AN ORDINANCE AMENDING THE ST. LOUIS PARK ORDINANCE CODE
SECTION 9-307 GARBAGE/REFUSE SERVICE RATES
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. That section 9-307 entitled "Garbage/Refuse Service Rates" is
hereby amended to read:
Section 9-307. Garbage/Refuse Service Rates
A service charge for garbage/refuse collection, including recycling
service and grass/leaf collection service, provided to residential
dwelling units within the City) shall be: $33.00 per quarter ($11.00
per month).
A dwelling unit shall include all residential dwellings with one through
four living units except condominiums.
A recycling credit of $6.60 per quarter shall be deducted from the
quarterly service charge for garbage/refuse collection for any residential
dwelling units which participate in the recycling service at least
three times in a billing quarter.
A monthly service charge of $3.00 shall be added to the quarterly service
charge for garbage/refuse collection for any residential dwelling unit
which mixes grass/leaves with refuse.
Section 2. Refuse rates shall be effective May 1, 1988.

A recent Minnesota Court of Appeals decision struck down Minnesota Statute
609.501(2) which is consistent with the St. Louis Park ordinance 12 -1001.
The statute prohibits obstructing the legal process or arrest and applies
to any person who interferes with a peace officer while the officer is engaged
in the performance of official duties. The court found the statute too broad
since the interference could include verbal conduct which is constitutionally
invalid.
Attached is Section 12-1W1 of the St. Louis Park ordinance code as amended
to comply with the court's decision.
Recommendation: It is recommended Council waive first reading, set second
reading for -larch 21, 1988.
