ORDINANCE NO. 1785-89
AN ORDINANCE DECLARING NO FURTHER PIJBLIC NEED
AND RELEASING A PORTION OF LAND ORIGINALLY CONDEMNED
FOR PUBLIC ROAD PURPOSES

THE CITY OF ST. LOUIS PARK DOES ORDAIN:
WHEREAS, on October 20, 1983, Hennepin County District Court
issued ari Order for Deposit which granted title to certain
properties by condemnation, to the City, for public road purposes;
and
WHEREAS, one of the properties awarded by the condemnation
Order was and 'is currently owned by R & S Investrnent Co., a
Minnesota partnership, and is legally described in Hennepin County
and upon the Amended Petition for Condemnation as:
Lots 1, 2, 3 and 4, Block 44, "St. Loris Park", Lots 6
to 11 inclusive, Block 44, Rearrangement of St. Louis
Park, according to the plats thereof on file or of
record in the Office of the Register of Deeds.
(Hereinafter referred to as "Condemnation Property"); and
WHEREAS, the City determined that a large portion of the
Condemnation Property was not needed for the public purpose
intended, and requested a deed from R & S Investrnent Co. for
property specifically described in Hennepin County as:
That part of said Lot 6 lying westerly of the following
described line: Commencing at the northeast corner of
Block 44, Rearrangment of St. Louis Park; thence
westerly 110.00 feet along the north line of said
Block 44 to the point of beginning of the line to be
described; thence southerly at a right angle, to the
southwesterly line of said Block 44 and there
terminating.
(Hereinafter referred, to as the "Conveyed Property"),
which property was conveyed by R & S Investment Co., a Minnesota
partnership, to the City on October 17, 1983, and filed with the
Hennepin County Registrar of Titles upon Certificate of Title
No. 531225, on January 12, 1984 as document #1557157; and
WHEREAS, R & S Investment Co. granted the City a temporary
constlrrction easement, which by its terms, expired on
November 15, 1988; and
WHEREAS, R & S investment Co., a Minnesota parinership, has
requested the City to convey the portion of the Condemnation
Property not needed for public purposes, excepting the Conveyed
Property.
BE IT RESOLVED, that the Mayor and City Manager, or their
designees, are hereby authorized on behalf of the City to execute
any and all documents necessary to convey the portion of the
Condemnation Property not needed for public purposes, excepting
the Conveyed Property and subject to any existing easements of
record.
This ordinance will take effect 15 days after its publication.
