AN ORDINANCE VACATING PUBLIC ALLEY
Lying Easterly of Wooddale Avenue Between
36th and 37th Streets
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. A petition in writing signed by a majority of all of the owners of all
property abutting upon both sides of the public alley proposed to be vacated has been
duly filed with the City Clerk, requesting vacation of the public alley, and the City Clerk
has furnished a copy of said petition to the City Manager who has reported filing of same
to the newspaper, the St. Louis Park Sailor, on January 17, 1989 as directed by the said
notice and has conducted a public hearing upon said petition and has determined that the
public alley is not needed for public purposes, and that it is for the best interest of the
public that said public alley be vacated.
Section 2. The following described public alley, as now dedicated and laid out
within the corporate limits of the City of St. Louis Park, is vacated:
The portion of the alley lying easterly of Wooddale Avenue between 36th and
37th Streets for a distance of approximately 250 feet located in:
Lots 1 to 4 inclusive and all of vacated alley and adjoining 1/2 of Yosemite
Avenue vacated, Block 1, Collins 2nd Addition to St. Louis Park, and
Lots 6 to 11 inclusive, Block 44, Rearrangement of St. Louis Park and Lots 1 to
4 inclusive, Block 44, St. Louis Park, except roads.
reserving, however, to the City of St. Louis Park any and all easements that may exist
in, over, and across the described property for storm sewer, sanitary sewer, water main,
and public utility purposes.
Section 3. Recording of this ordinance shall be contingent upon satisfaction of the
following conditions:
a. The applicant, Quadion Corporation, shall provide recordable
evidence to the City of its purchase of the property described as
Lots 6 through 11, Block 44, Rearrangement of St. Louis Park, and
Lots 1 through 4 inclusive, Block 44, St. Louis Park, except roads.
b. The applicant, Quadion Corporation, shall provide evidence of
concurrence in this vacaton by U.S. West Corportion, with particular
reference to the disposition of the telephone facilities located in
the alley proposed to be vacated.
Section 4. The City Clerk is instructed to record certified copies of this ordinance
in the Office of the Hennepin County Register of Deeds or Registrar of Titles as the
case may be.
Section 5. This ordinance shall take effect fifteen days after its publication.
