AN ORDINANCE AMENDING SECTIO t 1-101 THROUGH SECTION 1-212
OF THE ST. LOUIS PARK MUNICIPAL CODE
Section 1. The St. Louis Park Municipal Code is amended to read as attached.
Chapter 1: Administration
Part 1 - General Structure
Section 1-101. City Manager. The City Manager is the chief administrative
officer of the City and shall be responsible for the proper administration of
all affairs relating to the City.The City Manager also serves as the F cecutive
Director of the Economic Development Authority and shall be responsible for the
proper administration and all affairs related to economic development in the
City. The City Manager shall have the authorities, duties and responsibilities
conferred by State laws, the City Charter and by City Ordinances not
inconsistent with the City Charter or State laws.
Section 1-102. Departmental Organization. The administrative services of the
City shall be divided into the following departments, divisions, offices and
heads thereof and said departments, divisions, offices and positions are hereby
established:

The City Manager may assign the same person to head two or more departments or
to head a division within a department. The person so designated shall perforin
such additional duties as may be assigned by the Manager.
The City Manager or designee may perform the administrative duties of any
office or position in the administration under the Manager's control which is
vacant or which lacks administration due to the absence or disability of the
incumbent.
Section 1-103. Bonds. The following named City officials shall each, before
entering upon the duties of their respective offices or employment, provide the
City with a corporate surety bond in soh form as approved by the City Attorney
as security for the faithful performance of their respective official duties
the City and the safekeeping of the public funds. The premium for corporate
surety bonds herein provided for shall be paid by the City. Such bods shall be
provided in the following respective amounts:
City Manager $10,000
City Clerk $25,000
City Treasurer $50,000
With the approval of the City Council, the City Manager may secure a single
corporate surety bond or fidelity insurance coverage on other City employees
and offices in such suras as the City Council shall approve. The premium for
corporate surety bonds hereinbefore provided for shall be paid by the City. All
bonds so furnished shall be filed with the City Clerk.
Section 1-104. General Duties of Officers
(1) Officers. In addition to the elected officers of the City, department and
division heads shall be deemed officers of the City. Each officer shall perform
all duties required of the office by State law, the City Charter, this Code and
ordinances of the City and such other duties not in conflict therewith as may
be required by the City Manager.
(2) Department and Division Heads. The heads of departments, divisions and
offices shall:
(a) Be responsible to the City Manager. Be responsible to the City Manager
for the effective administration of their respective divisions and
departments, divisions and offices and all activities assigned thereto.
(b) Inaugurate Sound Practices. Keep informed as to the latest practices in
their respective fields and shall inaugurate, with the approval of
the City Manager, such rem practices as appear to be of benefit to the
City and to the public.
(c) Report to the City Manager. Subatit regular reports an the activities
of the department, division or office, to the City Manager.
(d) maintain Records. Establish and maintain a system of filing and
indexing records and reports in sufficient detail to furnish all
information necessary for the proper control of department, division or
office activities and to form a basis for periodic reports to the City
Manager.
(e) Authority Over Employees. Have authority, subject to the direction
of the City Manager and ordinances and regulations of the City
Q uracil, to direct and supervise all subordinates in their respective
departments, divisions or offices.
(f) Maintain Equi*nent. Be responsible for the proper maintenance
and control of all City property and equipment used in their respective
departments, divisions or offices.
(3) Departments and Divisions. Each department, division and office shall:
(a) Cooperate with other departments, divisions and offices; furnish any
other department, division or office, upon authorization of the City
Manager, such service, labor and materials as may be requested by the head
of such department, division or office as its own facilities permit,
subject to the same procedures, audit and control as other expenditures are
incurred.
(4) Receipts and Disbursements of Money. All units in the administrative
service shall:
(a) Deposit. Make daily- deposits to the City Treasurer of -any monies
received or as may be otherwise directed by the City Manager.
(b) Payment of Monies. Pay out monies belonging to the City and. incur
obligations on behalf of the City, only in the manner described herein.

Part 2 - Administrative Department
Section 1-201. Department of Finance. Incases where the duty is not
expressly charged to any outer Department, Division or office, it shall be the
duty of the Director of Finance to act to promote, secure and preserve the
financial arra property interests of the City.

(2) Divisions and offices of the Department of Finanoe. The Department of
Finance shall be divided into the following divisions and offices thereof:
(a) Office of the Treasurer. The Treasurer shall be subject to the direction
of the Director of Finance and shall have such duties in connection with
the receipt, disbursement and custody of public funds and other duties and
responsibilities as may be assigned by the Director of Finance and the
provisions of the City Charter.

