HomeMy WebLinkAbout1772-88 - ADMIN Ordinance - City Council - 1988/12/19"Replacement" ORDINANCE NO. 1772-88 AN ORDINANCE VACATING PUBLIC STREET Easterly 370 Feet of Gamble Drive THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. A petition in writing signed by a majority of all of the owners of all property abutting upon both sides of the public street proposed to be vacated has been duly filed with the City Clerk, requesting vacation of the public street, and the City Clerk has furnished a copy of said petition to the City Manager who has reported filing of same to the newspaper, the St. Louis Park Sun/Sailor, on October 24, 1988 as directed by the said notice and has conducted a public hearing upon said petition and has determined that the public street is not needed for public purposes, and that it is for the best interest of the public that said public street be vacated. Section 2. The following described public street, as now dedicated and laid out within the corporate limits of the City of St. Louis Park, is vacated: That part of Tract A, Registered Land Survey No. 1607 lying East of the Southerly extension of the Westerly line of Tract D, Registered Land Survey No. 1599. Subject to reservation and grant of of an easement for utility and drainage purposes legally described as follows: An easement for utility and drainage purposes over that part of Tract A, Registered Land Survey No. 1607, Hennepin County, Minnesota,lying Easterly of the following described Line "A" and Westerly of the following described Line "B" Line "A": Beginning at the Southwest corner of Tract D, Registered Land Survey No. 1599, Hennepin County, Minnesota, said corner being on the North line of said Tract A; thence Southerly along the Southerly extension of the Westerly line of said Tract D a distance of 66.00 feet, more or less, to the South line of said Tract A, and there terminating. Line "B": Commencing at the said Southwest corner of Tract D, Registered Land survey No. 1599; thence Easterly along-tbe TTorth-Tine of said Tract A a distance of 34.89 feet to the point of beginning of said Line "B" to be described; thence Southerly, parallel with said Line "A" a distance of 66.00 feet, more or less, to the South line of said Tract A, and there terminating. AND An easement for storm sewer purposes 10.00 feet in width, lying between an elevation of 877.00 feet and 867.00 feet N.G.V.D.-1929, sea level datum, the centerline of said easement being 23.00 feet South of and parallel with the North line of Tract A, Registered Land Survey No. 1607, Hennepin County, Minnesota, and lying Easterly of the following described Line "B" and Westerly of the following described Line "C"; Line "B": Commencing at the southwest corner of Tract D, Registered Land Survey No. 1599; thence Easterly along the North line of said Tract A a distance of 34.89 feet to the point of beginning of said Line "B" to be described; thence Southerly, parallel with said Line "A" a distance of 66.00 feet, more or less, to the South line of said Tract A, and there terminating. Line "C": Commencing at the said Southwest corner of Tract D, Registered Land Survey No. 1599; thence Easterly along the North line -of said Tract A a distance of 222.90 feet to the point of beginning of said Line "C: to be described; thence Southerly, parallel with said Line "A" a distance of 66.00 feet, more or less, to the South line of said Tract A, and there terminating. AND An easement for storm sewer, sanitary sewer, and water main purposes over that part of Tract A, Registered Land Survey No. 1607, Hennepin County, Minnesota, lying Easterly of the following described line: Commencing at the southwest corner of Tract D, Registered Land Survey No. 1599, Hennepin County, Minnesota, said corner being on the North line of said Tract A; thence Easterly along the North line of said Tract A a distance of 222.90 feet to the point of beginning of the line to be described; thence Southerly, parallel with the Southerly extension of the Westerly line of said Tract D a distance of 66.0 feet, more or less, to the South line of said Tract A, and there terminating. Section 3. The City Clerk is instructed to record certified copies of this ordinance in the Office of the Hennepin County Register of Deeds or Registrar of Titles as the case may be. Section 4.
