ORDINANCE NO. 1723-87
AN ORDINANCE REPEALING ORDINANCE NO. 1691-86
ADOPTED ON SEPTEMBER 2, 1986, AND
VACATING UTILITY, DRAINAGE AND PEDESTRIAN EASEMENT
LOTS 2 AND 3, BLOCK 1, BELTLINE BUSINESS PARK
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. Ordinance No. 1691-86, entitled "An Ordinance Vacating Public Utility
Easement - Beltline Business Park" and adopted by the City Council on September 2, 1986,
is hereby repealed and replaced by the following:
Section 2. A petition in writing signed by a majority of all of the owners of all
property abutting upon both sides of the utility, drainage and pedestrian easement proposed
to be vacated has been duly filed with the City Clerk, requesting vacation of the utility,
drainage and pedestrian easement, and the City Clerk has furnished a copy of said petition
to the City Manager who has reported filing of same to the newspaper, the St. Louis
Park Sun/Sailor, on September 7, 1987, as directed by the said notice and has conducted
a public hearing upon said petition and has determined that the utility, drainage and
pedestrian easement is not needed for public purposes, and that it is for the best interest
of the public that said utility, drainage and pedestrian easement be vacated.
Section 3. The following described utility, drainage and pedestrian easement, as
now dedicated and laid out within the corporate limits of the City of St. Louis Park, is
vacated:
A 20 -foot wide utility, drainage and pedestrian easement being 10
feet on each side of the lot line between Lots 2 and 3, Block 1,
Beltline Business Park, which lies southerly of the northerly 10 feet
of said Lots 2 and 3 and northerly of the westerly extension of a
line drawn parallel to and 15 feet northerly of the southerly line
of said Lot 3.
Section 4. The City Clerk is instructed to record certified copies of this ordinance
in the Office of the Hennepin County Register of Deeds or Registrar of Titles as the
case may be.
Section 5. This ordinance shall take effect fifteen days after its publication.
