ORDINANCE NO.
1734-88
AN ORDINANCE VACATING PUBLIC EASEMENTS
Northeast corner of Highway 100/Excelsior Boulevard
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. A petition in writing signed by a majority of all of the owners of all
property abutting upon both sides of the public easements proposed to be vacated has
been duly filed with the City Clerk, requesting vacation of the public easements, and the
City Clerk has furnished a copy of said petition to the City Manager who has reported
filing of same to the newspaper, the St. Louis Park Sun/Sailor on January 4, 1988 as
directed by the said notice and has conducted a public hearing upon said petition and
has determined that the public easements is not needed for public purposes, and that it is
for the best interest of the public that said public easements be vacated.
Section 2. The following described public easements, as now dedicated and laid out
within the corporate limits of the City of St. Louis Park, are vacated:
Easements on property located at the northeast corner of Highway 100/Excelsior
Boulevard, a tract of land containing approximately 12 acres which is also the
subject of a new subdivision called "On The Avenue" and consisting of at least
the following:
1) Utility and Fire Hydrant Easement, Hennepin County Registrar of
Titles - Document No. 1738125
2) Sidewalk Easement, Hennepin County Recorder - Document No. 4224409
3) Temporary Construction Easements, Hennepin County -Recorder - Document
Nos. 4890420 and 4858594
Section 3. The City Clerk is instructed to deliver to Guaranty Title Inc. two
certified copies of this ordinance for recording in the Offices of the Hennepin County
Registrar of Titles and the Hennepin County Recorder.
Section 4. This ordinance shall take effect fifteen days after its publication.
