HomeMy WebLinkAbout1766-88 - ADMIN Ordinance - City Council - 1988/10/17ORDINANCE NO. 1766-88 AN ORDINANCE VACATING OF UTILITY EASEMENT 5051 HIGHWAY 7 THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. A petition in writing signed by a majority of all of the owners of all property abutting upon both sides of the utility easement proposed to be vacated has been duly filed with the City Clerk, requesting vacation of the utility easement, and the City Clerk has furnished a copy of said petition to the City Manager who has reported filing of same to the newspaper, the St. Louis Park Sun/Sailor, on September 5, 1988 as directed by the said notice and has conducted a public hearing upon said petition and has determined that the utility easement is not needed for public purposes, and that it is for the best interest of the public that said utility easement be vacated subject to the execution of a hold -harmless agreement between the petitioner and the City of St. Louis Park, which agreement shall indemnify and hold the City harmless for any liability arising out of actions resulting from the location of the subject building. Section 2. The following described utility easement, as now dedicated and laid out within the corporate limits of the City of,St. Louis Park, is vacated: Commencing at the northwest corner of Lot 1, Block 1, Dalquist Industrial Park, Hennepin County, Minnesota; thence South, assumed bearing, along the west line of said Lot 1, Block 1, Dalquist Industrial Park a distance of 196.00 feet to the north line of the 30.00 feet wide east -west utility easement as shown on the plat of said Dalquist industrial Park; thence South 89 degrees 45 minutes 07 seconds East along the north line of said utility easement a distance of 144.90 feet to the point of beginning of the building balcony easement to be described; thence South 9 degrees 45 minutes 06 seconds East a distance of 6.80 feet; thence North 80 degrees 14 minutes 54 seconds East a distance of 38.58 feet to the north line of said 30.0 feet wide utility easement; thence North 89 degrees 45 minutes 07 seconds West along said north line of the 30.00 feet wide utility easement a distance of 39.18 feet to the point of beginning. Commencing at the northwest corner of Lot 1, Block 1, Dalquist Industrial Park, Hennepin County, Minnesota; thence South, assumed bearing, along the west line of said Lot 1, Block 1, Dalquist Industrial Park a distance of 196.00 feet to the north line of the 30.00 feet wide east -west utility easement as shown on the plat of said Dalquist Industrial Park; thence South 89 degrees 45 minutes 07 seconds East along the north line of said utility easement a distance of 83.57 feet to the point of beginning of the building encroachment easement to be described; thence South 9 degrees 45 minutes 06 seconds East a distance of 9.45 feet; thence North 80 degrees 14 minutes 54 seconds East a distance of 53.61 feet to the north line of said 30.00 feet wide utility easement; thence North 89 degrees 45 minutes 07 seconds West along said north line of the 30.00 feet wide utility easement a distance of 54.44 feet to the point of beginning. Section 3. The City Clerk is instructed to record certified copies of this ordinance in the Office of the Hennepin County Register of Deeds or Registrar of Titles as the case may be. Section 4. This ordinance shall take effect fifteen days after its publication.
