ORDINANCE NO. 1765-88
AN ORDINANCE AMENDING THE ST. LOUIS PARK MUNICIPAL CODE
SECTION 14-303(3), RELATING TO THE SUBDIVISION AND
PLATTING OF LAND
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. The St. Louis Park Municipal Code Section
14-303(3)(d) is renumbered as Section 14-303(3)(c), and is further
amended to read as follows:
(c) Title Documents and Legal Review. No less then ten (10)
days prior to approval of a plat by the City Council,
the subdivider shall file with the City Attorney, at the
subdivider's expense, an attorney's title opinion
addressed to the City or an owner's policy of title
insurance which insures the City's interests in the
plat, in an amount to be determined by the City,
covering the property described in the plat. Based upon
said title opinion or title insurance policy, the City
Attorney shall furnish the City Clerk with the
Certificate of Approval required by Section
14-303(3)(e)(i) of this ordinance.
Section 2. The St. Louis Park Municipal Code, Section
14-303(3)(c) is renumbered as Section 14-303(3)(d), and is further
amended to read as follows:
(d) Action by City Council. The final plat shall be on the
agenda of the City Council at a regular meeting held not
less than ten (10) nor more than thirty (30) days
following the date on which the final plat was
officially filed. The Council shall act to approve or
disapprove the final plat within thirty (30) days after
its initial consideration of the final plat. Approval
of a plat by the Council shall in all cases be subject
to the Certificate of Approval of the City Attorney
required by Section 14-303(3)(e)(i) of this ordinance,
and execution of any contract for improvements as
hereinafter provided. If either the City or the
developer desires to have any existing public easements
or rights-of-way vacated in connection with the final
plat and related development, the Council shall not act
to approve or disapprove the final plat until it shall
have received the Certificate of Approval of the City
Attorney required by Section 14-303(3)(e)(i) of this
ordinance.
Section 3. The St. Louis Park Municipal Code Section
14-303(3)(e)(i) is amended to read as follows:
(i) A Certificate of Approval of the City Attorney, based
upon the title opinion or title insurance policy
provided by the subdivider as described above, which
certifies that the plat has been properly executed by
the owners and encumbrancers of the property described
therein, and is in proper legal form to accomplish
subdivision of the land and dedication of all public
streets and other ways, and any easements, parks or
areas otherwise dedicated to the City;
Section 4. This ordinance shall take effect fifteen days
after its publication.

Approval
