HomeMy WebLinkAbout1671-86 - ADMIN Ordinance - City Council - 1986/01/06ORDINANCE NO. 1671-86 AN ORDINANCE APPROVING THE DISPOSITION OF PROPERTY KNOWN AS BELT LINE BOULEVARD THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. A petition in writing signed by a majority of all of the owners of all property abutting both sides of portions of a public street known as Belt Line Boulevard, proposing disposition of portions of Belt Line Boulevard, has been duly filed with the City Clerk, and the City Clerk has furnished a copy of said petition to the City Manager who has reported filing of the same to the newspaper, the St. Louis Park Sun/Sailor, on Monday, December _2_, 1985 as directed by the said notice and has conducted a public hearing upon said petition and has determined that the public street is not needed for public purposes, and that it is in the best interest of the public that the land designated for public street be disposed of by deed. Section 2. The portions of the public street in question, Belt Line Boulevard, were acquired in fee title by the City of St. Louis Park through a condemnation action and were awarded to the City by a Final Certificate of condemnation dated May 7, 1972 and filed with the Hennepin County Register of Deeds on May 17, 1972 as document number 3946670. The portions of the street to be disposed of by deed, are within the corporate limits of the City of St. Louis Park and are described in Hennepin County as: I. That part of the Northeast Quarter of Section 6, Township 28, Range 24, Hennepin County, Minnesota lying 50.00 feet on each side of LINE 1 and 50.00 feet northerly of LINE 2 described as follows: Commencing at the Southwest corner of the Northeast Quarter of the Southwest Quarter of said Section 6; thence on an assumed bearing of South 88 degrees 47 minutes 27 seconds East along the south line of said Northeast Quarter of the Southwest Quarter 618.28 feet to the actual point of beginning of said LINE 1; thence North 30 degrees 44 minutes 36 seconds East 1185.78 feet; thence North 59 degrees 15 minutes 24 seconds West 10.00 feet; thence northeasterly 594.53 feet along a nontangential curve, concave to the southeast having a radius of 1336.71 feet and a central angle of 25 degrees 29 minutes 00 seconds, the chord of said curve bears North 43 degrees 29 minutes 06 seconds East; thence North 56 degrees 13 minutes 36 seconds East 49.40 That part of the Southeast Quarter of the Northeast Quarter of Section 6, Township 28, Range 24, Hennepin County, Minnesota lying northerly of a line drawn from a point in the east line of said Southeast Quarter of the Northeast Quarter, distant 36.30 feet south of the northeast corner thereof to a point in the west line of said Southeast Quarter of the Northeast Quarter, distant 494.40 feet south of the northwest corner thereof and which lies southerly of a line 50.00 feet southerly of the following described line: Commencing at the Southwest corner of the Northeast Quarter of the Southwest Quarter of said Section 6; thence on an assumed bearing of South 88 degrees 47 minutes 27 seconds East along the south line of said Northeast Quarter of the Southwest Quarter 618.28 feet; thence North 30 degrees 44 minutes 36 seconds East 1185.78 feet; thence North 59 degrees 15 minutes 24 seconds West 10.00 feet; thence northeasterly 594.53 feet along a nontangential curve, concave to the southeast having a radius of 1336.71 feet and a central angle of 25 degrees 29 minutes 00 seconds, the chord of said curve bears North 43 degrees 29 minutes 06 seconds East; thence North 56 degrees 13 minutes 36 seconds East 49.40 feet; thence northeasterly 1183.40 feet along a tangential curve, concave to the southeast having a radius of 9632.80 feet and a central angle of 07 degrees 02 minutes 20 seconds to the point of beginning said line; thence continue northeasterly 1206.77 feet along last described curve, concave to the southeast, having a radius of 9632.80 feet and a central angle of 07 degrees 10 minutes 40 seconds; thence North 70 degrees 26 minutes 36 seconds East, tangent to last described curve 237.52 feet to the intersection with the east line of said Northeast Quarter and said Line there terminating. Excepting therefrom the east 70.00 feet of said Southeast Quarter of the Northeast Quarter. Containing 0.37 Acres reserving, however, to the City of St. Louis Park any and all necessary easements in, over, and across the above described properties for drainage, utility and pedestrian way purposes. Section 3. The City Clerk is instructed to record certified copies of this ordinance in the Office of the Hennepin County Register of Deeds or Registrar of Titles as the case may be. feet; thence northeasterly 1183.40 feet along a tangential curve, concave to the southeast, having a radius of 9632.80 feet and a central angle of 07 degrees 02 minutes 20 seconds to the terminus of said LINE 1 and the beginning of said LINE 2; thence continue northeasterly 1206.77 feet along last described curve, concave to the southeast, having a radius of 9632.80 feet and a central angle of 07 degrees 10 minutes 40 seconds; thence North 70 degrees 26 minutes 36 seconds East, tangent to last described curve, 237.52 feet to the intersection with the east line of said Northeast Quarter and said LINE 2 there terminating. Containing 5.05 Acres II. Excepting therefrom that part that lies within the east 70.00 feet of said Northeast Quarter. Containing 1.56 Acres Section 4. This ordinance shall take effect fifteen days after its publication.
