, provides for the regulation and licensing of lawful
gambling by the State Gambling Control Board ("Gambling Board").
The Gambling Board may issue licenses to organizations to conduct
lawful gambling if the organization has been in existence for at
least 3 years, has at least 15 active members, and complies with
Minnesota Statutes, Section 349. All license applications shall be
on a form prescribed and procured from the Gambling Board.
(2) Local Approval. Before issuing or renewing an organization license,
the Gambling Board must notify the City Council. If the City
Council adopts a resolution disapproving the license and so informs
the Gambling Board within 60 days of receiving notice, the license
may not be issued or renewed.
(a) Bingo Occasions. Not more than 6 bingo occasions each
week may be conducted by an organization. At least 15
bingo games must be held at each occasion and 'a bingo
occasion must continue for at least 1.5 hours but not more
than 4 consecutive hours.
(b) Bingo on Leased Premises. A person or corporation, other
than an organization, which leases any premises that it
owns to 2 or more organizations for purposes including the
conduct of bingo, may not allow more than 18 bingo occasions
to be conducted on the premises in any week. The license
application and other requirements shall\be prescribed by
the Gambling Board and applicable City ordinances.
(3) Exemptions from the lawful gambling requirements:
(a) Bingo may be conducted without a license if it is conducted
in connection with a civic celebration and if it is not
conducted for more than 12 consecutive days in a calendar
year.

(b) Bingo may be conducted without a license if it is con-
ducted by an organization which conducts 4 or fewer
bingo occasions in a calendar year.
(c) Bingo may be conducted without a license within a nursing
home, senior citizen housing project or by a senior citizen
organization if the prizes for a single game do not
exceed $10, total prizes awarded at a single occasion do
not exceed $200, no more than 2 occasions are held by the
organization or at the facility each week, only members of
the organization or residents of the home or housing
project are allowed to play, no compensation is paid for
any persons conducting the bingo, and a manager is appointed
who must first register with the Gambling Board.
(d) Raffle may be conducted without a license if it is conducted
by an organization and if the value of all raffle prizes
awarded by the organization in a calendar year does not exceed
$750; or if the raffle is conducted by a tax-exempt health or
social service organization under contract to the state or a
political subdivision if the prizes awarded are real or
personal property donated by an individual, firm or other
organization.
(e) Lawful gambling may be conducted without a license if the
organization conducts gambling on 5 or fewer days in a
calendar year, does not award more than $50,000 in prizes in a
calendar year, receives City Council approval, and receives an
exemption from the Gambling Board.
(4) Penalty. Violation of the provisions of this section constitutes a
gross misdemeanor. This section does not preclude civil and criminal
actions under other applicable laws.
Sec. 2. Effective Date. This ordinance shall take effect 15 days
following its publication.
