HomeMy WebLinkAbout1694-86 - ADMIN Ordinance - City Council - 1986/09/15ORDINANCE NO. 7694-86 AN ORDINANCE APPROVING AN EXCHANGE OF PROPERTY BETWEEN THE CITY OF ST. LOUIS PARK AND ROBERT H. MEYER & ASSOCIATES, INC. THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. The City engineering staff has determined that it is necessary to place a slope easement over property currently owned by Robert H. Meyer & Associates (hereinafter known as "Meyer"), which property is legally described in Hennepin County as: That part of Lots 11 and 12, Block 1, Lewiston Park, Hennepin Co. Minn. which lies Westerly of a line drawn parallel to and 46 feet Easterly of the following described line: Commencing at the most Southerly corner of Lot 1, Block 1, BELT LINE INDUSTRIAL PARK 2ND ADDITION, thence South 59 degrees 15 minutes 24 seconds East on an assumed bearing along the Southeasterly extension of the Southwesterly line of said Lot 1 a distance of 40.00 feet to the point of beginning of said line; thence North 30 degrees 44 minutes 36 seconds East 112.38 feet; thence Northerly 768.57 feet along a tangential curve concave to the West having a radius of 785.30 feet and a central angle of 56 degrees 04 minutes 30 seconds; thence North 25 degrees 19 minutes 54 seconds West, -tangent to last described curve, 180.04 feet; thence Northerly 589.17 feet along a tangential curve concave to the East having a radius of 1268.10 feet a central angle of 26 degrees 37 minutes 12 seconds, said line there terminating. (Hereinafter known as "Easement Property"). Section 2. Meyer has indicated a willingness to give the Easement Property to the City in exchange for property owned by the City which Meyer desires to use for parking purposes. Said property as owned by the City is legally described in Hennepin County as: That part of Lot 4, Block 1, Dalquist Industrial Park, which lies Easterly of a line drawn parallel 4... ....00.74. to and 46 feet Easterly of the following described line, excepting the east 37 feet of said Lot 4: Commencing at the most Southerly corner of Lot 1, Block 1, BELT LINE INDUSTRIAL PARK 2ND ADDITION, thence South 59 degrees 15 minutes 24 seconds East on an assumed bearing along the Southeasterly extension of the Southwesterly line of said Lot 1 a distance of 40.00 feet to the point of beginning of said line; thence North 30 degrees 44 minutes 36 seconds East 112.38 feet; thence Northerly 768.57 feet along a tangential curve concave to the West having a radius of 785.30 feet and a central angle of 56 degrees 04 minutes 30 seconds; thence North 25 degrees 19 minutes 54 seconds West, tangent to last described curve, 180.04 feet; thence Northerly 589.17 feet along a tangential curve concave to the East having a radius of 1268.10 feet a central angle of 26 degrees 37 minutes 12 seconds, said line there terminating. Subject to easement for pedestrian way slope and utility purposes over that part of the above described tract lying Westerly of a line drawn parallel to and 20 feet East of the Westerly line and Southerly of a line drawn parallel to and 20 feet Northwesterly of the Southeasterly line of said parcel. Subject to existing utility easements. (Hereinafter known as "City Property"). Section 3. An Agreement has been drawn between the City and Meyer outlining the terms of a proposed exchange, said terms have been consented to by Meyer and approved by, City staff, and said terms include an exchange of fee title to the respective properties between the parties by quit claim deed. Section 4. The St. Louis Park City Council hereby directs and authorizes the Mayor and City Manager to execute any and all instruments necessary to complete the exchange of the above cited properties, according to the terms of the approved agreement. Section 5. This ordinance shall take effect 15 days following its publication. Adopted by the City Council September 15 , 1986. itiA4.
