ORDINANCE NO. 1736-88
AN ORDINANCE AUTHORIZING CONVEYANCE
BY THE CITY OF ST. LOUIS PARK
OF PROPERTY LOCATED WITHIN
THE EXCELSIOR BOULEVARD REDEVELOPMENT DISTRICT
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. The City Council has previously approved the
preliminary plat for On The Avenue and the special permit for the
development of On The Avenue consisting of a retail shopping
center, a hotel and a residential housing unit.
Section 2. The Property subject to this Ordinance is located
within the Excelsior Boulevard Redevelopment District.
Section 3. City Council has previously approved the
Excelsior Boulevard Redevelopment District Plan which provides
for redevelopment of the property subject to this ordinance.
Section 4. The City Council has determined that there is no
City public need for the property subject to this Ordinance.
Section 5. Pursuant to Certificate of Title No. 81892,
Hennepin County Registrar of Titles, the Village of St. Louis
Park is fee owner of that property legally described on Exhibit A
attached hereto and made a part hereof (the water tower parcel).
Section 6. Pursuant to that warranty deed dated September
21, 1983, by and between Yngve and Yngve, a co -partnership
consisting of John A. Yngve and Albert B. Yngve, grantors, and
the City of St. Louis Park, grantee, recorded October 7, 1983, as
Document No. 4833408, and that warranty deed dated September 21,
1983, by and between John A. Yngve and Carrie Yngve, husband and
wife, and Albert B. Yngve, a single person, grantors, and The
City of St. Louis Park, grantee, recorded October 7, 1983, as
Document No. 4833409, the City of St. Louis Park is fee owner of
that property legally described on Exhibit B attached hereto and
made a part hereof (Yngve parcel).
Section 7. Pursuant to that quit claim deed dated December
15, 1987, by and between the State of Minnesota, grantor and the
City of St. Louis Park, grantee, and that Order for Deposit dated
October 20, 1983 in the matter of the City of St. Louis Park,
petitioner, vs. Sidney Lorber, as successor trustee of the Elly
Phillips Trust and of the Residuary Trust under The Last Will and
Testament of Nicholas B. Phillips, deceased, dated December 11,
1953, et al, Hennepin County District Court, Fourth Judicial
District Court File No. CD 1805, recorded in the office of the
Hennepin County Recorder on November 3, 1983, as Document No.
4842071, the City of St. Louis Park is fee owner of that property
legally described on Exhibit C attached hereto and made a part
hereof (right-of-way parcel).
Section 8. The proposed plans for development of On The
Avenue provide that the water tower parcel, Yngve parcel and
right-of-way parcel be conveyed to The Housing and Redevelopment
Authority of St. Louis Park, Minnesota, for platting and to allow
for future conveyance.
Section 9. The Mayor and City Manager are instructed to
execute on behalf of the City, the necessary quit claim deeds to
convey the water tower parcel, Yngve parcel and right-of-way
parcel to The Housing and Redevelopment Authority of St. Louis
Park, Minnesota.
Section 10. The City Clerk is instructed to deliver two (2)
certified copies of this Ordinance together with the executed
quit claim deeds referenced in Section 9 above to Guaranty Title,
Inc. for recording in the office of the Hennepin County Recorder
and the Hennepin County Registrar of Titles.
Section 11. This Ordinance shall take effect fifteen (15)
days after its publication.
Adopted by the City Council February 1, 1988.

EXHIBIT A
Water Tower Property
All that part of the Northwest Quarter of the Northwest Quarter
(NW 1/4 NW 1/4) of Section Seven (7), Township Twenty-eight (28),
Range Twenty-four (24) bounded as follows: Beginning at a point
on the center line of the "Minneapolis and Excelsior Road"
(so-called) as now located across said subdivision of said
Section which point of beginning is eight hundred fifty and
five -tenths (850.5) feet southwesterly from the point formed by
the intersection of the center line of said road with the east
line of the Northwest Quarter of the Northwest Quarter (NW 1/4 NW
1/4) of said Section; thence in a northwesterly direction at
right angles with the center line of "Minneapolis and Excelsior
Road" four hundred fifty and thirty-three one -hundredths (450.33)
feet; thence in a northeasterly direction and parallel with the
center line of said "Minneapolis and Excelsior Road" one hundred
ninety-three and forty-seven one -hundredths (193.47) feet; thence
in a southerly direction one -hundred forty-three and fifty-four
one -hundredths (143.54) feet to a point that is three hundred
eighteen and forty-four one -hundredths (318.44) feet
northwesterly from and in a line that extends at right angles
northwesterly from the center line of said "Minneapolis and
Excelsior Road"; thence along said line a distance of sixty-eight
and forty-four one -hundredths (68.44) feet; thence southwesterly
on a line parallel to the center line of said Road one hundred
(100) feet; thence southeasterly on a line parallel to the first
mentioned line two hundred fifty (250) feet to an intersection
with the center line of said Road; thence southwesterly along
said center line thirty-six and eighty-one one -hundredths (36.81)
feet to the point of beginning.
NOTE: Said property being registered as is evidenced by
Certificate of Title No. 81892.

Commencing at a point in the west line of said section 7,
distant 836.91 feet south of the northwest corner thereof;
thence north 76° east 65 feet to the easterly line of State
Highway No. 100; thence continuing north 76° east 75 feet;
thence north 133.4 feet to the actual point of beginning;
thence continuing north on last described line 46.65 feet;
thence deflect to the left in a westerly direction 99°36' for
104.73 feet, more or less, to the easterly right of way line