(b) Accounting and Internal Auditing. The functions of accounting and
internal auditing shall be administered by the Assistant Finance
Director who shall be responsible to the Director of Finance. This office
shall have duties and responsibilities in connection with the accounting,
data -control operations, internal auditing and control services of all City
government activities and other duties as maybe assigned.
All receipts, investments, contracts, payroll, purchases, payments and
billings shall be processed and recorded by and be the
responsibility of this office.
(c) Purchasing. The Assistant Finance Director shall be the Purchasing Agent
under direction of the Finance Director and shall be responsible for all
purchases and contracts of all supplies and contractual services needed by
the City in accordance with procedures outlined in this Code. The City shall
be bound only by contracts made in accordance with the provisions of this
Code or by State statute.
(d) Assessing. The functions -of Assessing shall be by -the
City Assessor who shall be responsible to the Director of Finance. This
division shall have duties and responsibilities in connection with
establishing valuations of all real and personal property for the purpose of
taxation, and shall be responsible for calculation and distribution of costs
for special improvement projects, the acquisition of real estate and
easements and City property management.

Section 1-202. Police Department. The Police Department shall be administered
by the Police Chief .
(1) Duties of the Police Chief. The Police Chief shall be responsible to the
City Manager for the enforcement of all laws of the State of Minnesota, the
City Charter and ordinances of the City and the protection of life and property
from liminal and related activities in the community.
Section 1-203. Fire Department. The Fire Department shall be administered stered by
the Fire Chief.
(1) Duties of the Fire Chief.
Fire. The Fire Department shall be administered by the Fire Chief who shall be
responsible to the City Manager for the protection of life arra property from
the hazards of fire, including suppression and prevention of fire.
Civil Defense. The Coordinator of Civil Defense, appointed by the City
Manager, shall be responsible to the City Manager for planning and
administering the City's Civil Defense and Emergency Preparedness Programs and
other duties as assigned.
Section 1-204. Department of Inspections. The Department of Inspections shall
be administered by the Director of Inspections.
(1) Duties of the Director of Inspections. The Director of Inspections shall be
responsible to the City Manager for the enforcement of State laws and City
ordinances relating to health and sanitation, building construction, zoning and
safety and other duties as may be assigned.
Section 1-205. Department of Public Works. The Division Department of Public
Works shall be administered by the Director of Public Works/City Engineer.
(1) Duties of the Director. The Director of Public Works/City Engineer shall be
responsible to the City Manager for planning, coordination and supervision of
all improvement projects as well as street maintenance and operation of
facilities and equipment within the City.
(2) Divisions of the Department of Public Works. The Department of Public Works
shall be divided into the following divisions:
(a) Engineering. Engineering_services shall be administered by the
Superintendent of EngirmithIgwho shall be responsible to the Director of
Public Works/City Engineer. This office shall be responsible for the
of all
planning, design and inspectionCity-administered public improvement
projects and all public works facilities within the City.
(b) Water and Sewer. Water and Sewer services shall be administered by
the of Utilities Superintendent who shall be responsible to the Director of
Public Works and shall be responsible for the operation, maintenance and
repair of all facilities necessary for the production, storage and
distribution of water to residential, commercial and industrial
establishments within the City. The division shall also be responsible for
the repair and maintenance of sanitary and storm sewer systems, lines and
facilities throughout the City.
(c) Street Maintenance Services. Street Maintenance Services shall be
administered by the of Street Maintenance Services Superintendent whb shall
be responsible to the Director of Public Works and shall be -responsible for
the maintenance of streets, alleys and snag and ice removal.
(d) Central Equipment Maintenance Services. Central Equipment Maintenance
Services shall be administered by the Central Equipment Maintenance Services
Superintendent who shall be responsible to the Director of Public Works and
shall be responsible for the maintenance of all namicipally-o nZed vehicles
and accessory equipment.
(e) Facilities Maintenance Services. Facilities Maintenance Services shall be
administered by the Facilities Mbintenance Services Foreman who shall be
responsible to the Director of Public Works and shall be responsible for
the maintenance and care of public building facilities.
(f) Lighting and Traffic Control. Lighting and Traffic Control shall be
administered by the Lighting and Traffic Control Foreman who shall be
responsible to the Director of Public Works and shall be responsible for
the maintenance and care of all public semaphores, lighting and signage.
Section 1-206. Office of Legal Services. The Office orIegal Services shall be
owed of the City Attorney and City Prosecutor, both of whom shall be
appointed by the City C uracil and shall be responsible to the City Manager for
advising the City C until and administrative staff on questions of law and
review of all ordinances, resolutions, contracts and other legal documents of
the City. This office shall also have the responsibility to represent the City
in court actions, including the prosecution of cases in district courts as
well as defending the City in all litigation.
Section 1-207. Department of Parks and Recreation. The Department of Parks and
Recreation shall be administeradby the Director of Parks and Recreation who
shall be responsible to the City Manager for all matters pertaining to the
planning and administration of public recreation programs and the maintenance
and operation of all public parks, park equipment and park buildings.
(1) Divisions of the Department of Parks and Recreation. The Deparfinent of
Parks and Recreation shall be divided into the following divisions:
(a) Park Maintenance Services. The Division of Park Maintenance Services
shall be administered by the Park Maintenance Superinterxient who shall be
responsible to the Director of Parks and Ration and shall be responsible
for the maintenance of all public parks and open space areas, playgrounds and
equipment, and weed cutting.
(b) Forestry Services. The Division of Forestry Services shall be
administered by the City Forester who shall be responsible to the Park
Maintenance Superintendent. The City Forester shall be responsible for the
City's forestay and reforestation programs.
(c) Recreation Center Services. The Division of Recreation Center Services
shall be administered adMdrizteredby the Recreation Center Operations Supervisor who
shall be responsible to the Director of Parks and Recreation. The Recreation
Center Operations Supervisor shall be responsible for the operation and
maintenance of ice arena, swimming pool and recreational program.
(d) Westwood Hills Environmental Education Center. The Division of Westwood
Hills Environmental Educatict Center shall be administered by the Manages/
Naturalist of Westwood HillsEnvironmental Education Center who shall be
responsible to the Director of Parks and Recreation. The Manager/Naturalist
shall be responsible for the provision of environmental education programs
and the preservation of the wildlife refuge.
(e) Organized Recreation Services. The Division of Organized Recreation
Services shall be administered by the Director of Parks and Recreation who
shall be responsible to the City Manages. The Director of Parks and
Recreation shall be responsible for the developanent and supervision of both
organized and informal recreation programs offered at public park and school
sites throughout the eoammmity.
Section 1-208. Department of Coammmity Development. The Department of Coatmamity
Development shall be administered by the Director of Community Development who
shall be responsible to the City Manager for the administration of zoning and
subdivision ordinances, preparation and review of development plans, evaluation
of information relative to development and implementation of the Comprehensive
Plan. The Director of Community Development shall also provide technical
assistance and staff services to the City Council, Planning C nigsion, Board
of Zoning Appeals, Housing Authority, (including the staff thereof) the
Economic Development Authority and other City advisory boards and commissions
as directed.

