HomeMy WebLinkAbout1782-89 - ADMIN Ordinance - City Council - 1989/04/171 ORDINANCE NO. 17U-82 AN ORDINANCE VACATING PUBLIC UTILITY EASEMENT 3620 DECATUR AVENUE THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. A petition in writing signed by a majority of all of the owners of all property abutting upon both sides of the public utility easement proposed to be vacated has been duly filed with the City Clerk, requesting vacation of the public utility easement, and the City Clerk has furnished a copy of said petition to the City Manager who has reported filing of same to the newspaper, the St. Louis Park Sailor, on March 20, 1989 as directed by the said notice and has conducted a public hearing upon said petition and has determined_ that the public utility easement is not needed for public purposes, and that it is for the best interest of the public that said public utility easement be vacated. Section 2. The following described public utility easement, as now dedicated and laid out within the corporate limits of the City of St. Louis Park, is vacated: That part 9f the existing drainage and utility easement located on Lot 3, Block 1, The Federation Addition, Hennepin County, Minnesota, described as follows: Commencing at the southeast corner of said Lot 3; thence South 69 degrees 23 minutes 51 seconds West 52.12 feet along the southerly line of said Lot 3; thence North 68 degrees 39 minutes 00 seconds West 131.00 feet along the northerly line of an existing drainage and utility easement and the westerly extension thereof to the point of beginning; thence North 209.60 feet along the west line of another existing drainage and utility easement; thence North 69 degrees 23 minutes 51 seconds East 5.34 feet along the northerly line of said existing drainage and utility easement; thence South 213.44 feet; thence North 68 degrees 39 minutes 00 seconds West 5.37 feet to the point .of beginning (Torrens Certificate Number 72575) Section 3. The City Clerk is instructed to record certified copies of this ordinance in the Office of the Hennepin County Register of Deeds or Registrar of Titles as the case may be. Section 4. This ordinance shall be approved subject to the following conditions: 1. Approval of the special permit for a nursing home. 2. The costs associated with moving the watermain will be the responsibility of the developer. Section 5. This ordinance shall take effect fifteen days after its publication.