Section 1-209. City Clerk's Office. The City Clerk's Office shall be
administered by the City Clerk who shall be responsible to the City Manager, to
administer, oversee and perform records management; issue licenses; process
contracts and bids; process claims and lawsuits; act as liaison between the
City and insurance carriers; codify ord na ces; and manage all elections
assuring conformance with applicable statutes.

Section 1-210. Personnel Office. The Personnel Office shall be administered by
the Personnel Officer who shall be responsible to the City Manager and shall
administer the recruitment and selection of employees, affirmative action, wage
and benefits, employee performance reviews, training and safety programs and
labor contract negotiations arra assuring conformance with federal regulations
and applicable statutes.
Section 1-211. Computer Services Office. The Comnputer Services Office shall be
administered by the Management Information Systems Coordinator who shall be
responsible to the City Manager to administer and be responsible for
coordination of departmental computer applications and to work towards a shared
and integrated information system.
Section 1-212. Indemnification. The City shall indemnify and provide defense
for any employee or officer, whether elective or appointive, against any claims
or suits arising out of an alleged act or omission within the scope of
employment or official duties to the extent requied by law. This obligation is
subject to the liability limitations set forth in Minnesota State Statutes.
The City may obtain insurance to discharge its obligations under this -section,
but these obligations remain in effect whether or not insurance is obtained.
The provisions of this section requiring indemnification do not apply in the
case of malfeasance in office or willful or wanton neglect of duty.
Section 2. Effective date. This ordinance shall take effect 15 days after
summary of publication.
